4:00 - Business Meeting & Conservation Agent's Report

Meeting Minutes:
The following amended meetings minutes were moved and approved
April 3, 2013, April 17, 2013 and May 1, 2013.

There was discussion regarding driving on the beach where shellfishing is closed or not allowed.   There will be further discussion with the Shellfish Advisory Board.
Jurisdictional Opinion:  180 Long Ave., remove one tree.   Ginie Page moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.
David Lajoie provided a site plan to Agent Greenberg-Lemos of Gull Pond which she  passed around to the commissioners.  The commission reviewed the plans and made recommendations for changes to the plan.  
 Agent Greenberg-Lemos stated she sent preliminary FEMA flood plain maps to the commissioners via e-mail.
The commission discussed illegal tree cutting on town land adjacent to the Bartlett property at the Gull Pond sluiceway. The Bartletts  are supposed to come to a business meeting to discuss what they have done and what their plans are for their property.

Correspondence from the National Seashore regarding replacing beach stairs and landings at Marconi Beach.

Public Hearings 5:00 pm:

Pikula, 709 Way #69, Map 21, Parcel 35, Certificate of Compliance.  The project is in compliance.  Ginie Page moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 5-0.

Gilson, 1400 Chequessett Neck Rd., Map 18, Parcel 6, NOI, reconstruct beach stairs.  Lauren McKean recused herself.  Richard Lay represented the applicant and stated damage was done to the stairs in the previous years’ storms.  He stated the lower portion of the stairs will be removable, all materials will be stored at the top of the bank and hand carried to the work site.  Natural Heritage has not responded as yet.  The Commission expressed some concern that the new stairs may not survive winter storms and may be undercut by bluff retreat. .  Ginie Page moved to continue to June 5, 2013; seconded by Ed Simpson; passed 5-0

Reisinger, 240 Blue Heron Road, Map 41, Parcel 20, NOI, construct new dwelling.  Tim Brady represented the applicant and stated that the septic system is already installed on the property.   He stated that the 1996 plans do not show the resource areas  as they are today.  The Riverfront Act was not in effect at the  time of the previously approved plan.  There was discussion regarding a four bedroom plan and the septic system.  The commission stated the dwelling would be within the 50’ buffer zone, it would be directly adjacent to the coastal bank, and it is very large in size.  Brady stated the lot was created in 1963.  In 1997 the survey identified a marsh.  Brady stated it would be less impact to the resources with a walk-out basement.    Letters from Lisa and Mike Goulwin and Sara Winsomb (ck) opposed the project.  Abutter Blau opposed the project.  Mr. Galvin, abutter, questioned Brady if the new plan is the same plan that was approved; Brady stated that it was not, but the original plans would have placed the dwelling 100 feet from the river.  Another abutter stated there are too many resource issues with this lot.  Brady will go back to the applicant with the commission’s concerns and therefore requested a continuation.  John Portnoy moved to continue to June 5, 2013; seconded by Ginie Page; passed 5-0.

Mail:  A letter was received from FEMA regarding their new preliminary Flood Insurance Rate Maps  
 Discussion regarding Bunnell property.  Agent Greenberg-Lemos will have a discussion with the Building Inspector regarding the definitions of sheds versus studios.    
 Ed Simpson moved to adjourn at 7:15 pm; seconded by John Portnoy; passed 5-0.
