Wellfleet Planning Board
Minutes of Meeting on Wednesday, February 20, 2013
Senior Center Conference Room, 7:00 p.m.


Present: Janet Reinhart, Chair; Andrew Freeman, Barbara E. Gray, Janet Morrissey, Alfred Pickard; Planner Patrice Carson
Regrets: Eric Larsen, Gerald Parent

Chair Janet Reinhart called the meeting to order at 7:00 p.m.

Minutes of 2/6/13
Freeman moved to approve the corrected minutes of February 6, 2013. Morrissey seconded, and the motion carried 5-0.  

Article II Demolition Delay Bylaw
Olga Kahn and Steven Curly of the Historic Review Board were present to discuss Warrant Article II on Demolition Delay General Bylaw.  They explained provisions for: designation of significant structures; demolition by neglect; enforcement; historic districts; and transferring the Historical Review Board to the Historical Commission.  Jan Morrissey suggested a number of language changes to the bylaw.  Alfred Pickard expressed his opposition to the proposed bylaw.  

Reinhart moved to recommend Article II for the Demolition Delay Bylaw.  
Gray seconded.  Freeman said he had reservations about the present draft and would like to see revisions because he supported the concept.  Morrissey also favored the concept The motion to recommend did not carry 2-3.  

Article CC – Photovoltaics Bylaw
Jan Morrissey addressed comments e-mailed to the Planning Board in advance by Dennis O’Connell.1   O’Connell was present to discuss his comments with the Board.  The Energy Committee will need to agree to a limitation number for the decibel level.  

Pickard moved to approve the revisions of February 20, 2013 to the photovoltaic bylaw.  Freeman seconded, and the motion carried 5-0.  

Morrissey moved to recommend Article CC for the Photovoltaics Bylaw as revised.  Freeman seconded, and the motion carried 5-0.

Recommendations for the Annual Town Meeting Warrant
Article R – Holbrook Ave. Sidewalks
Alfred Pickard enumerated problems with Article R for sidewalk construction on Holbrook Avenue.  
Morrissey moved to not recommend Article R for the Holbrook Avenue sidewalks.  Pickard seconded.  The Board discussed the need for Holbrook Avenue sidewalks at this time and the lack of a plan.   The motion to not recommend carried 3-2.
   Might reconsider if they get some one to present

Article U – Baker’s Field Restrooms
Pickard commented favorably on the plan for restrooms at Baker’s Field, and he elaborated on the technology involved.  
Morrissey moved to recommend Article U for Baker’s Field Restrooms.  Pickard seconded, and the motion carried 5-0.

Article Ua – Design for Baker’s Field Restrooms
The Board discussed the impact of recommending Article Ua for the design of Baker’s Field restrooms if Article U does not pass at Town Meeting.  
Freeman moved to not recommend Article Ua for the design preparation for Baker’s Field Restrooms.  Morrissey seconded, and the motion to not recommend carried 3-2.

Article DD – Moratorium on Medical Marijuana Clinics
Freeman moved to hold a public hearing on March 20, 2013 for the Moratorium on Medical Marijuana bylaw.  Gray seconded.  The Board adjusted numbering for the article and bylaw.  The motion carried 5-0.

Morrissey moved to recommend Article DD for the Moratorium on Medical Marijuana Clinics.  Freeman seconded.  The Board had further discussion before the motion carried 5-0.

Article EE – Easements for Properties w Sidewalk Improvements
Gray moved to recommend Article EE for sidewalk easements.  Freeman seconded, and the motion carried 4-0-1.

Article FF – Scenic Roads
Morrissey moved to recommend Article FF for the three additional Scenic Roads.  Freeman seconded, and the motion carried 4-0-1.

Article GG – Lease for OpenCape Equipment on Water Tower
Planning Board members examined a message from Town Administrator Harry Terkanian regarding leasing equipment on the water tower.
Morrissey moved to recommend Article GG for the lease agreement with Open Cape for microwave equipment on the water tower.  Gray seconded, and the motion carried 5-0.

Consultancy Fees
Town Counsel had not yet responded to a question on Consultancy Fees.  The Planning Board corrected numbering and made a few other changes.  Pickard registered displeasure with the response time from Town Counsel.  

Permit Granting Authority
Planning Board needs to be included in the ZBA Permit Granting Authority regulation but still needs to make provisions for Site Plan Review.  

Sheds and Accessory Buildings
Chair Janet Reinhart wanted to know what the Board wanted to do about developing a shed and accessory building bylaw.  Pickard suggested dealing with sheds separately.  

Mail
Jan Morrissey had distributed the mail log of February 20, 2013.3   She noted a FEMA workshop on Feb. 26, 2013 that has a time slot set aside for Wellfleet.

Agenda for Next Meeting
Agenda for the March 6 meeting will include: Public Hearing for Photovoltaics Bylaw, Scenic Roads and Consultancy Regulation; signing DSD #13-01, Boyd; Affordable Housing Cluster Zoning; Sheds & Accessory Buildings; and Priorities.

Adjournment
Gray moved to adjourn.  Freeman seconded, and the motion carried 5-0.  The meeting was adjourned at 9:45 p.m.
