Chair Pontbriand called the meeting to order at 7:00 pm.

7:00 pm         06-03   Kevin J. Doherty/Marcia T. Allen, 54 Hiller Avenue, Map 20, Parcel 68:  Application for a Special Permit under WZB 6.1.5:  Replace existing garage with a one story structure to include a bedroom, bathroom, and storage area.   The applicant sent a letter dated January 25, 2006 requesting a continuation to March 9, 2006.   Trevor Pontbriand moved to continue the hearing to March 9, 2006; seconded by Jeffrey Stewart, passed 6-0.  

7:02 pm         06-04  Mark and Christine Washburn, 20 Third Avenue, Map 40, Parcel 95:  Construct second story addition to a pre-existing non-conforming structure under WZB 6.1.5.1  The Board for this hearing was Trevor Pontbriand, Jeffrey Stewart, Bruce Drucker, Charles Amsler and Sibel Asantugrul.   Mark Washburn, applicant, stated the structure was originally built in 1972, and that a full foundation was constructed in 1988.  The existing lot coverage is 16.1% and will be reduced to 13.3% with the proposed renovation.  There will be an increase of 1,050 square feet of living space with the addition of the second story.  The proposed renovation will eliminate the existing 3 ½ foot roof overhang and the enclosed porch.  A letter from Julian E. AvRutic dated January 17, 2006 was read which included some questions about the renovation.  Joyce Harding, of the audience, asked if there would be a change in the number of bedrooms.  Mr. Washburn stated that the number of bedrooms will remain at three.  The proposed second story deck will be of permeable construction and not counted as lot coverage.  Because some of the work will be done in the 100 foot buffer zone, the applicant will have to go before the Conservation Commission.  Mr. Washburn explained the bulkhead needs to be moved due to the location of the front door.  Everything else will remain on the existing footprint.  Trevor Pontbriand moved for Findings of Fact:
The existing non-conformities are inadequate lot area, intrusions into the front, rear and North side setbacks, and lot coverage.
There will be no change in or increase in use
The lot coverage will be reduced from 16.1% to 13.3%

The new structure will be built entirely upon the existing foundation.
There will be an approximately 100% increase in square feet of living area.
There will be a substantial volumetric increase; however, the volumetric increase with the setbacks will be minimal.
The proposed two-story building is in keeping with the general characteristics of the neighborhood.
Pontbriand moved to approve the Findings of Fact; seconded by Bruce Drucker; passed 5-0.
Pontbriand moved to grant the Special Permit based on the Findings of Fact; seconded by Bruce Drucker; passed 5-0.

7:35 pm        05-43  Francis Turpin, 393 Bound Brook Way, Map 6, Parcel 10:  Application for a Special Permit to construct a new septic system, garage, and rebuild house on existing footprint (Cont’d from 01/12/06).  The case was originally continued to February 9; however, at the request of Attorney Hammatt, the Board agreed to move the hearing up to January 26, 2006.  The Board for this hearing was Trevor Pontbriand, Sibel Asantugrul and Vern Jacob, with Bruce Drucker replacing William Nicholson  and Jeffery Stewart replacing Robert Hankey, to which Attorney Hammatt agreed.  Attorney William Hammatt represented the applicant.  The meeting minutes of January 12, 2006 were read into the records.  Pontbriand read a letter from the National Seashore dated 01/23/06 into the record.  A new site plan was distributed to the Board identifying the revised location of the outdoor stairs on the southeast side of the house, as well as the elimination of the proposed garage.  The Turpins’ have reached an agreement with the abutter to purchase the necessary land.  Hammatt stated the Town of Truro Zoning Board of Appeals has approved a Special Permit.  Pontbriand moved for Findings of Fact:
This property is unique in that it is bisected by the town line, and lies partially within the Town of Truro and partially within the Town of Wellfleet.
The present structure is in a state of significant disrepair and the proposed reconstruction will be an improvement to the neighborhood.  
There will be no increase in use.
The new structure will be built entirely upon the existing footprint.
There will be a substantial volumetric increase.
There is no objection from abutters, the Town of Truro or the National Seashore.
Pontbriand moved to approve the Findings of Fact; seconded by Drucker; passed 5-0.
Pontbriand moved to grant the Special Permit based on the Findings of Fact; seconded by Drucker; passed 5-0.
Trevor Pontbriand moved to adjourn the meeting at 7:55 pm; seconded by Bruce Drucker; passed 6-0.
