Attendees:  Trudy Vermehren, Terry Gips, John Portnoy, Ginie Page, Lauren McKean, Ed Simpson, and Cary Rea, Agent Hillary Greenberg-Lemos and Christine Bates, Committee Secretary.
4:00 - Business Meeting & Conservation Agent's Report
•         John Portnoy moved to approve the amended 09/04/13 meeting minutes; seconded by Cary Rea; passed 5-0.
•         Mail:  General Conditions for NOI’s
•         Open Space Committee: Robert Hubby, Chair of the Open Space Committee, stated OSC would like the commission to review/make suggestions to OSC’s mission statement and goals which refer to the conservation commission.  Once amended, OSC will come back to the commission.    
•         Emergency Order – Herring River:  Lauren McKean and John Portnoy recused themselves.   John Portnoy stated the river has been physically blocked from the rain event two weeks ago and the culvert is filled at Old Kings Highway, extending upstream six or seven feet and there is no water flow.  The herring are unable to return to the ocean.    Don Palladino, of Friends of Herring River, and John Portnoy requested the Emergency Order to remove the sand and restore the flow of water.  This could be done by a small backhoe or performed by hand which would be laborious.  Straw bales would be used along the side of the road.  Mr. Palladino stated the sediment disposal area is a depressed area and the sand would be deposited at that point.  This will be an on-going problem and they are looking for funding to make a more permanent fix.  Lauren McKean stated the National Seashore would have to review the project because this is an archeological site.   The berm would be cut through on the west side of the road to divert runoff from the river.   Trudy Vermehren moved to approve the Emergency Order and have the Friends of Herring River, Town of Wellfleet and National Seashore remove and relocate the sediment by hand or mechanical means, install straw bales and divert water flow by digging two small trenches (2 ft wide) through the berm on the westside of the road; seconded by Ginie Page; passed 5-0.      
•         Hamblin Park restoration project:  Frank Corbin stated he was aware of the concerns of the commission and he requested that, when there are observed problems, the commission members talk to him first and not the workers.  He stated debris will be removed using the 8 foot wide path. He stated they will use straw instead of hay bales for erosion control.  The originally specified  materials will be used for the pathway from Uncle Tim’s bridge. Agent Greenberg-Lemos stated the path has been widened by the truck doing the work and the use of a truck down the central pathway was not approved.  Mr. Corbin requested a detailed plan on the places where vegetation has been damaged.  Corbin stated either pine needles or mulch will be used in the pathways.  Hugo Urbina is the foreman of the project.  The commission requested the blue stone be placed on a tarp and there will be no truck use in the center pathway.  Corbin stated he has had to replace tree flags and posts because people are taking them down.  For public information, Trudy Vermehren, supervisor, recommended signs at both ends of the project with a sketch of the project, the name of the company doing the work, and Frank Corbin’s phone number as a reference for any questions from the public.         
 Public Hearings 5:23 pm:
Lay, 335 Forrest Rd., Map 16, Parcel 612, Certificate of Compliance.  Ginie Page stated the project is in compliance; seconded by John Portnoy; passed 6-0.-1.   
 Finzi, 104 Meadow Way, Map 8, Parcel 170, Amended Order of Conditions.  David Lajoie represented the applicant and reviewed the revised plans with the commission.  Water tests were performed on the property.  The property had received an Order of Conditions in the past and now the property has been purchased and the new plan includes a screened porch and a deck.  The driveway has been relocated and is outside of the buffer zone.    The screened porch will be above the walk out basement.  Vini Divito is purchasing the property.  Mr. Lajoie stated the bank will be vegetated with native plants.  There was discussion regarding the location of the septic, the relocation of the proposed dwelling, and the work limit; commissioners suggested that all these elements might be moved out of the buffer zone.   Ed Simpson moved to approve the AOOC with  conditions; seconded by John Portnoy.  After further discussion, the commission  requested a revised plan that shifts the dwelling and the septic system farther from the buffer zone..    The motion failed.:  1-6. Terry Gips moved to continue to October 2, 2013; seconded by Cary Rea; passed 7-0.       
 Bruno, 55 7th St., Map 40, Parcels 143,175 and 181, Certificate of Compliance (cont’d from 09/04/13).  Agent Greenberg-Lemos stated beach nourishment was completed.  Terry Gips moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 7-0.  
 Eisinger, 60 Indian Neck Rd., Map 28, Parcel 49, NOI, management of invasive species, preservation and rejuvenation of healthy vegetation (Cont’d from 09/04/13).  Natural Heritage has responded favorably .  Trudy Vermehren moved to approve the NOI; seconded by John Portnoy; passed 7-0.  Supervisor:  Trudy Vermehren.
Marschall, 45 Forrest Rd., Map 16, Parcel 619, NOI, additions and new septic.  Lauren McKean recused herself.  David Lyttle and Steve Curley represented the applicant and Lyttle stated the National Seashore does not support the project.   This has to go before the ZBA as well.  The second story will be built within the current footprint.  The decking, and screened porch will be built on sono-tubes.  Lyttle stated there is a finished basement which will be converted from livable space to a storage area due to mold and mildew.  The cesspool will be removed and replaced with a Title 5 septic system.  The house has 1,546 sq ft of livable area now, and 240 sq ft of existing deck.  The proposed plans, after renovation and additions, will noto increase livable space.   Trudy Vermehren expressed concerns with the porch and deck due to the closeness to the resource and it was recommended the screen porch go on the second floor.   If the porch were eliminated, the stairs could be located at that location.  The commission also asked for mitigation with the runoff on the south side of the property.  David Lyttle requested a continuation and Trudy Vermehren moved to continue to  October 2, 2013; seconded by Ed Simpson; passed 6-0.,  
 Cary Rea moved to adjourn at 6:30 pm; seconded by Trudy Vermehren; passed 7-0.
