Steven and Heyliger Subdivision, Off Old Hay Road

Note:  The applicant has requested modification of the original plan for improvements to Old Hay Road because a Town water pipe was discovered too close to the surface to allow the cutting and grading originally proposed.

Mr. Parent disclosed that Mr. Heyliger is the godfather of one of his children.

Mr. Lay explained that the water pipe was 3.2 feet below grade.  Therefore, no cutting could be done in that area, only filling.  The original design would require cutting.  The requested modification would add fill at the bottom of the slope (approximately 1
Further, Mr. Lay said that he would propose to relocate the turnout and pave just above the catch basin.  He would also leave an existing large tree next to the road.  Mr. Lay pointed out that he was not requesting any changes within the subdivision or to the subdivision road.  All changes would be to the improvements on Old Hay Road, which is a Town road.  These changes were requested by the DPW in order to maintain cover over the existing pipe.  Wilson questioned why the Board was able to condition it in the first place.

Ms. Wilson said that she had spoken to Don Schmidt at DHCD in Boston.  It was his opinion that any change in the drainage or slope would require a new public hearing.  Mr. O
Ms. Wilson said that she is also concerned about the relationship of the drainage and leach pits to the existing pipe.  Is there a problem with freezing?  Mr. Vincent said there would not be a problem with freezing, because the leach pits remain at a constant 45 degrees year-round.  Mr. Cahoon agreed that freezing was not an issue.

Mr. Lay said that there would also be a minor change in the location of the catch basins at the intersection of Old Hay Road and Route 6 due to the location of existing fiber optic cables.  They will be pulled back slightly to clear the cables.

Some discussion followed about the possibility of taping the water pipe for future location.  This would not be practical, because the entire length of pipe would need to receive magnetic tape.  Mr. Murphy said they would tag the location of the pipe as it is exposed.  Mr. Parent asked if they discovered that the depth is less than 3.2 inches, would they notify the Town.  Mr. Murphy said that is what they did.  Mr. Koehan, an abutter at 75 Old Hay Road, said that he was concerned about the
