Board of Water Commissioners

The meeting was called to order at 7:02 p.m. by Chairman Dale Donovan.  Commissioners in attendance included Ira Wood, Helen Miranda Wilson and Jerry Houk.  Commissioner Michael May was absent.  Town Administrator Tim Smith also attended.

The Board held the continuation of the public hearing to consider the Wellfleet Municipal Water System Rules and Regulations.

The Board discussed establishing a connection fee.  Wood moved and Wilson seconded a motion to set the connection fee at $10,000.  Discussion included  application of the connection fee i.e. condominiums and apartments as one property or individual units, residential properties with separate cottages, restaurants if usage exceeds one residential equivalent; hardship cases; costs for the new water system and recovery of those costs.  On a motion by Wood, seconded by Wilson, the Board voted unanimously to clarify the initial motion and to amend page 12, Section VIII of the Wellfleet Municipal Water System Fee Schedule, by changing the present fee of $4,000 to $10,000.

The Board discussed establishing user fees.  DPW Director Mark Vincent indicated that the current fees are in line with other towns.  On a motion by Donovan, seconded by Wilson, the Board voted unanimously to leave all other fees on page 12 as they stand.

Donovan indicated that the Rules and Regulations document will now be forwarded to Town Counsel.  Wood asked for a clarification of what constitutes a hook-up, specifically for condominiums and restaurants.  Wilson asked that her question regarding Section 5.10, Liability for Interruption of Water, be forwarded to Town Counsel.  The Town Administrator noted his response to Wilson’s question with information from the Town’s insurance carrier.

The Board received public comment on the Rules and Regulations.  Discussion included reserving capacity for the original ATBS, including the water system component chart in the definitions and the possibility of an effect on the building code by the water system.

On a motion by Wilson, seconded by Houk, to send Wilson’s question regarding the disclaimer of liability as drafted and discussed to Town Counsel with the Rules and Regulations, the Board voted 2-2, with Wood and Donovan voting against.

On a motion duly made and seconded, the Board voted unanimously to continue this public hearing to December 6, 2004 at 7:00 p.m.

On a motion by Wood, seconded by Wilson, the Board voted unanimously to adjourn at 9:19 p.m.
