4:00 - Business Meeting & Conservation Agent's Report
•       Agent Greenberg-Lemos sent a memo to the Historical Commission regarding Hamblen Park.
•       Terry Gips stated the commission needs to keep order during the public hearings and stay on track and have the applicant speak to the entire commission.  Trudy Vermehren also reminded the commission when on site visits, to stay focused on the applicant’s request.

                A letter was received from John Riehl regarding the State of the Harbor Conference                      scheduled for November 3, 2012..  He requested the commission for input regarding current               issues, vision for the Harbor for 2022, and what projects or accomplishments has                        the committee performed for the Harbor.  There was discussion regarding         the Mayo Creek           restoration project and who is heading it up at this time.  Agent Greenberg-Lemos stated one            of the goals would be to get Harborside Village on the town water.  Agent Greenberg-Lemos               will contact the technical committee for the Mayo Creek Restoration project.
•       Gordon Peabody provided paperwork on slope stabilization.  The commission will send him a letter        thanking him for the materials and they will use them in the future.  
•       Agent Greenberg-Lemos received a call from a resident stating he saw an osprey eating a                 great-blue heron.  The resident felt the osprey was reducing the amount of other birds in the area.     The commission recommended the gentleman contact MA Audubon.  John Portnoy stated osprey are    almost extinct on the Cape and that is why there are bird houses in the area so they have a place to    live.  
•       Agent Greenberg-Lemos will contact Patterson again.
•       The kayak rack request was funded for half the amount requested.  Agent Greenberg-Lemos will    contact Suzanne Thomas, DPW and the Marina to see if additional funding could be gathered to build      the amount the commission would like.  
•       Shoreline Change seminar to be held on Tuesday, Sept. 25, 2012 at Woods Hole.
•       The commission will prepare comments for the draft wastewater program.   
•       Agent Greenberg-Lemos stated the Herring River Restoration Committee will be ready to release the       draft.  There will be a public hearing scheduled for public comments.  
     
Public Hearings 5:00 pm:

Town of Wellfleet, Amendment to NOI, Commercial Street Drainage Project.  Lisa Goyer of EPG presented information on drainage and sidewalks.  The drawings did not identify the distance from the resources and did not identify the buffer zones for the river area.  There were no elevations identifying the catch basins and at what pitch the run off would flow.  Lisa Goyer stated there will be four new leach pits from Kendrick to the marina for the catch basins.  There will be a curb at the Pearl Restaurant identifying their property vs. the street.  The sidewalk will not be extended up Holbrook due to financial issues.   She stated the pavement will be 1 ½ inches above the current elevations.  The commission requested a plan identifying the elevations to ensure the water will be pitching correctly into the catch basins, identifying where the hay bales and silt fencing will be located for the work limit, elevations for the road surface from Kendrick Ave. to Holbrook, and what the additional paving will be performed as shown to the Board of Selectmen.  Alfred Pickard questioned if there would be a sidewalk going up Holbrook Ave., as shown on the plan.  Lauren McKean moved to continue to October 3, 2012; seconded by Cary Rea; passed 7-0.

Bruinooge, RDA, Aquaculture grant (Cont’d from 09/05/12).  At the request of the applicant, Terry Gips moved to continue to 10/03/12; seconded by Cary Rea; passed 6-0.
Valli, 30 Ridge View Dr., Map 13, Parcel 134, NOI, New well, 12’ x 16’ deck and portion of proposed addition within 100 ft buffer.  At the request of the applicant Terry Gips moved to continue to 10/03/12; seconded by Ed Simpson; passed 6-0.

Lindsay, 30 Pine Point, Map 21, Parcel 69, RDA, reconstruct patio.  Sharyn Lindsay stated the current patio was not built properly and it will be rebuilt with an additional walkway/path.  The application did not include any site plan with drawings of the proposed patio and Ms. Lindsay gave an overview of the changes she planned on making for safety reasons.  The Commission had concerns with the erosion of the bank and requested a new plan identifying all new work to be done with accurate measurements.    The commission also wanted the property lines delineated.   Terry Gips moved to continue to 10/03/12; seconded by Ed Simpson; passed 6-0.

Coates, 10 First Ave, Map 30, Parcel 120, Amendment to NOI.  Steven Phillips represented the applicant and stated they want to change the porch location so the owners can enjoy a better view.  The porch will be built on sono-tubes.  Ginie Page moved to approve the Amendment; seconded by John Portnoy; passed 6-0.   
Emmons, 119 Hamblen Farm Rd., Map 19, Parcel 13, NOI, well and septic upgrade (Cont’d)  John Portnoy and Lauren McKean recused themselves.  David Lajoie and Ben Zehnder represented the applicant.  Lajoie identified the revisions to the plan which included the driveway, parking, vegetation in the driveway/parking area, new planting areas, a small walkout area from the proposed new dwelling, with the removal of the various sheds, 619 sq ft will be removed and the new building will be 576 sq ft.  Concerns of the commission included too much work within the 50 and 100 buffer zone, the square footage includes lot coverage that is not verifiable in the files.   Zehnder stated the small shed/one bedroom building is not useable at this time and the replacement will be useable.   Sarah James, abutter, paraphrased an e-mail which Agent Greenberg-Lemos had not received from another abutter, stating there were issues with the width of the road, as well as the size of this proposal.  Attorney Zehnder stated by removing the sheds, etc. it is an improvement and benefit to the property.  Lajoie stated this is a redevelopment and will be an improvement to the property.  Cary Rea stated he didn’t feel a split rail fence was a barrier.  David Rickets, not an abutter, but close to the area, read his letter of concerns regarding the septic systems, lot coverage, etc.  Attorney Zehnder stated the Board of Health conditions identified I/A system technology.  Attorney Zehnder stated the increase in lot coverage was better use of the property.  Trudy Vermehren moved to deny the project as presented; seconded by Ginie Page; 4-1 in opposition of the project with one voting in favor of the project.           
   
Brimm, 160 3rd St., Map 40, Parcel 102, NOI, shorefront revetment (Cont’d from 06/20/12).  Don Munroe represented the applicant and identified the revisions on the plan.  Many of the changes are a result of the September 24, 2012 letter from the Division of Fisheries and Wildlife.  Ed Simpson moved to approve the NOI; seconded by Cary Rea; passed 6-0 with conditions.  There was further discussion regarding the nourishment for both the Brimm and 2 Ctr Plaza Nominee Trust.  

2 Ctr Plaza Nominee Trust, 150 3rd St., Map 40, Parcel 98, shorefront revetment (Cont’d from 06/20/12).  Don Monroe represented the applicant and identified the revisions on the plan based on the September 24, 2012 letter from the Division of Fisheries and Wildlife.   The stones and fiber rolls will be buried.  The nourishment conditions of the Fisheries and Wildlife letter were discussed and any changes will have to be reviewed by that agency.    There was discussion regarding the location of the shed on the property.  Bob Prescott of MA Audubon questioned if there are any breaks for the terrapins and Natural Heritage took their well-being into consideration with the conditions they are imposing.  If there were a future catastrophic event, Natural Heritage would be involved with the decision of covering the drift fence.  Cary Rea moved to approve the NOI; seconded by Ed Simpson; passed 6-0 with conditions.   

Wright, 0 Blackfish Creek, Map 35, Parcel 210, NOI, replace timber bulkhead with rock revetment (Cont’d).  At the request of the applicant, Terry Gips moved to continue to 10/17/12; seconded by Ginie Page; passed 7-0.
