Minutes

The meeting was called to order at 7:00 p.m. by Chairman Roger L. Putnam, Jr.  Selectmen present included Michael May, Dale Donovan and Michael Parlante.  Selectman Jerry Houk was absent.  Town Administrator Tim Smith also attended.

Open Session:
- Allison Marshak asked follow-up questions relative to Chairman Putnam's presentation to the Planning Board regarding a regional composting facility to serve the five Lower Cape towns.
- Bob Granville addressed the Board regarding the status and costs of capping the landfill and the quality of the compost produced at composting facilities.

On a motion by Parlante, seconded by May, the Board voted unanimously to accept the minutes of July 29, 2002 as presented.

On a motion by Parlante, seconded by May, the Board voted unanimously to release the executive session minutes dated July 27, 1998, April 2, 1998, March 24, 1998, March 20, 1998, March 16, 1998, March 2, 1998, February 2, 1998, January 27, 1998, January 20, 1998, January 5, 1998, December 5, 1997, November 17, 1997, November 13, 1997, October 22, 1997, October 10, 1997.

Town Administrator Comments - today is the starting date for construction of the new Senior Center and a pre-construction meeting is scheduled for 10 a.m. Thursday.

Correspondence - Selectman Donovan presented his correspondence report.  He noted receipt of a Disclosure Under G.L. Ch. 268A, S.19 (B) (1) form from Alfred Pickard of the Planning Board and a letter and an e-mail regarding Planning Board member Gerald Parentauthority, indicating that at any particular moment in time that a plan is submitted, he is acting in the best interest of the Town since he could have a business interest in the future.  The Board voted 3-1, with Donovan voting against, in favor of the motion.  Parlante moved and May seconded a motion to accept Alfred Pickard's disclosure.  Dennis O
Chairman Putnam announced that the second annual meeting of the Wellfleet Non-Resident Taxpayers Association is scheduled for August 18th at 2:00 p.m. at the United Methodist Church.

The Board held a public hearing on the application of Joel Fox and Anne Fox for Shellfish Grant Licenses #739, #739A and #754 located at Mayo Beach and consisting of approximately 5.47 acres.  Selectman Parlante recused himself and left the table.  Selectman Donovan read the public notice.  Selectman May disclosed that he holds a commercial shellfish permit.  Chairman Putnam disclosed that he holds a senior commercial shellfish permit.  Shellfish Constable Bill Walton was in attendance and presented his recommendation that these shellfish grant licenses be awarded to Joel and Anne Fox for a period of ten years commencing September 1, 2002 and ending on September 1, 2012.  On a motion by May, seconded by Donovan, the Board voted unanimously 3-0 to accept the recommendation of the Shellfish Constable.  Selectman Parlante rejoined the Board.

The Board discussed:
a) Early Retirement - Selectman May disclosed that he is an employee of the Town and a member of the Barnstable County Retirement Association.  Discussion included the costs to the Town and the need to replace retiring employees.  On a motion duly made and seconded, the Board voted unanimously to approve the early retirement program with the following restrictions:
- Six employees from Group 1 exclusively.
- Total of 5 years of service or age or combination of years of service and age.
- Application for early retirement must be submitted by November 15, 2002.
- Retirement date - December 31, 2002.
b) Requests to Use Town Property:
    - Wellfleet Oyster Festival Committee - Parlante moved and Donovan seconded a motion to approve the request of the Wellfleet Oyster Festival Committee to use Main Street, parking lots (Church and Main lot) and the Town Pier parking lot on Saturday, October 19th from 8 a.m. to 5 p.m. for an oyster festival street fair including craft booths, band on the Town Hall lawn and an oyster shucking contest.  Lisa Brown presented the Oyster Festival events calendar noting that the monies raised will go toward a scholarship or
  - Linda Blakemore - on a motion by Parlante, seconded by Donovan, the Board voted unanimously to approve the request of Linda Blakemore to use Newcomb Hollow Beach on September 7th from 4-8 p.m. for a family beach party and cookout and on September 8th from 3:30 to 4 p.m. for a wedding ceremony.
c) Gull Pond Lease (Jack's Boat Rentals) - discussion postponed (see below)
d) Appointment of Election Workers - on a motion by Parlante, seconded by Donovan, the Board voted unanimously to appoint the following election workers as submitted by the Wellfleet Town Democratic Committee:  Barbara Atwood, Zel Levin, Anne Ehrenberg, Claire Carroll, Donna DeVasto, Nancy Durkee, Anne C. Fox, Susan S. Gauthier, Mary Houk, Patricia D. Nugent, Janet P. Rice, Barbara Souther, Barbara Stevens, Terri Frazier, Katherine Stillman, Sheila Paine, Stephen Russell, Paul Weber, John M. Dooley, Mary Ann Dooley.
e) Town Clean-Up - Selectman Donovan suggested that the Board sponsor a Town-wide clean-up entitled "Our Town, Our Time" on September 21st with a broad participation by Town groups  culminating  in  a  social  event  i.e.  a  cookout  at  Mayo  Beach.    On  a  motion  by

     Donovan,  seconded  by  Parlante,  the  Board  voted  unanimously  to                 sponsor a  Town-wide clean-up.

Helen Miranda Wilson announced that a stormwater management workshop presented by DEP is scheduled for September 17th at 7:00 p.m. in the Library.

Beach Administrator Suzanne Thomas requested that the Board review the lease with Jack's Boat Rentals.  There was consensus to discuss this matter at the September 9th Board meeting.

On a motion by Parlante, seconded by May, the Board voted unanimously at 8:05 p.m. on a roll call vote (Donovan, May, Parlante, Putnam - yea) to enter executive session to discuss litigation and not to reconvene in open session.
