Wellfleet Planning Board
Minutes of Meeting and Wednesday, April 1, 2009
Town Hall Hearing Room, 7:00 p.m.
        
Present:  R. Dennis O’Connell, Chairman; Griswold Draz, Barbara E. Gray, Ronald Harper, Gerald Parent; Rex Peterson, Assistant Town Administrator
Absent: Alfred Pickard, David Rowell

Chairman O’Connell called the meeting to order at 7:10 p.m.

40B Housing Application
Attorney Devin, representing the owners of 170 Pond Avenue, came forward. O’Connell explained the conflict of two members of Planning Board and his position as an abutter through the Wellfleet Conservation Trust.  Gray and Harper recused themselves and left the table as members of Planning Board.  Mr. Devin said he was comfortable with non-conflicted members making comments.  O’Connell stepped down as chairman, and the Board was reduced to two members, not a quorum. Parent, who had assumed chairmanship, and Draz said they could not comment on behalf of the Planning Board.  Gray said she was not an abutter; however, she is a member of the Drummer Cove Neighborhood Association.  Parent and Draz agreed to send a letter to the ZBA explaining that there was not a quorum available but unable to comment on the case.

Warrant Recommendations
Planning Board considered Article 34 concerning the sale of eight Town-owned properties.  Parent commented on the restrictions stipulated in the Article.  Peterson discussed the time span involved in deed restrictions.  The Board discussed recommending the sale but with the stipulations removed because of too much restriction.  After reviewing each parcel, the Board determined that they all could be sold.  Parent moved to sell all but not with the restrictions stated in the Article, but there was no second.  Gray moved to separate the vote into recommending to sell and recommending to remove the stipulations.  

O’Connell moved that the deed restriction not be supported.  Harper seconded.  The motion carried 4-1.  

O’Connell moved to sell the eight lots.  Gray seconded.  O’Connell removed his motion and Gray removed her second.

O’Connell moved to not recommend the Article as written.  Parent seconded, and the motion carried 4-1.

O’Connell moved to amend Article 34 to remove the restrictions and recommend sale of all eight properties.  Harper seconded, and the motion carried 4-1.

Planning Board will hold its other recommendations for the Wind Turbines and Water Articles until the April 15 public hearing and meeting with the Water Commissioners.    
 
Parent reported that the Bylaw Committee had not recommended the Sign Bylaw Warrant Article.  They had reservations on the 501 (c) nonprofits’ signs.  There was a concern for the number of banners allowed.  Parent suggested contacting SPAT before Town Meeting to find out how many banners they display for the Oyster Festival.  Harper suggested defining special banners to distinguish them from signs.  Peterson said the Warrant Article reads “special event banner,” which restricts it.  Planning Board decided that the bylaw could be further amended if problems occur during the year.

O’Connell read a March 26, 2009 letter from the Field Point Neighborhood Association regarding changes in the size bylaws for the Town Residential Districts.

Minutes of 3/18/09
Harper moved to approve the minutes of March 18, 2009.  Gray seconded, and the motion carried 4-0.

Executive Session
Gray moved to go into Executive Session.  O’Connell seconded.  Harper, Gray, Parent, O’Connell and Draz each said yes.

Adjournment
Planning Board returned to the regular meeting and immediately adjourned by consensus at 8:25 p.m.
