Wellfleet Planning Board
Minutes of Meeting on Wednesday, October 20, 2010
Senior Center Conference Room, 7:00 p.m.

Present:  Griswold Draz, Chair; Barbara E. Gray, Olga Kahn, Alfred Pickard, Janet Reinhart, Rex Peterson, Assistant Town Administrator
Regrets: Gerald Parent, Theodore Franklin

Chair Gooz Draz called the meeting to order and opened the hearing at 7:00 p.m.  

T-Mobile Antenna – Hearing
John-Markus Pinard and Dinesh Dasani of Centerline Communications LLC were present to explain the T-Mobile application for a Special Permit for the installation of communication appurtenances on the existing fire tower at 1947 Route 6 (Map 29, Parcel 268).1  He entertained questions from the Planning Board.  Draz said he had visited the site and determined that there was no noise issue.  

Pickard moved to approve the Special Permit application for T-Mobile.  Gray seconded, and the motion carried 5-0.  

T-Mobile must post a bond for estimated costs of removal of the appurtenacnes.

Minutes of 10/6/10
Reinhart moved to approve the minutes of October 6, 2010.  Kahn seconded, and the motion carried 4-0.  

Final Release of the Covenant – Goss Lane
Alfred Pickard disclosed that Cortes is one of his customers.
Chester Lane from Slade Associates was present to obtain the final release of the covenant for Goss Lane.
Reinhart moved to release the covenant of Goss Lane.  Gray seconded, and the motion carried 5-0.

Formula Business Bylaw
Gray disclosed that her daughter is in the business of placing entrepreneurs in formula businesses.
Draz said there are a handful of communities that have prohibited fast food and formula restaurants from operating in their towns.  York, Maine is one that he mentioned.  Draz says he favors this approach, but he was uncertain about Town Counsel‘s opinion.  Planning Board members expressed their views on creating a formula business bylaw.  Theresa Parker’s e-mail of October 6, 2010 2 was introduced as support for such a bylaw.  PB discussed “drive up” windows, definition of “formula restaurants,” and pre-existing formula restaurants.  Draz said he’d like to submit the York, Maine formula business restriction bylaw to Town Counsel for an opinion.  

Reinhart moved to refer the York, Maine formula restaurant prohibition bylaw to Town Counsel to adapt it for Wellfleet.  Gray seconded.  The motion carried 5-0.

Reinhart mentioned a website called newrules.com that lists towns with fast food prohibition bylaws.  From the floor, Jan Morrissey requested a Planning Board representative at the November 15, 2010 Wellfleet Forum meeting on formula businesses.  Draz said he would attend.  

Affordable Housing Proposals
Rex Peterson reviewed 6.28 “Provisions to Encourage the Development of Affordable Housing in Wellfleet.” 3   Peterson said that section 6.28.4 “Affordable Housing Apartment” had been added, but the definition needed to be included in the Zoning Bylaws.  He explained other changes that he had discussed with the Wellfleet Housing Authority.  Planning Board members had questions and suggestions for the bylaw.  Elaine LaChapelle of the Wellfleet Housing Authority said the bylaw was an attempt to take a 40B approach that is suitable for and controlled by Wellfleet.   Pickard said he would obtain the list of half-acre lots that could be opened up to Affordable Housing according to the bylaw proposal. Planning Board continued to discuss rental property and provisions for market rate lots with the affordable lots,

The Housing Authority had also presented 6.27 “Small House Ownership By-Law” (drafted 7/26/2010) 4 which had provisions for subdivision. There was discussion of how the wells and septic systems would be placed on the small lots.  

Draz suggested that Olga Kahn work on the bylaws with Rex Peterson and the Affordable Housing group.  She agreed to help with the revisions for the next meeting.  

Next Meeting
The agenda for the November 3, 2010 meeting includes: ANR #10-04, fast food & formula restaurant bylaw proposals, affordable housing bylaws, change in site visits’ time.

Adjournment
Reinhart moved to adjourn. Gray seconded, and the motion carried 5-0.  The meeting was adjourned at 9:05 p.m.
