4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Terry Gips called the meeting to order at 4:03 pm.

Agent Greenberg informed the Commission that Tanya Daigneault gave her notice to leave employment with the Town of Wellfleet.

Jurisdictional Opinions:
Rice, 11 Partridge Way, remove a total of 6 scrub pines. Terry Gips stated she had a discussion with the owners and advised them they would need to come before the commission before doing any work on the property. The Board stated the tagged trees at the site visitation were random and they had not provided a revegetation plan. The Commission recommended they file a RDA and recommend hiring an environmental landscape company who will recommend replantings and a removal plan.

Mayo Beach – sand fencing to prevent new access paths. Suzanne Thomas stated she had received recommendations from a concerned citizen to place fencing in newly created paths. She stated she would add new signage regarding walking on designated paths. Ginie Page moved to approve the Jurisdictional Opinion; seconded by Lauren McKean; passed 7-0.

Allison Palmer – 70 Lookout Rd, remove one dead pine tree and prune another tree. Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 7-0.

Lauren McKean, Suzanne Thomas and Agent Greenberg-Lemos attended a pond meeting. Data identifying the decline of the water quality was provided for Long Pond and Duck Pond. Lauren McKean stated a new group has been formed to study Duck Pond. She stated the split rail fencing will be replaced and jute will be used to contain the soil at the base of the fencing. It appears the sediment has been the reason for the degrading of the water. Split railing will be placed across some recently made paths to keep pedestrians in designated areas. Suzanne Thomas stated she talked with the DPW and the fencing could be placed within the next couple of weeks. Agent Greenberg-Lemos recommended an emergency filing or Jurisdictional Opinion be filed in order to complete the project prior to the height of the season. Lauren McKean will provide a report at the next meeting.

The commissioners discussed their concerns with possible public use of a small site which has reverted from private use to the Seashore on Long Pond. Their concerns include the lack of bathroom, amount of parking and how much would be reserved for handicapped visitors, bike racks, how patrolling and enforcement will be provided, people driving over wetlands and into the wetlands, and “no parking” signs on the road. It was recommended a porta-potty be installed and the area be a walk-in only beach to reduce degradation. It was also noted that it is dangerous to enter and exit the parking area because of the sharp curve in the road.  Suzanne Thomas stated there has been light to moderate use of the beach area in the past because people thought it was private property. Agent Greenberg-Lemos will send a letter to the National Seashore with the commission’s concerns.

MAIL:
A letter, included photographs of the erosion, was received from a concerned citizen regarding damage caused by vehicles driving over the sand at Indian Neck. Agent Greenberg-Lemos stated DPW will provide signs to be placed at the area to discourage driving over the sand other than in established roads.

Notification of a minor change for the Wellfleet Dredging project was received, which does not require a new filing.

Violation letters for Dixon and Valli. Trudy Vermehren stated a site visit to the Dixon property showed some fill had been moved. She stated the major part of the area of concern has new vegetation. Agent Greenberg-Lemos stated no site plan for Dixon had been provided.   She will send Dixon a letter regarding the non-permitted fencing and the need for further sand removal. It was also noted there are two burn areas near the wetlands. The commission recommended a planting plan and a site plan.

John Portnoy requested Lauren McKean identify the ownership of property for the Herring Warden’s use.

Public Hearings 5:05 pm:

Blasch Del Mar, LLC, 1440 Chequessett Neck Rd., Map 18, Parcel 8, Certificate of Compliance. Lauren McKean recused herself. Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Campbell Rea; passed 5-1 with conditions.

Tesson, Shellfish grant. Ed and Patrick Tesson. Since no response has been received from Natural Heritage, this will have to be continued. Ginie Page moved to continue to June 20, 2012; seconded by Trudy Vermehren; passed 7-0.

Bunnel & Zahner, 56 Beach St., Map 35, Parcel 10, Certificate of Compliance. Agent Greenberg-Lemos stated the project is within compliance. Ed Simpson moved to approve the Certificate of Compliance; seconded by Campbell Rea; passed 7-0.

Emmons, 119 Hamblen Farm Rd., Map 19, Parcel 13, NOI, new wells and septic upgrade (cont’d from 05/16/12).~ David Lajoie represented the applicant. Agent Greenberg-Lemos stated that the hearing will have to be re-advertised due to improper abutter notification. The Board of Health will have to review the project again, also.   No decision will be made at this time, but Lajoie requested an opportunity to discuss the project. He provided a plan for a small Cape Cod dwelling to replace the cottage. Agent Greenberg-Lemos requested he locate Mill Creek on the site plan to ensure the project is 200 feet from the bank. Lajoie stated they are proposing A/I technology for the septic systems. He stated the Board of Health approved a three bedroom and a 2 bedroom septic system. Agent Greenberg-Lemos recommended they file with the Zoning Board of Appeals for a setback relief so that the proposed dwelling~could be sited further out of the buffer zone. Trudy Vermehren stated she is concerned with the hydric soil, is against a three bedroom dwelling replacing the one bedroom cottage, and the intensity of use on the lot. Sarah James, abutter, stated the cottage is basically one room. This is a private road with property ownership going to the middle of the road. Lauren McKean requested a plan identifying the proposed disturbance to the property, which includes landscaping, driveways, etc. The subdivision proposal will be going to several other boards in town for recommendations/statements.
