Wellfleet Planning Board
Minutes of Meeting and Wednesday, March 18, 2009
Town Hall Hearing Room, 7:00 p.m.

Vice-Chair Gerald Parent opened the public hearing at 7:00 p.m.

Sign Bylaws Public Hearing  
The Planning Board reviewed the proposed changes in the sign bylaw.  Rex Peterson read into record a message from Ned Hitchcock regarding including 501(c) (4)’s as well as 501 (c) (3)’s in temporary sign exemptions.  Gray moved to word references to the non-profits as “501 (c) (4) and 501 (c) (3). “ Harper seconded and the motion carried 5-0.  

Section 7.7.7 for temporary signs had size specifications that were considered for change, but the original language for 2 sq. ft. was retained.

In 7.7.8 on temporary signs prohibiting sponsor promotion messages, logos or symbols was reconsidered with an exemption for Town department and non-profits. Gray moved that in 7.7.8 language be added, “Temporary sign logos may not exceed 10% of the sign’s total square footage,” and that 7.6.5 is exempt from 7.7.8.  Draz seconded, and the motion carried 5-0.  

Harper moved to recommend the Sign Bylaw revisions as a Warrant Article.  Gray seconded. The motion carried 5-0.

Meeting Schedule
Parent closed the public hearing at 7:45 p.m. and asked about scheduling of the upcoming meetings to be sure there was a quorum to discuss the 40B Application.  Pickard moved to return the April 2009 meetings to April 1 and 15, and Gray seconded.   The motion carried 5-0.  The 40B Application will be considered at the April 1, 2009 meeting.  

Wind Turbines Draft Bylaw
Planning Board reviewed the Wind Turbine draft bylaws and made changes and corrections as needed.  Parent moved to add language on educational signs in 6.25.5 since the signs need to comply with Seashore regulations.  Gray seconded.  The motion carried 5-0.

Parent moved that in 6.25.3 the minimum indemnification amount be set as $2 million.    Gray seconded, and the motion carried 5-0.

Draz moved to accept the draft as amended.  Gray seconded and the motion carried 5-0.

Warrant Recommendations
The Board agreed to reserve recommendation until for Wind Turbine Articles Z and Za until after the public hearing is held on April 15, 2009.  

Article AA  BB  BBa Municipal Water
Parent moved to reserve recommendation for Town Meeting for Municipal Water System Articles AA, BB and BBa.  Gray seconded and the motion carried 5-0.  

Articles Town Owned Lots
Parent moved to reserve recommendation for Town Meeting for the Disposition of Town Property Articles CC and DD. Gray seconded and the motion carried 5-0.  

Rules & Regulations – Lot Shape
Gray moved to reinstate the Lot Shape provision into the Rules & Regulations through a public hearing on April 15, 2009.  Harper seconded.  The Board discussed pork chop or pan handle lots, how frontage is determined on a cul-de- sac, irregular shaped lots in Wellfleet, and finding examples of problem lots.    The motion did not carry 1-4.  

Minutes of 3/4/09
Gray moved to approve the amended minutes of March 4, 2009.  Harper seconded, and the motion carried 4-0.

Other Business
Alfred Pickard discussed ZBA deliberations on homes off Ocean View Drive.  Planning Board might be able to address the issues with an Overlay District, a topic for consideration at a future meeting.   

Adjournment
Gray moved to adjourn, Draz seconded, and the motion carried 5-0.  The meeting was adjourned at 9:20 p.m.
