4:00 - Business Meeting & Conservation Agent's Report

Mail:
A request from Gordon Peabody to present and distribute a slope stabilization booklet to the commission. It was recommended the booklet be distributed to the commission prior to a presentation.

MA Marine Fisheries flyer – new rules and regulations regarding keeping shellfish safe in the summer months.

Kopelman and Paige letter regarding the revision of permitting extensions.

Kopelman and Paige letter regarding American Disability Act regarding access for mobility with wheelchairs for trails. After discussion the Commission stated they would like someone from the firm to come and clarify the new regulations.

Other:

·       Terry Gips recommended the commission respond to the Wastewater Report because there was no reference to the Wellfleet Environmental Bylaw.
·       Mid-Cape Home Center storage redesign – changing design of the storage racks. Agent Greenberg-Lemos passed around the proposed drawing changes. The commission felt that it didn’t require a new filing. Terry Gips moved to accept the revised drawings and not require an additional application; seconded by Ed Simpson; passed 7-0.
·       Paved driveways in wetlands jurisdiction – once a curb cut is installed, they do not have to come before anyone in town. Catch basins are getting full and overflow goes into the resources. John Portnoy stated his biggest concern is the movement of sediment into resource areas.
·       The wetland flyers will be mailed out shortly.
·       Vernal Pool at 200 Cove Road:~ Agent Greenberg-Lemos stated she has not received any reply from EPG who was to supply information regarding replanting. Terry Gips moved to have Agent Greenberg-Lemos send a letter to EPG regarding the vernal pond on 200 Cove Road; seconded by Ginie Page; passed 7-0.
·       Hamblen Park – Cary Rea stated he would like some signage which would identify it was a park. Agent Greenberg-Lemos will send a memo to the Historical Commission requesting them to come to a business meeting to discuss the status of their plan.
·       Cary Rea moved to approve the amended meeting minutes of 08/01/12; seconded by John Portnoy; passed 7-0.

Public Hearings 5:00 pm:

Rispoli, LLC, 15 LeCount Hollow Rd., Map 30, Parcel 22, Amended Order of Conditions for decking and additions. At the request of the applicant, Terry Gips moved to continue to October 3, 2012; seconded by Ginie Page; passed 7-0.

Malnak, 470 Old Wharf Road, Map 35, Parcel 20, Certificate of Compliance.Agent Greenberg-Lemos stated the first Certificate of Compliance was issued in 1987 but never filed with the Registry of Deeds. Therefore; a new signature page was signed.

Daphnis Family 2000 Trust, 420 Cove Road, Map 28, Parcel 26, Request for Extension. Due to the Revisions to Permit Extension Act, no action is required. Terry Gips will be the supervisor.

Gedrich, 41 and 45 Crest Ave, Map 35, Parcels 87.2 and 87, NOI, removal of scrub oak clusters and replacement with natural species. Chet Lay represented the applicant and provided details on the tree removal as well as the new plantings.~ Discussion included possible use of herbicide to control regrowth of oak and changes to the list of plants to be used.  Several areas within the 50’ buffer zone were deleted from the plan during the discussion.  Bearberry replaced low bush blueberry and the number of plants per species were outlined.  Townsend will be doing the work. Hand pruning will be used for maintenance. Terry Gips moved to approve the NOI with conditions; seconded by John Portnoy; passed 7-0.

Bruinooge, RDA, Aquaculture grant. Bruinooge stated this would be a half acre extension   Natural Heritage requested additional information and the applicant needs to provide it before the commission can approve the RDA. Terry Gips moved to continue to September 19, 2010; seconded by Ed Simpson; passed 7-0.

Bunnell and Zahner, 56 Beach St., Map 35, Parcel 10, NOI, construct 3 sheds, pergola and decks. Chet Lay and Mr. Bunnell came to the table and Lay gave an overview of the project. The commission requested measurements of the total lot coverage of the proposed  construction within the 50’ and the 100’ buffer zones.  The commission requested what the overall lot coverage would be within~ the 50’ and the 100’ buffer zones. The commission had concerns with the amount of disturbance to the property and would like to see a reduction in the scope of the work. The commission recommended relocating the kayak shed outside of the 50’ setback. Chet Lay requested a continuation. Terry Gips moved to continue to October 3, 2012; seconded by Cary Rea; passed 7-0.

Valli, 30 Ridge View Dr., Map 13, Parcel 134, NOI, New well, 12’ x 16’ deck and portion of proposed addition within 100 ft buffer. Jason Ellis represented the applicant and gave an overview of the project, stating there will be additional work done to the property outside of the buffer zone. DEP had not responded to date.~ Trudy Vermehren moved to continue to September 19, 2012; seconded by Terry Gips; passed 7-0.

Terry Gips moved to adjourn at 6:30 pm; seconded by John Portnoy; passed 7-0.
