Conservation Commission Meeting Minutes
Town Hall
Attendees:  Terry Gips, Ginie Page, Lauren McKean, and Cary Rea
Regrets:  John Portnoy, Trudy Vermehren and Ed Simpson
Jurisdictional Opinion:  Bernstein, 25 Beach St., Fence off property line.  There was discussion regarding the location of the split rail fencing and stockade fence.  It was recommended there be a 10 inch opening at the bottom of the stockade fence for habitat passage..  Lauren McKean moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 4-0.
Regulation Change 2.06:  Small Vessel Identification and Permitting Program – Fees.  A revised copy of the draft fees was distributed.  Denny O’Connell represented the WCT regarding the Old Wharf Point rack and stated WCT would want to have the regulation indemnifying and holding harmless applied to the Trust just as it is written for the town.   Agent Greenberg-Lemos stated Bill Iacessa asked if people who donated money could get free stickers for two or three years preference for the spots.  Options were discussed regarding this issue. Agent Greenberg-Lemos will have a discussion with Harry Terkanian regarding more racks at Mayo Beach and the issue of indemnifying the Trust.  Terry Gips will attend the Board of Selectmen’s meeting regarding the fees.
Paperwork for the Stern property was re-signed due to an administrative error.  
Correspondence:  
Letter from Paul Banner regarding King Phillip Road.  Agent Greenberg-Lemos stated an   enforcement letter had been sent to Banner for road work performed in June 2013.  Previously, Banner had said a filing would be forthcoming but it was never received.  Agent Greenberg-Lemos read a letter from Banner giving history and usage of King Phillip Road.  The commission stated there has been cutting into the marsh areas in four places for road drainage and the runoff is still a problem.  Agent Greenberg-Lemos will contact Paul Banner again and advise him that a NOI needs to be filed.
Agent Greenberg Lemos had contact with Shea regarding the decking at Crest Ave.  The commission requested a filing be submitted.

Public Hearings 5:00 pm:
Amsler, 313 Main St., Map 14, parcel 177, NOI, two 10 x 12 sheds (Cont’d).  Chet Lay stated the revised plans identified everything on the site, and the sheds and dumpster will be relocated.  Six by six inch wooden posts will be installed on the side of the driveway toward the swamp to limit the encroachment of trucks / traffic.  Drywells will be placed on to carry water from the sheds.  Amsler stated the stairs from the street will be relocated 23” closer to his building and the fence will be placed on the property line.  Lay stated the project is not within priority habitat.  The sheds will be placed on 10 inch pads and be used for storage for the tenants.  The liquor store owner stated both immediate abutters had to install new septic systems.  There was discussion regarding the parking in the back of the buildings, the truck deliveries and damage to the resources.   Commissioners indicated their lack of support for the current proposal and mitigations.  Chet Lay requested a continuation.  Terry Gips moved to continue to 02/19/14; seconded by Lauren McKean, passed 4-0.     
Cashin, 21 Arthur Cashin Road, Map 40, Parcel 148:  Certificate of Compliance.  Agent Greenberg-Lemos stated the project was built per plan.  Cary Rea moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 4-0.
Engel, 55 Warren, Map 35, Parcel 133, Abbreviated NOI, 2nd floor reconfiguration.  Gordon Peabody represented the applicant and gave an overview of the project.  Cary Rea moved to approve the Abbreviated NOI; seconded by Ginie Page; passed 4-0.  Ginie Page: supervisor.  
McMahon, 54 Valley Rd., Map 4, NOI, new septic and well, repair to driveway.  Lauren McKean recused herself.  Due to a lack of quorum, Terry Gips moved to continue to 02/19/14; seconded by Ginie Page; passed 3- 0 (1 recused).  
Donald, 0 Bayview, Map 35, Parcel 39, NOI, extend existing timber bulkhead.  Ginie Page recused herself.  Due to a lack of quorum, Lauren McKean moved to continue to 02/19/14; seconded by Terry Gips; passed 3-0 (1 (recused).
Rispoli, 15 LeCount Hollow Road, Map 30, Parcel 22, NOI, construct basement expansion, enlarge deck and construct full basement area.  David Lajoie represented the applicant and gave an overview of the project, describing the locations of the additions.  Lajoie stated the crawl space portion of the project (1C) to construct a full basement will be withdrawn from this application.  There will be changes to the stairs and decking.  Ginie Page moved to approve the NOI; seconded by Cary Rea; passed 4-0.  Supervisor:  Terry Gips.
Lauren McKean moved to adjourn at 6:05 pm; seconded by Ginie Page; passed 4-0.
