Wellfleet Planning Board
Minutes of Meeting on Wednesday, January 5, 2011
Senior Center Conference Room, 7:00 p.m.

Present:  Griswold Draz, Chair; Theodore Franklin, Barbara E. Gray, Olga Kahn, Gerald Parent, Janet Reinhart; Rex Peterson, Assistant Town Administrator

Chair Gooz Draz called the meeting to order at 7:00 p.m.  

Minutes of December 15, 2010
Gray moved to approve the minutes of December 15, 2010.  Reinhart seconded, and the motion carried 6-0.  

ANR #11-01 – Cape Commerce Nominee Trust, 2393 State Highway
Gerald Parent recused himself from consideration of the ANR.
Chester Lay of Slade Associates presented ANR #11-01, a perimeter plan for Cove Corners at 2393 State Highway/Route 6.1   Gray moved to endorse ANR #11-01.  Reinhart seconded, and the motion carried 5-0.  

Affordable Housing Bylaws
Rex Peterson noted some small changes to the Affordable Housing Bylaw proposal dated 1/5/2011.2  Kahn moved to delete “age and” in 6.28.1 Purpose.  Parent seconded, and the motion carried 6-0.  Planning Board reviewed the bylaws and made other changes.  Gray asked about occupancy of Affordable Homes in Wellfleet.  Parent moved to approve and send the bylaw with changes and questions to Town Counsel for review.  Reinhart seconded, and the motion carried 6-0.

Steve Durkee was not present to explain his Affordable Housing Proposal of 12/15/10. 3   He had submitted the material in advance and told the chair that he will prepare more information for another PB meeting.  

From the floor, Attorney Ben Zehnder said he would be proposing a petitioned Article for Town Meeting.  His petitioned Article proposes allowing accessory dwellings on 20,000 s.f. lots. Although it will not be definitionally Affordable Housing, it will be in practicality, he said.  

The Board discussed enforcement issues for keeping dwellings Affordable.  Planning Board will ask Town Counsel for some concrete enforcement suggestions.  Gray said there were other time arrangements that could be considered for Affordable Housing.  

Gross Floor Area Bylaw Proposal  
Rex Peterson had prepared the Gross Floor Area Bylaw as the legal notice of Warrant Articles for Annual Town Meeting. 4   Draz suggested that the three parts be combined as one Article.  Draz recommended preparing a brochure that explains Gross Floor Area (GFA). The brochure would be available for public hearings and Town Meeting.  Olga Kahn distributed a Gross Floor Area Calculations Diagram5 illustrating a sample house to help provide a visual understanding of GFA.  

Draz moved to send the Legal Notice for Gross Floor Area prepared as one Article to Town Counsel for review.  Gray seconded.  The motion carried 5-1.  

There was a short discussion of attached garage calculations.  

Formula Business Proposed Bylaw
Gooz Draz had prepared two proposals for new formula business bylaws.
The Board reviewed the Draft of Fast Food & Formula Restaurant Prohibition By-Law of 12/28/106 and made changes.   Ben Zehnder cautioned that in some cases the “Fast Food” category could overlap with the “Drive Up” category.  

Kahn moved to approve the Fast Food & Formula Restaurant bylaw as a Town Meeting Article to be sent to Town Counsel for review.  Gray seconded, and the motion carried 6-0.  

The second bylaw for retail business was the Draft Formula Business By-Law of 12/28/10. 7   PB members discussed which businesses would be covered by the bylaw.

Gray moved to send the Formula Business Bylaw to Town Counsel for review.  Reinhart seconded, and the motion carried 6-0.  

Revision to Seashore District with Gross Floor Area Provisions
Draz explained that he had prepared Seashore District bylaw revisions using Gross Floor Area8 so that bylaws for that district would harmonize with the Gross Floor Area Bylaw for R1 and R2 if that Warrant Article passes at Annual Town Meeting in April.  The Board discussed presenting the Article at a different Town Meeting but decided to prepare it for this April.   

Kahn moved to send the proposal for the National Seashore Park District to Town Counsel. Reinhart seconded.  The motion carried 5-1.   

Other Business
Draz said he had a request from the Wellfleet Economic Development Committee to meet with Planning Board in February.  

 Gray asked if Planning Board had a role in plans for  the LeCount Hollow Beach parking lot.  Gray moved to send a letter to the BOS and other boards asking about remedial measures.  Kahn seconded.  The motion did not carry 1-5.  

Next Meeting
Agenda for the January 18, 2011 meeting includes: Comments from Town Counsel on Affordable Housing, Formula Business Bylaws and Gross Floor Area.

Adjournment
Parent moved to adjourn. Franklin seconded, and the motion carried 6-0.  
The meeting was adjourned at 9:55 p.m.
