Wellfleet Planning Board
Minutes of Meeting on Wednesday, April 3, 2013
Senior Center Duck Pond Room, 7:00 p.m.


Present: Janet Reinhart, Chair; Andrew Freeman, Barbara E. Gray, Eric Larsen, Janet Morrissey, Gerald Parent, Alfred Pickard

Chair Janet Reinhart called the meeting to order at 7:00 p.m.
Because Mr. Lay of Slade Associates had not yet arrived, Gray moved to postpone the public hearing for twenty minutes.  Morrissey seconded, and the motion carried 7-0.  

Minutes of 3/20/13
Gray moved to approve the minutes of March 20, 2013.  Morrissey seconded, and the motion carried 7-0.

Mail
Included in the mail1 were notices for a hearing at the Cape Cod Commission April 11, 2013 to amend the bylaw on Developments of Significant Impact and an announcement for an April 27, 2013  Simons College conference on Climate Change.

Town Meeting Warrant Article 25 Recommendation Revisited
Janet Reinhart asked if the Planning Board would reconsider the vote on Article 25, which is a back up Article if Article 24 for the Baker’s Field Restrooms did not pass.  

Reinhart moved to recommend Article 25.  Gray seconded, and the motion did not carry 3--4.  Planning Board again did not recommend Article 25.  

Reinhart opened the public hearing at 7:20 p.m.

DSD #13-01 Wen/Don Realty Trust, 724 State Highway
Chester Lay of Slade Associates came forward to present the Definitive Subdivision for Wen/Don Realty Trust at 724 State Highway (Map42, Parcel 43).2 He gave the MESA report for the property.  Abutters Donna & Robert McAffrey and Steve Riley were present to review the subdivision plans.  The definitive subdivision plan is for three lots.  A number of issues were raised that need to be resolved before Planning Board makes a decision: the location of the McAffrey’s public water supply well in relation to the Wen/Don subdivision; the elevations for the catch basins (sheet 2);  lot numbering to fit the DSD plan; the turn around for the cul-de-sac; and  surface for the road (section C3 of the Declaration of Trust).
Mr. McAffrey asked what could be built in the C3 Zone, where the subdivision is located and was referred to the zoning bylaw usage tables.   Mr. Lay requested a continuance to May 1, 2013 in order to resolve the issues raised and revise the Declaration of Trust.   

Alfred Pickard moved to continue the public hearing for Wen/Don.  Freeman seconded. The motion carried 7-0.

ANR #13-02 Oliver
Larsen disclosed that his father is an abutter to the property.
Reinhart moved to endorse the ANR for Oliver at 2183 State Highway (Map 23, Parcel 218).3  Gray seconded. The motion carried 7-0.

Covenant Release for Whereaway Lane Extension
Mr. Lay had submitted the As-Built plans for Whereaway Lane Extension.  

Freeman moved to approve the covenant release for Lots 4a and 4b on Whereaway Lane Extension.4  Pickard seconded, and the motion carried 7-0.  

Affordable Housing Discussion with Public
Planning Board discussed Affordable Housing issues with Elaine McIlroy and Judy Taylor of the Wellfleet Housing Authority.  They distributed material on Affordable Housing.5   Barbara Gray, for the record, praised the commitment of Elaine McIlroy and Judy Taylor.   They enumerated efforts to promote Affordable Housing in Wellfleet: the housing available, the Buy-Down program, rental subsidies, Section 8 vouchers, and Affordable Accessory Dwelling Units (AADU’s).  McIlroy and Taylor updated the Board on the Gull Pond Affordable Housing units and status of the planned Paine Hollow rental units.  They discussed the difficulties of moving forward with the Affordable Housing projects.  

Planning Board expressed interest in working on zoning bylaws to encourage more Affordable Housing.  Cluster Housing bylaws are a possible means. The Board discussed limitations of 40B, but said the concept could be adjusted to a smaller scale.  Use of multiple small sized, free standing units on a property is another possibility to explore.

Town Meeting Preparation
Janet Morrissey had proposed an amendment for the Large Scale Ground Mounted Solar Panels Installation (LSGMSPI) Article.5  She explained the rationale for making the amendment, but she and the Board agreed that the amendment would not be necessary.  

Medical Marijuana Clinics
Planning Board is awaiting the draft regulations from Public Health regarding Medical Marijuana clinics.  A poll of PB members revealed that no one had a strong opinion about a bylaw for Medical Marijuana clinics.



Review Sprint Modifications at Gross Hill Rd.
Parent moved to notify the Building Inspector not to proceed with a building permit for the Gross Hill communications monopole until Planning Board has examined the plans.    Pickard seconded, and the motion carried 5-2.  

Update on Amy’s Way Easement Issues
Parent explained the issues involved in the Amy’s Way easement.  The deposition has been postponed until mid-April, he said.  

Agenda for Next Meeting
Agenda for the May 1, 2013 meeting will include:  Wen/Don Definitive Subdivision continuance; Sprint modifications to Gross Hill Rd. monopole, Sheds & Accessory Buildings, and Site Plan Review.

Adjournment
Parent moved to adjourn. Morrissey seconded, and the motion carried 7-0.  The meeting was adjourned at 9:50 p.m.
