Minutes of Zoning Board of Appeals Public Meeting

Date:           October 22, 2008
Time:           4:00 PM
Attendees:      Chair Vern Jacob,  Bruce Drucker, Robert Hankey, William Nicholson, Roger Putnam, Don Palladino, Manny Heyliger, Tom Reinhart and Christine Bates, Committee Secretary.

Chair Vern Jacob opened the meeting at 4:05 pm. and informed the applicants and audience of the procedures for the meeting.

Public Hearings:  
Community Housing Resource, Inc., (Town of Wellfleet) 250 Gull Pond Rd., Map 8, Parcel 39:  Application for Comprehensive Permit (MGL CH 40B, S20-23), development of five (5) units of affordable and median income housing for first time home buyers on a single lot. (Cont’d from 9/25/08).  The Board remained the same with Vern Jacob, Bruce Drucker, Robert Hankey, Manny Heyliger and Don Palladino replacing William Nicholson with the applicant’s approval.  

William Nicholson stated he does not feel the road is safe and is concerned with people parking on Gull Pond Road in bad weather and feels there are other options available.  

The Board determined to take a vote to determine if they approved the driveway plans  as presented by East Cape Engineering dated 10/03/08.  Attorney Freeman stated the conditions that Coastal Engineering recommended would be included in the decision.  

Vern Jacob moved that the Board vote if they are in favor of the driveway which would be subject to further review of the conditions of the road.  3 in favor; 2 against.

William Nicholson excused himself at 4:20 pm.

The Board, Attorney Freeman, Ted Malone and Tim Brady reviewed the findings and made amendments.

There was discussion if the stop sign is owned by the Town or the Condo association and Freeman stated the maintenance of the sign can be added as a condition.    

Freeman stated the Housing Authority would be responsible for monitoring the maintenance fund of the homeowners, the maintenance of the driveway in terms of erosion, revegetation, etc.  The driveway will be private and the Building Inspector has the right to enforcement.  Malone stated there would be a notice sent to the owners one year after occupancy, which would also be sent to the Building Inspector for his monitoring of the integrity of the road and the revegetation.  

Willmer was in agreement to strike the proposed condition 20.  Malone stated he will work with the Department of Public Works to see if they could make new road stripes on Gull Pond.  

Vern Jacob moved to approve the Comprehensive Permit and Conditions; seconded by Bruce Drucker; passed 5-0.
Vern Jacob moved to grant the waivers as amended; seconded by Manny Heyliger; passed 5-0.

Drucker moved to adjourn at 6:30 pm; seconded by Manny Heyliger; passed 7-0
