Minutes of the Meeting of November 14, 2002

Mr. Pickard said that he wished Mr. Rose, chairman of the ZBA, were present for the discussion. Mr. O
Mr. Wright said that the most important criteria for the variance seemed to be the definition of
Mr. Parent said that the ZBA is not a precedent setting board. However, similar properties would tend to be treated in similar ways. Mr. O
Mr. Wright asked what the Board
Attorney Ben Zehnder said that he does not recommend suing the ZBA. He believes that would not be a good decision for the Town
Ms. Brown recommended sending a letter to the Building Inspector to ask his opinion of whether or not the lot is buildable, and how the lot was created. Mr. Parent recommended that a letter also be sent to the ZBA expressing the Planning Board

Mr. Wright suggested that the letter and any further discussion of the case be framed as questions rather than challenges. Mr. O
Mr. Zehnder asked how many of the Planning Board members attended the ZBA hearing. No members had attended. Mr. Zehnder said that showing up a week or two after the close of the public hearing and in public session to discuss the ZBA
The Planning Board members agreed to pay closer attention to upcoming ZBA agendas, and to pay particular attention to any requests for variances. Mr. Parent made a motion to adjourn the meeting. Mr. Berry seconded the motion. The Board
