Minutes of Meeting on Wednesday, January 2, 2013

Chair Janet Reinhart called the meeting to order at 7:01 p.m.
Minutes of 12/5/12
Morrissey moved to approve the minutes of December 5, 2012. Freeman seconded, and the motion carried 5-0.
Mail
Jan Morrissey submitted the mail log of January 2, 2013.1
ANRs for Chequessett Yacht & Country Club
There were two ANRs for the Chequessett Yacht & Country Club (CYCC). ANR #12-05, 2 presented to the Planning Board on April 4, 2012, was referred to the Cape Cod Commission for findings. ANR #12-063 makes provisions for three small unbuildable lots to be separated from the main lot (Map 19, Parcel 81) and be held in conservation in accordance with the Cape Cod Commission’s directives.
Parent moved to endorse the ANRs and have the chair sign ANR #12-05 for lot 76 (Map 19, Parcel 81) and ANR #12-06 for the three unbuildable parcels: Lots 77, 78 and 79 (Map 19, Parcel 81).
Gray seconded, and the motion carried 5-0.
Samoset/Hiawatha Rd. Addresses
Mary Lou Wood from the Wellfleet Fire Department explained the request for renaming a portion of Samoset Rd. to Hiawatha Rd. so that four homes that are accessed from Hiawatha Rd. reflect their physical location. The four addresses are: 5 Samoset to be reassigned as 125 Hiawatha; 10 Samoset to become 130 Hiawatha; 11 Samoset to become 135 Hiawatha and 21 Samoset to be 145 Hiawatha. Map and Parcel numbers remain the same for the new addresses: 125 Hiawatha (28-186); 130 Hiawatha (28-183); 11 Samoset (28-185) and 145 Hiawatha (28-184). The abutters are signing off on the notifications forms. Planning Board determined that a public hearing will need to be held to make the changes of address. The Planning Board would also like to find out what other towns do about renumbering for 911 purposes. The
new Fire Chief may have a preference for how the numbering should be done in this case and for other situations throughout Town. The Town Administrator could also state his preference for handling the 911 numbering.
Planning Board will make a site visit to Hiawatha and Samoset Roads. Before there is a hearing, the Fire Department will study the situation again.
Request for Opinion on Lot 101 CYCC (Map 19, Parcel 101)
The Selectmen had requested a recommendation from Planning Board in regards to the sale of CYCCs Lot 101 (Map 19, Parcel 101). The small waterfront property on Chequessett Neck Rd. will be released from its Recreational Tax Lien with the Town exercising rights of first refusal.
Parent moved to recommend that the Town exercise the option of first refusal on Map 19, Parcel 101 belonging to the Chequessett Yacht and Country Club. Gray seconded, and the motion carried 5-0.
Preparation for Public Hearing
Planning Board members reviewed comments Town Counsel Elizabeth Lane had sent on the Consultancy Fee Regulations. 5 This included a discussion of a regulation for setting fees (§10.3) and consultant fee (§10.4.2.1). Attorney Elizabeth Lane had sent an email dated January 2, 20136 regarding the two sections for the regulation. Planning Board will meet with the Zoning Board of Appeals in order to prepare the consultancy fees.
Freeman moved to adopt the Employment of Consultancy language as submitted by Town Counsel. Morrissey seconded, and the motion carried 5-0.
Planning Board members discussed receiving replies from Town Counsel in a timely manner and dealing with additional information brought to the meetings.
Public Hearing Date
The date for a public hearing on the photovoltaic bylaws, scenic roads, sheds & accessory buildings and consultancy fees was set for February 20, 2013.
Shed & Accessory Buildings Bylaw
Town Counsel Elizabeth Lane had made a few suggestions § 6.2 in for the proposed shed & accessory buildings bylaw.
Freeman moved to accept the amended version of the Sheds & Accessory Buildings Bylaw as suggested by Town Counsel. Morrissey seconded, and the motion carried 5-0.
Photovoltaic Bylaws Vote
Gray moved to approve the revised Photovoltaic bylaws. Morrissey seconded, and the motion carried 5-0. Marcus Springer of the Energy Committee will be notified of the vote and the public hearing date.
Update on Town Water Innovative Alternative Systems
Chair Janet Reinhart explained that the Wellfleet Board of Health regulations has a list of Innovative Alternative Systems (IAS) on the Town website. She said it affects the allowances for bedrooms in Single Family Residences and that the Board of Health monitors the lots that have the IASs. PB members discussed lot size and bedroom allowances and the IASs.
Signatures
Members completed the forms to the Registry and Land Court authorizing their signatures on subdivision documents.

Gray moved to adjourn. Morrissey seconded, and the motion carried 5-0. The meeting was adjourned at 9:25 p.m.
