Wellfleet Planning Board
Minutes of Meeting on Wednesday, November 3, 2010
Senior Center Conference Room, 7:00 p.m.

Present:  Janet Reinhart, Vice-Chair; Theodore Franklin, Barbara E. Gray, Olga Kahn, Gerald Parent, Alfred Pickard, Rex Peterson, Assistant Town Administrator
Regrets:  Griswold Draz

Vice-Chair Janet Reinhart called the meeting to order and opened the hearing at 7:00 p.m.  

Alfred Pickard said that he believed there was a clerical error in Olga Kahn’s Planning Board term which needs to be corrected.  The Selectmen will fix her appointment at their meeting next week.  
Gray moved that any votes of a significant nature made between July 1, 2010 and October 20, 2010 be re-done.  Franklin seconded, and the motion carried
5-0.  
Kahn removed herself from the table for the meeting.  

ANR #10-04 – Verney/McDonough,
30 & 50 Amy’s Way (Map 29, Parcels 294 & 295)
Chester Lay of Slade Associates explained the ANR proposal for 30 and 50 Amy’s Way.  Franklin moved to endorse the plan as an ANR.  Gray seconded, and the motion carried 5-0.

ANR #10-05 – Harnett, 450 & 460 Chequessett Neck Rd.
(Map 19, Parcels 46 & 47)
Mr. Lay also presented the ANR plan to consolidate 450 and 460 Chequessett Neck Rd. into one lot.  Parent moved to endorse the plan as an ANR.  Franklin seconded, and the motion carried 5-0.

Minutes of 10/20/10
Gray moved to approve the amended minutes of October 20, 2010.  Pickard seconded, and the motion carried 3-0.  

Fast Food & Formula Restaurant Bylaw Proposals
Town Counsel had not sent an opinion yet on the fast food and formula restaurant proposal that had been introduced at the last meeting.  Gray said she would like to include “box stores” for consideration in a formula business bylaw as well as the fast food restaurants.  Parent suggested that Elizabeth Lane of Kopelman & Paige come to a Planning Board meeting to discuss legalities of formula business bylaws and what kind of bylaw would pass the Attorney General’s review.  Ms. Lane had suggested using the Town of Dennis’ bylaw as a model.  Gray suggested that Planning Board members read Chapter 40, Section 3 “The Zoning Act” of Mass General Law.

Affordable Housing Bylaws
Parent disclosed that he owned property that might fall into the Affordable Housing category.  
Elaine McIlroy and Harry Peabody of the Wellfleet Housing Authority came forward to discuss the revisions to the bylaw proposal for “6.28 Provisions to Encourage the Development of Affordable Dwellings in Wellfleet.” * The Board discussed the difference between 40B and the Wellfleet zoning bylaw proposal.  Elaine McIlroy reviewed 40B developments in Wellfleet that had been 100% Affordable Housing.  Pickard said he was continuing to gather information on half-acre lots that have potential for Affordable Housing.  PB discussed lot sizes, bedroom allowances, septic issues, increasing Affordable Housing opportunities, lot size, and compliance with setbacks and frontage requirements.  The discussion will continue at the next meeting.  

Change in Site Visits’ Time
The change in site visit time will be officially 9:30 a.m.  

Other Business
Gerry Parent presented amendments to Criteria #1 of Standards and Criteria to be discussed at the next meeting.

Next Meeting
The agenda for the November 17, 2010 meeting includes: Affordable Housing proposals, Amendment to Criteria #1 and Lot Sizes, and Formula Businesses.

Adjournment
Gray moved to adjourn. Franklin seconded, and the motion carried 5-0.  The meeting was adjourned at 8:40 p.m.
