Wellfleet Planning Board
Minutes of Meeting and Wednesday, September 3, 2008
Senior Center Long Pond Room, 7:00 p.m.

Chairman O’Connell opened the hearing at 7:00 p.m.

7:00 p.m. Hearing  81-W Modification of a Portion of Benjamin Way
Gerald Parent recused himself as the original developer of the subdivision.

Chester Lay of Slade Associates presented the 81-W plan to eliminate a portion of Benjamin Way, located between 100 Harding Drive and 10 Wood Lot Road.  The road plan had been a part of Definitive Subdivision #79-01 for Old King’s Crossing.  Gerald Parent had signed a release for the elimination of the portion of the road.  There was discussion of access to the Sexton lot (Map 23, Parcel 91).  

Pickard moved to approve the 81-W plan.  Rowell seconded, and the motion carried 4-0.

O’Connell closed the hearing at 7:13 p.m.  Gerald Parent returned, and the regular meeting began at 7:14.

Scenic Road Tree Trimming
Paul Sellars, Senior Arborist from NStar, gave a Power Point presentation on tree removal and trimming and handed out maps on tree trimming on Wellfleet roads according to the electrical circuits.  Mr. Sellars said NStar is amenable to working with the Town on tree maintenance on scenic roads.  Planning Board discussed listing the newly designated scenic roads in the General Bylaws.  

Gould Property - Discussion of Way #100, Lieutenant’s Island
Parent disclosed that he was a long-time friend of the Aggers.
Planning Board members O’Connell and Harper had made a site visit to Way #100 earlier in the day.  O’Connell read into record a letter from Jo Walsh, who lives on Way #100. Mr. & Mrs. David Agger were present for the discussion of the road.  Chester Lay of Slade Associates explained the proposal for a subdivision of the Gould property on Lieutenant’s Island and the possibility of correcting the location of Way #100.  Mr. Lay said the Goulds did not request a change in the road bed.  The Conservation Commission had not required the change in the road to remove it from their property either.  All parties agreed that the road location would not be necessary for a future one-lot ANR division of the Gould property (Map 41, Parcel 150).

Zoning Bylaw Revision
Ron Harper had prepared a proposed revision of Section 6.1.5 of the Zoning Bylaws.  His proposal separates the Seashore District from the rest of the Town.  It applied a stricter definition for structures in the Seashore.  He had added a 6.1.6 Section.  The suggestions are separate from Site Plan Review.  Harper suggested discussing Site Plan Review – Special Permit first.  If that route is taken, he said, the 6.1.5 and 6.1.6 would not be needed.

Site Plan Review – Special Permit
The legal notice for lot coverage and Planning Board’s proposed Site Plan Review – Special Permit Articles for the Special Town Meeting Warrant was reviewed.  There was a correction to the Affordable Accessory Dwelling Unit footnotes.  

Rowell moved to include R2 for consideration along with R1 in the Building Coverage chart. Harper seconded, and the motion carried 5-0.  

Harper moved to refer Article F for advertising and inclusion in Special Town Meeting Warrant.  Parent seconded, and the motion carried 5-0.

Parent went over the figures in Article G, Section 6.24.3 Applicability.  He reviewed the numbers that trigger a Site Plan Review.  In the Applicability introductory paragraph, there was a sentence added that property 1,250 s.f. or less would not require Site Plan Approval.  

In Section 6.24.5 corrections were made in wording in #’s 4 and 5, and a sentence eliminated from #6.

Rex Peterson said that Town Counsel had seen the draft, but she had not actually reviewed it.  

Parent moved to approve Article F with the changes for advertising and inclusion in the Special Town Meeting Warrant.  Harper seconded.  The motion carried 5-0

Harper moved to approve Article H as presented for advertising and inclusion in the Special Town Meeting Warrant.    Rowell seconded, and the motion carried 5-0.  

Harper withdrew his submission of 6.1.5 revisions.

Mail
LCPC had requested time to discuss recommendations, but there was no time line given.  The Disposition of Town-owned property is another project that will be coming before the Planning Board.  Pickard and Rowell volunteered to study the Town-owned property suggestions.  The CPC request for an update on Community Needs will be discussed at a future meeting also.  
Hearing Dates
The hearing for the Selectmen’s Zoning Bylaw changes will be held September 17, 2008.  The public hearing for the Planning Board proposal will be posted for October 1, 2008.  

Minutes of 8/20/08 and 8/27/08
Harper moved to approve the amended minutes of August 20, 2008.  Parent seconded, and the motion carried 5-0.

Harper moved to approve the minutes of August 27, 2008.  Rowell seconded, and the motion carried 5-0.

Other Business
Peterson gave an update on the Airstrip Parcel.  

Adjournment
In the absence of Barbara Gray, O’Connell moved to adjourn.  Parent seconded.  The motion carried 5-0, and the meeting was adjourned at 8:55 p.m.
