Minutes of Meeting on Wednesday, June 5, 2013
Senior Center Duck Pond Room, 7:00 p.m.

Chair Janet Reinhart opened the meeting at 7:02 p.m. and welcomed Dennis O’Connell back to the Board. His term will officially begin July 1, 2013. Barbara Gray has retired from Planning Board.
ANR #13-04
Chester Lay of Slade Associates presented ANR #13-041 for William Nicholson of 80 Williams Way (Map 29, Parcel 474.3) and explained the unbuildable lot and the restricted area of the lot.
Freeman moved to deem the plan an ANR. Morrissey seconded, and the motion carried 4-0.
Rules & Regulations
Chester Lay will review the corrections on page 22 in the Rules and Regulations in order to clarify the instructions for turnarounds in a subdivision plan.
Minutes of 5/15/13
Morrissey moved to approve the amended minutes of May 15, 2013. Freeman seconded, and the motion carried 5-0.
Mail
Information on the FEMA CCO meetings on June 17, 2013 was in the mail.2
Route 6 Traffic Safety Study & Memo
Assistant Town Administrator Tim King had submitted a memo3 requesting Planning Board’s written support for the traffic improvements at the corner of Route 6 and Main St. The pharmacy on Route 6 at the Main Street traffic lights has changed the patterns at the intersection. There were suggestions for an arrow for a left turn going south on Rte. 6; a filter light for traffic turning south coming out of Main Street; enforcing the ban on sandwich board signs in the island before Rte. 6; better signage about the lane merges on Rte. 6; installing a pedestrian crossing; elimination of the island; adding bike trails. Planning Board supports the proposal for improvements but reserves the right to review final plan.
Morrissey moved to submit a letter of support. Freeman seconded, and the motion carried 5-0.
FEMA Flood Insurance Risk Maps
The Preliminary FEMA Flood Insurance Risk Maps had been sent to the Town. These are available online for closer scrutiny. Planning Board, the Conservation Commission and other Town boards need to review the maps and make recommendations. After the final maps are completed, Planning Board may have to revise bylaws that address floodplain issues. Planning Board would like to ask the Building Inspector how he deals with buildings in the floodplain and will send him a letter to that effect.
Sheds & Accessory Buildings
Planner Patrice Carson had prepared a draft of shed and accessory buildings amendments to the zoning bylaws. 4 The Board had agreed to the Coverage definition at the last meeting. The Building Inspector has included sheds 120 sq. ft. and under on the registration fee list for building permits.
Freeman moved to accept the added line to the table Use Regulations 5.3.1 for sheds with the addition of the word “Other” after “Buildings, Accessory.” Morrissey seconded. Members discussed how the permitted uses are set in the charts for each district. The Board also considered accessory structures that are added to properties that went through Special Permitting or Site Plan Review. The motion carried 5-0.
There was a discussion of including covered trash bins as sheds. Small, temporary structures that can’t be walked into (under five feet) will be dealt with at another meeting. Patrice Carson will incorporate suggestions into the shed definition. An underlying question – are sheds are changing the character of the Town – has not yet been determined.
Meeting with BOS
The Board of Selectmen will come to the next Planning Board meeting to discuss a number of topics. Originally the Selectmen had planned to invite Planning Board to a BOS meeting. The Building Inspector will be invited to the meeting.
Agenda for Next Meeting
Agenda for the June 19, 2013 meeting with the Selectmen will include: Derelict Buildings and Houses; By-right Permits for New Businesses; Signs; Affordable Accessory Dwelling Units; Top Priorities (Affordable Housing, Commercial Districts, Medical Marijuana)
Medical Marijuana Regulations
The Board received zoning bylaws from several towns 5 and the Mass Department of Health regulations for Medical Marijuana Dispensaries. 6 The Board was in agreement that dispensaries should be limited to the Commercial District same as the Adult Entertainment bylaw. Members also agreed that Special Permits with the ZBA as the permit granting authority should be required. There was some consideration of designation as a Development of Significant Impact (DSI) to ensure Planning Board’s involvement, but the Board’s role would need to be strengthened in order for that to be effective. Another security suggestion was adding safety specifications for property abutting the Rail Trail. For now, Planning Board is waiting to see if Town Counsel will produce a model bylaw, and they
will study the Town of Dennis’ Medical Marijuana bylaw which was approved by Kopelman & Paige.
Summer Schedule
Planning Board set the dates of July 17, 2013, and August 14, 2013, for the summer meetings and scheduled another meeting on September 4, 2013.

Parent moved to adjourn. Pickard seconded, and the motion carried 5-0. The meeting was adjourned at 10:12 p.m.
