Minutes of Meeting on Wednesday, November 7, 2012
Senior Center Conference Room, 7:00 p.m.


Present: Janet Reinhart, Chair; Eric Larsen, Janet Morrissey, Alfred Pickard, Gerald Parent; Planner Consultant Patrice Carson; Potential Member Andrew Freeman

Chair Janet Reinhart called the meeting to order at 7:00 p.m.

Chequessett Yacht & Country Club ANR for Map 19, Parcel 81
Chester Lay of Slade Associates requested a continuance for the ANR1 for Chequessett Yacht & Country Club.  The Planning Board agreed to the continuance because the Cape Cod Commission needs to hold a public hearing on the case.  Picard moved to agree to the continuance of the ANR.  Morrissey seconded, and the motion carried 5-0.  

Hearing for Chequessett Yacht & Country Club’s Buildable Lot
The Cape Cod Commission had sent a notice for a public hearing on November 15, 2012 at the Wellfleet Public Library or the lot proposals at Chequessett Yacht & Country Club.

Preliminary Subdivision for Boyd, 30 Whereaway Lane
Mr. Lay presented the Preliminary Subdivision plan for Rebecca Boyd of 30 Whereaway Lane (Map 15, Parcel 148.8). 2  He explained that the original owner’s intention to limit the subdivision to four lots was never put into the deeds or covenant as a restriction.  Mr. Lay explained the utility easement and the road construction, including a T-turn.  Gerald Parent said that even if Planning Board documents indicated that the subdivision had been restricted to four lots, it would be possible to waive the restriction.  Parent said that Planning Board does not have jurisdiction over what goes into subdivision restrictive covenants.  

Morrissey moved that Town Counsel review the case before Planning Board makes a decision.  Pickard seconded.  The motion carried 5-0.  

Comments from Town Counsel on Photovoltaic Bylaws
Town Counsel Elizabeth Lane had sent comments, dated November 1, 2012, 3 on Sections 10.3, 10.4.2.1 and some general comments for setting an amount of a deposit.  Planning Board discussed setting fees and procedure for Site Plan Review.

Parent moved to eliminate Section 10.3.  Pickard seconded.  The motion carried 4-1.  
Section 10.4.2.1 deals with consultants’ fees.  Planner Patrice Carson will prepare a regulation to cover funding consultants, as suggested by Town Counsel.  

Patrice Carson said that solar panel building fees are already set by the building permit fee schedule.

Minutes of 10/17/12
Larsen moved to approve the corrected minutes of October 17, 2012.  Morrissey seconded, and the motion carried 5-0.

Shed & Accessory Buildings Model Bylaw
Patrice Carson had prepared a model bylaw for Sheds & Accessory Buildings, 4 which the Planning Board reviewed.  Members discussed changing the rear lot line setback requirement for an accessory building.  The Board also considered allowing sidelines adjustments through Special Permitting from the ZBA.  Patrice Carson will revise the rear line setback requirements and submit them for discussion at another meeting.  Planning Board would like more time to think about the side line requirements.  Reinhart also considered door placement for accessory buildings and shed setbacks.

Jan Morrissey presented a list of items in the mail.5

Agenda for Next Meeting
Agenda for the December 5, 2012 will include: photovoltaics bylaws,  consultancy regulations, sheds & accessory bylaw revision, the “Landing Strip” update, Whereaway Lane Preliminary Subdivision , CYCC Hearing, and a report on a meeting with the Building Inspector.

Adjournment
Larsen moved to adjourn. Parent seconded, and the motion carried 5-0. The meeting was adjourned at 9:25 p.m.
