Wellfleet Planning Board
Minutes of Meeting on Wednesday, July 17, 2013
Senior Center Duck Pond Room, 7:00 p.m.



Present: Janet Reinhart, Chair; Andrew Freeman, Janet Morrissey, Gerald Parent, Alfred Pickard, R. Dennis O’Connell; Planning Consultant Patrice Carson

Chair Janet Reinhart called the meeting to order at 7:00 p.m.

Discussion with Building Inspector
Building Inspector Richard Stevens was present to discuss several issues of concern with the Planning Board.  Stevens addressed a list of questions, some submitted to him in advance. Topics included: updating zoning bylaws; cottage colonies; size calculation for houses in the Seashore District; fees for sheds; definitions of sheds; number of sheds; pods/storage containers; enforcement for commercial businesses in residential zones; temporary signs; signs on Town Hall property; walk-up windows at restaurants; notification for variances; and yearly renewal of business licenses.  The Building Inspector said he had no problem with accessory buildings and sheds except for the number of sheds allowed per lot.

PSD #13-03 2442 State Highway/Rte. 6
Chester Lay of Slade Associates presented a Preliminary Subdivision Plan (PSD #13-03)1 for Judith Thureson at 2442 State Highway/Route 6 (Map 23, Parcel 29).  He described the plantings that were proposed within the layout of the new road.  The road specifications would be included in the covenant, Mr. Lay said.  The Planning Board and Fire Chief Richard Pauley, who was in attendance, agreed that access to the new lot would be better if created from Joshua Lane.  

Parent moved to approve PSD #13-03 with the access on Joshua Lane.  O’Connell seconded, and the motion carried 6-0.

PSD #13-04 185 & 190 Newcomb Hill Rd.
Alfred Pickard recused himself from deliberations.
Mr. Lay presented PSD #13-04 for Jeffrey S. Russell for 185 & 190 Newcomb Hill Rd. (Map 12, Parcels 88 & 89). 2

Parent moved to approve PSD #13-04 as a modification to the original subdivision.  O’Connell seconded, and the motion carried 5-0.
Pickard returned to the meeting.

Road Extensions
Mary Lou Wood and Fire Chief Pauley discussed road names using the term “extension.”  Chief Pauley said they were trying to prevent confusion and discouraged the practice.

ANR #13-05      130 Kerouach Road
Chester Lay of Slade Associates presented a plan for an Approval Not Required (ANR #13-05) 3 for George M. Basset at 130 Kerouach Rd. (Map 8, Parcel 32).  Mr. Lay explained the split into of Parcel A and Parcel B.  
        
O’Connell moved to deem the plan an ANR.  Morrissey seconded, and the motion carried 6-0.

Correction for Subdivision Rules & Regulations
Mr. Lay addressed an error in the Wellfleet Subdivision Rules & Regulations and offered a correction for page 22, Section 4.04.b regarding cul de sacs. An interior radius of  40 ft and an exterior radius of 30 ft. are the correct designations.  Also in the correction the word diameter was replaced with the word radius.    Planning Board will hold a hearing for the change.

O’Connell moved to approve the changes as discussed subject to a hearing.  Parent seconded, and the motion carried 6-0.  

Medical Marijuana Bylaw Proposal
Planning Consultant Patrice Carson had prepared a proposal for a Wellfleet Medical Marijuana Facilities Bylaw.  Chair Reinhart said that one aim of the proposal was to keep the bylaw simple.  She made a few changes in basic terminology in the draft bylaw. 4  Carson said that she had based the bylaw on the Town of Dennis’ s Medical Marijuana Bylaws.  Jan Morrissey pointed out the differences between locating facilities in an Industrial Zone, which is found in some towns, and allowing one in a Wellfleet Commercial Zone.  ZBA would be the Special Permit Granting Authority (SPGA) for a medical marijuana facility.  Planning Board members suggested adding specifications for signage.  Permitting is allowed in the Commercial Zone only.  Operations allowed in the facility need to be clarified.  Registered Marijuana Dispensary is the name used by the State regulations to include all activities allowed:  cultivation, acquisition, preparation and distribution.  

Jan Morrissey outlined concerns she had to the first draft medical marijuana bylaw proposal.  PB members will submit other concerns and suggestions to the secretary and Patrice Carson for inclusion in another draft for the next Planning Board meeting.  

Minutes of 6/19/13
Parent moved to approve the minutes of June 19, 2013.  Picard seconded, and the motion carried 4-0.

FEMA will be holding a meeting August 15 at the Truro Community Center.  Planning Board members are invited to attend the presentation.

Agenda for the August 14, 2013 meeting includes: PSD #13-05 Hahn; Organization; Medical Marijuana Bylaws; Signs; Minutes; Mail and Future Concerns.

Adjournment
O’Connell moved to adjourn.  Morrissey seconded, and the motion carried 6-0.  The meeting was adjourned at 10:10 p.m.
