Wellfleet Planning Board
Minutes of Meeting on Wednesday, November 2, 2011
Senior Center Conference Room, 7:00 p.m.

Present:  Janet Reinhart, Chair; Theodore Franklin, Barbara E. Gray, Eric Larsen, Gerald Parent, Alfred Pickard

Chair Janet Reinhart called the meeting to order at 7:00 p.m.

ANR #11-06 – Bishop of Fall River, 479 Old King’s Highway
Alfred Pickard disclosed he was an abutter to an abutter, and Eric Larsen disclosed that he had worked on the original engineering for the property.  
Chester Lay of Slade Associates presented the ANR plan for Our Lady of Lourdes Church at 479 Old King’s Highway (Map 23, Parcel 17).  Eric Larsen explained the MESA conservation restriction on the property.  

Pickard moved to endorse the plan as ANR #11-06.  Gray seconded, and the motion carried 6-0.

Discussions of Wilton’s Way Subdivision Lot #3 (Map 42, Parcel 25.1)
Jeff and Debbie Mayer and Dale Rice were present to explain the plan for Freedjum Rd. Lot #3 (Map 42, Parcel 25.1).  The covenant and original 1993 Definitive Subdivisions state that before any construction can take place on Lot #3, the property owner must come before the Planning Board again.  Mr. Lay of Slade Associates, who had prepared the original subdivision plan, said the reason the note was included to be sure that the road was adequate.  

Parent moved to release the covenant of January 21, 1993, in full and remove the restriction on Lot 3 stating that no construction could be done without referral to the Planning Board.   Gray seconded.  The motion carried 4-1-1.  

Notification
Reinhart noted Olga Kahn’s resignation from the Planning Board.  Gray moved to send Olga Kahn a letter thanking her for her service to the Board.  Franklin seconded, and the motion carried 6-0-1.

Minutes of 10/19/11
Parent moved to approve the minutes of October 19, 2011.  Larsen seconded, and the motion carried 5-0.

ZBA/Planning Board Joint Sessions
Janet Reinhart explained efforts to meet with the Zoning Board of Appeals to discuss topics of concern. The Board discussed methods of greater contact with ZBA.  Planning Board members said they should first discuss the issues outlined in the ZBA draft letter of 9/12/11 before meeting with the ZBA.   
Pickard moved to request that ZBA indicate in their finished letter the votes of ZBA members showing their top issues and the way in which they would like PB to prioritize the issues.  Parent seconded.  The motion carried 6-0.  

Planning Board examined issues ZBA introduced in the draft letter.  The Board discussed wind turbine definitions, Affordable accessory dwelling unit bylaws (6.21) and Restoration (6.1.2)

Regarding restoration issues, Parent moved to send a letter to the Building Inspector requesting a written response indicating whether or not it is in state building code that a house has to be built in two years or if there is no restriction.  Pickard seconded. The motion carried 6-0.  

There was further discussion of shed sizes and setbacks, the definitions for restaurant.

Agenda for Next Meeting
Agenda for the November 16, 2011 meeting includes: Preliminary Subdivision for 724 State Highway, Referral of Cumberland Farms as a Development of Significant Impact, and ZBA response.  

Adjournment
Franklin moved to adjourn. Larsen seconded, and the motion carried 6-0.  The meeting was adjourned at 9:15 p.m.
