Wellfleet Planning Board
Minutes of Meeting and Wednesday, August 4, 2010
Senior Center Conference Room, 7:00 p.m.
        
Present: Gerald Parent, Vice-Chair; Griswold Draz, Ronald Harper, Olga Kahn, Alfred Pickard, Janet Reinhart; Assistant Town Administrator/Planner Rex Peterson

Vice-Chair Gerald Parent called the meeting to order at 7:00 p.m.

Minutes of 7/14/10
Franklin moved to approve the minutes of July 14, 2010.  Draz seconded, and the motion carried 6-0.  

Special Permit – T-Mobile Antenna, Fire Tower, 1937 Rte. 6
Rex Peters explained that John-Markus Pinard of Centerline Communications LLC had sent a request 1 to have the Pre-Application Conference waived for a proposed T-Mobile antenna addition to the Wellfleet fire tower, which already has other antennas in place.  The Board examined the plans2 that were submitted showing existing and proposed features.  Pickard moved to deny the waiver and require the applicant to apply for a pre-application conference.  Harper seconded, and the motion carried 7-0.  

There was a discussion of obtaining the Certificate of Compliance for the previous antennas and the proposed ones.  The secretary will send letters to the carriers requesting these and notify Mr. Pinard that Centerline Communications will need to have the Pre-Application Conference.  

Bylaw Revisions for Gross Floor Area, Sliding Scale
Gooz Draz reported on the meeting with the Non-Resident Taxpayers on the proposed house size bylaw changes.  Draz said he favored a few suggestions that a member at that meeting had e-mailed 3 to the Planning Board.  One suggestion was to add the word exterior before the word wall, and to change the word grade to the word ground.   

Ted Franklin related his experience doing a trial measurement of a house for its allowable expansion potential on its lot.  He presented concerns from the home owner about the process to be used for measuring gross floor area.  There was discussion of the Special Permit process that would be needed if a proposed addition exceeds the “by right” allowable size.  The effect of having a cap on size was discussed.  Janet Reinhart referred to an average house size since 1982 chart .4  Draz displayed and explained the July 29, 2010 scatter chart 5 of existing house sizes in relation to lot size.  

Harper moved to approve, for the purpose of discussion, the Gross Floor Area definition and Use Table of July 20, 2010 with the two recommended changes for “exterior walls” and “ground” instead of “grade”; a change to the third section of the chart, the elimination of the last two sections of the chart, and a change in the footnote. The third section should read “greater than 20,000 sq. ft.”  Pickard seconded.  

Members of the audience expressed their views on having a cap and the changes in the Use Table (seen unfavorably).  Parent suggested a meeting with the ZBA to discuss the proposed bylaw changes before going further with the proposal.  The Standards and Criteria bylaws were also considered although that was not a part of the motion on the table.  

Calling the question was unanimously approved.  The motion for the changes carried 5-2.  

Draz suggested sending the cap language to the ZBA.  Reinhart moved to meet with the ZBA and discuss the July 20, 2010 version and August 4, 2010 version of the Gross Floor Area changes.  Picard seconded, and the motion carried 7-0.  

Draz moved to send the Standards and Criteria to ZBA.  Harper seconded, and the motion carried 7-0.  

Reorganization
Reinhart nominated Gooz Draz for Planning Board Chair.  Kahn seconded, and the motion carried 5-2.  

Harper nominated Janet Reinhart for Vice-Chair.  Kahn seconded, and the motion carried 6-1.  

Parent nominated Janet Reinhart for Clerk.  Franklin seconded, and the motion carried 7-0.  

Parent nominated Reinhart for Community Preservation Committee representative.  Harper seconded, and the motion carried 7-0.

Signatures for Registry & Land Court
Planning Board members signed the signatory documents needed for the Barnstable Registry of Deeds and    Land Court in Barnstable and Boston.   

Mail
The County of Barnstable Cape Cod Water Protection Collaborative information on the water system6 was available for anyone interested in reading it.  

Other Business
Draz reported that he had met with the Conservation Commission regarding the bylaw changes.  

 Reinhart had questions on parking spaces for a town property.  

Next Meeting
Anticipated agenda for the next meeting to be held August 18, 2010, includes:  Zoning Bylaw Work, Standards and the Criteria, Minutes, Mail and Other Business.  
        
Adjournment
Harper moved to adjourn.  Reinhart seconded, and the motion carried 7-0.  The meeting was adjourned at 9:00 p.m.
