Conservation Commission Meeting Minutes
Town Hall
Attendees:  Terry Gips, Trudy Vermehren, Lauren McKean, and Cary Rea

4:10 - Business Meeting & Conservation Agent's Report
        Wesley Swamp – truck deliveries – to be discussed in the future.
        Boat Rack discussion:   Suzanne Thomas, Dave Rheault, and John Ryerson gave an overview of 2013 and what they thought would work for 2014.   Ryerson stated he needs to know the 2014 fees in order to get letters out to the 2013 participants.  43 people rented racks seasonally out of 48 racks at Indian Neck.  There was discussion regarding weekly rentals and it was determined there is not enough staff.  Suzanne Thomas stated there was confusion about rack regulations and recommended they be clarified.  People stated they wished they could get stickers at their own landings.  John Rheault placed  stickesr on boats that had to be moved; however, some were allowed to be there because they were commercial vessels.  The Harbormaster office was provided stickers to fishermen’s and tenders for boats at moorings.  Discussion took place regarding additional racks at Powers Landing and it was determined lower racks could be better placed at Mayo Beach.  There was discussion regarding a potential lottery and Dave stated it will add another level of confusion to people.  There will be fees for Pleasant Point and probably for racks located on Conservation Trust land.  It was determined there must be a public hearing regarding fees, then presented to the Board of Selectmen.  Suzanne stated the people who had a rack in 2013 will get notification via letter and must respond in 30 days, then those individuals on a waiting list will be notified, and if there are any racks available, they will be given on a first come, first serve basis.  Terry Gips moved to set fees at $30 June, $30 July, $30 August, $30 September and $50 for the season and hold a public hearing on February 5, 2014; seconded by Cary Rea; passed 4-0.  Agent Greenberg-Lemos will check to see if the Commission can go before the Board of Selectmen at their 02/11/14 meeting.              
        Organic Land Management – to be discussed at a future meeting.
        Fromboluti:  Lauren McKean recused herself.  David Lajoie represented the applicant and stated the shed and wall were damaged by trees during a storm and the owner wants to replace them, placing them a few feet from the original site.  Agent Greenberg-Lemos stated the original NOI was for a septic upgrade and there was no mention of replacing a shed and rebuilding the wall.  David Lajoie stated the work limit will be the same and he requested the Commission review the proposal for the new location of the shed and wall.  A partial Certificate of Compliance was issued, waiting for the planting plan.   David Lajoie will file a RDA.         
Public Hearings 5:05 pm:
Athans, 206 B Kendrick Ave, Map 20, Parcel 28-G, NOI, new pervious driveway and parking area (cont’d).   David Lajoie represented the applicant and stated they want to extend the wall (outside of the buffer zone) and remove invasive species and plant beach grass.  There will be no new driveway.  Lauren McKean moved to approve the NOI per new design; seconded by Terry Gips; passed 4-0.  Supervisor:  Ginie Page
Collins, 51 9th St., Map 40, Parcel 156, RDA, septic upgrade.  John Schnaible represented the applicant.  He stated the leach pit is fine and the cesspool will be replaced with a septic tank.  Cary Rea identified the RDA as a Negative 3; seconded by Terry Gips; passed 4-0.
Amsler, 313 Main St., Map 14, parcel 177, NOI, two 10 x 12 sheds (Cont’d).  The applicant requested a continuation to 02/05/14.  Trudy Vermehren moved to continue to 02/05/14; seconded by Terry Gips; passed 4-0.
Stahler, 17 Crest Ave./0 Prospect Ave, Map 35, Parcels 91 and 91.1, NOI, tree clearing and replanting (Cont’d).  The application has been withdrawn.  Terry Gips moved to allow the application be withdrawn without prejudice; seconded by Lauren McKean; passed 4-0.
Doak, 115 Baker Rd., Map 29, Parcel 339, NOI, two additions, decking and patio.  Chet Lay and Jay Horowitz, architect, represented the applicant.  The addition between the two dwellings is within the 100 foot buffer zone along with decking and patios.  A construction protocol was reviewed by Chet Lay.  Chet Lay provided a new site plan identifying a small change to the decking and the commission saw no issues.  Terry Gips moved to approve the NOI; seconded by Cary Rea; passed 4-0.  Supervisor:  Terry Gips
Huss, 170 Meadow Ave West, Map 40, Parcel 132, RDA, removal of dead wood and trees (Cont’d).  Kenneeth MacPhee represented the applicant and described the project.  A site visit was made by Hillary and Cary.  Cary Rea identified this as a Negative 3; seconded by Terry Gips; passed 4-0.
Limbach, 599 Chequessett Neck Rd., Map 19, Parcel 119, RDA, prune branches and plant cedar trees (Cont’d).   Lee Clark of Mow Town Landscaping represented the applicant and stated a cedar tree will be removed and three cedar trees will be planted.    Branches will be pruned from the locus trees for a filtered view.  Terry Gips identified this as a Negative 3; seconded by Cary Rea; passed 4-0.  
Terry Gips moved to adjourn the public hearings at 5:45 pm; seconded by Cary Rea; passed 4-0.
Business Meeting Continued:
Terry Gips moved to approve the amended meeting minutes of 12/18/13; seconded by Cary Rea; passed 4-0.

Agent Greenberg-Lemos read the letter from Linda White Shea regarding vegetation work on her property..
Agent Greenberg-Lemos read a letter she sent to the Dept. of Environmental Protection and NStar regarding. herbicide applications.
Lauren McKean stated Suzanne Thomas will be attending the 01/28/14 Board of Selectmen’s meeting regarding Gull Pond Landing.  It was recommended that someone from the Commission attend.
