Wellfleet Planning Board
Minutes of Meeting on Wednesday, March 6, 2013
Senior Center Conference Room, 7:00 p.m.


Present: Janet Reinhart, Chair; Barbara E. Gray, Janet Morrissey, Gerald Parent, Alfred Pickard; Town Administrator Harry Terkanian

Chair Janet Reinhart called the meeting to order at 7:00 p.m.

DSD #13-01, 30 Whereaway Lane
Chester Lay of Slade Associates submitted the plans for Definitive Subdivision #13-01 for Rebecca Boyd, 30 Whereaway Lane (Map 15, Parcel 148.4), and Planning Board members signed the plan and the road covenant1 for the new lots.   

Scenic Roads
Chair Janet Reinhart opened the public hearing at 7:08 p.m.
Janet Reinhart read the list of three additional scenic roads: Cannon Hill, Old Hay Road and Old Wharf Road. 2  From the floor, Dennis O’Connell asked about the extent of the designations.  

Reinhart closed the public hearing on scenic roads and entertained a motion to accept them.  Gray moved to accept the new scenic roads, Morrissey seconded, and the motion carried 4-0-1.

Regulations Consultants
Reinhart opened the public hearing for the Consultancy Regulations, 3 an amendment to the Wellfleet Rules & Regulations Governing the Subdivision of Land.

Gray moved to waive the reading of the entire regulation.  Morrissey seconded, and the motion carried 5-0.  

Reinhart explained the purpose of the new regulation.  Dennis O’Connell asked if the regulation applied to subdivisions only, and the Board verified that was the case.

Reinhart closed the public hearing for Consultancy Regulations and called for a motion.  Gray moved to approve the change.  Morrissey seconded, and the motion carried 5-0.  

Photovoltaics Zoning Bylaw
Chair Reinhart opened the Photovoltaics Bylaw hearing.
Gray moved to waive the reading of the entire photovoltaics bylaw. 4   Morrissey seconded, and the motion carried 5-0.  
Reinhart summarized the new large-scale ground-mounted, photovoltaics installation bylaw and explained how it differed from last year’s proposal.  This bylaw stands alone from the Green Communities Act, but it would be a step towards that designation.  

Energy Committee Chair Marcus Springer elaborated on the Green Communities Act criteria.  He also outlined the time line for an installation.  Reinhart explained why the sandpit was not an appropriate location for a large-scale ground-mounted photovoltaic installation (LSGMSPI).  She suggested a possible change in the language about degraded or previously disturbed land.  From the floor, Dennis O’Connell commented on determination of what is considered degraded or previously disturbed land.  There will be a small grammatical correction for Section10.6.  

Robert Prescott from the Mass Audubon Wellfleet Bay Wildlife Sanctuary distributed two photographs of the photovoltaic installation located on their property and discussed the advantages of the installation.  He answered questions on the financial benefits and the depth of the support pilings.

Reinhart noted a letter of support6 from Elaine McIlroy, Wellfleet Library Head, who commented on the success of the photovoltaics on the Library roof.

Reinhart closed the public hearing on the LSGMSPI bylaw.
Reinhart moved to approve the bylaw.  Parent seconded, and the motion carried 5-0.  

Minutes
Gray moved to approve the corrected minutes of February 20, 2013.  Morrissey seconded, and the motion carried 4-0.

Town Meeting Warrant Recommendations
Town Administrator Harry Terkanian and the Board discussed the Article for Holbrook Ave. sidewalks, which has been eliminated.  Article II has been changed to merge the Historic Review Board and Historical Commission.  

Morrissey moved to recommend the new Article II.  Gray seconded and the motion carried 4-0-1.

101 Chequessett Neck Rd.
Because several Town Boards had recommended the purchase of 101 Chequessett Neck Road, the Board of Selectmen had asked Planning Board members to revisit their vote.  Harry Terkanian reviewed the Town’s process of exercising the right of first refusal on the property and described the parcel.   At this time the Selectmen have not made a decision, he said.  The Board discussed the pros and cons of purchasing the property.  Planning Board decided to keep their original recommendation against purchasing the property.  


Consultancy General Regulation
Reinhart explained that the words “and Permit Granting Authority” needed to be added to the General Regulation5 on the Employment of Outside Consultants Section A. General in the opening line after  “The Planning Board as Special Permit Granting Authority.”    Harry Terkanian explained that there is no specific statutory authority for adopting regulations.   He said the mechanism is already in the photovoltaic bylaw, but the general regulation would cover the Planning Board in the role of Permit Granting Authority as well as Special Permit Granting Authority.  

Morrissey moved to adopt regulation for outside consultants as amended.  Gray seconded and the motion carried 5-0.  

Tree Removals
Chair Reinhart informed the Board of emergency tree removals that had been done on two scenic roads, Paine Hollow Rd. and Long Pond Rd.

Mail
Janet Morrissey distributed the mail log7 and reported on the new FEMA draft flood zone maps.  The maps will be available at town hall.  

Agenda for Next Meetings
Reinhart said she would like Planning Board to have panel discussions covering several issues including cluster development, Affordable Housing and night sky at the April 3, 2013 meeting.  

Agenda for the next meeting includes: the Medical Marijuana hearing, ANR #04-06 for 40 Ione Rd., a road renaming, and Priorities.  

Adjournment
Morrissey moved to adjourn.  Gray seconded, and the motion carried 5-0.  The meeting was adjourned at 8:55 p.m.
