4:00 - Business Meeting & Conservation Agent's Report
Trudy V called the meeting to order at 4:05 pm.

Jeff Hughes, Herring Warden, regarding Old Kings Hwy and culvert for Herring River. The commission made a site visit to observe the sediment run off from the sand road into the stream. One of the first questions raised concerned the ownership of the road as it crosses Herring River at the site of the herring count. Hughes stated clear title is required for future grant money. The water may be owned by the State and John Portnoy will check into it. Agent Greenberg-Lemos stated the Order of Conditions issued to the Herring Warden in 2008 is still valid. John Portnoy recommended that Hughes and the Conservation Commission team up with the National Seashore to address the problem.~ The retaining wall adjacent to the culvert under the a bridge will require on-going repairs. Hughes stated because of the sediment in the runoff and the dry spring, the water is shallow which makes it difficult for the herring to migrate upstream. Hughes said he is nervous about removing silt to improve flow because he would be disturbing the area where other species live. He stated he is having issues with poachers He gave an overview of the poaching activity and stated the National Park is aware of the poaching. Jeff stated he has the ability to write tickets but would prefer not to Agent Greenberg-Lemos stated a letter should be written to the National Park regarding the poaching. John Portnoy recommended having the National Seashore identify the ownership of the road, the land, the water, and property to help improve the water flow. There is a question regarding what Jeff can and can’t do without a permit.~ Agent Greenberg-Lemos stated we may go to Town Counsel to make a determination as to what authority the Herring Warden can do. Portnoy recommended asking DMF to identify the responsibilities. Jeff Hughes will come back on June 20 for further discussion.

Jurisdictional Opinions:
5 Crest Ave, Garrity, remove 6 hazardous pine trees. Terry Gips moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 6-0.

Crockett, 45 Holbrook Ave, remove 3 locust trees. Ginie Page moved to approve the Jurisdictional Opinion; seconded by Campbell Rea; passed 6-0.

Campbell Rea moved to approve the amended 4/18/12 meeting minutes; seconded by John Portnoy; passed 6-0.

Public Hearings 5:00 pm:

Psathas, 154 Meadow Ave. West, Map 40, Parcel 67, Certificate of Compliance. Agent Greenberg-Lemos stated it is in compliance.~ Terry Gips moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 6-0.

Grullemans, 60 Ring Road, Map 41, Parcel 94, Certificate of Compliance. Agent Greenberg-Lemos stated it is in compliance, Ginie Page moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 6-0.

Commissioner Lauren McKean arrived at the meeting at 5:10 pm..

Meister, 295 King Phillips Rd., Map 35, Parcel 198, RDA, topping/removing trees (Cont’d from 05/02/12). Agent Greenberg-Lemos stated she has not heard from the applicant. She recommended sending a letter to the homeowner and remove this RDA from the agenda.

Emmons, 119 Hamblen Farm Rd., Map 19, Parcel 13, NOI, new wells and septic upgrade (Cont’d from 05/02/12).~ David Lajoie represented the applicant.~ He stated the Board of Health approved a total of 5 bedrooms for the property.~ He stated there would be alternative treatment septic systems for both parcels. A driveway would have to be installed for the smaller cottage. Lajoie had not done any soil tests as yet.~ He stated the applicant’s choice was to have the larger dwelling be two bedrooms and the smaller unit become three bedrooms. Lajoie stated he will bring plans to the next meeting. Terry Gips moved to continue to June 6, 2012; seconded by Ed Simpson; passed 7-0.

Maier, 1015 3rd Ave, Map 40, Parcel 7, RDA, Install permanent generator. Betty Maier stated Days Propane and Long Point Electric will install the generator. Terry Gips identified the project as a Negative 3; seconded by Ed Simpson; passed 7-0.

Collins, 51 9th Ave, Map 40, Parcel 156, RDA, Footings for deck. Rob McCarthy represented the applicant.~ The footing will be under the existing deck. Campbell Rea moved to identify this as a Negative 3; seconded by Ginie Page; passed 7-0.

Peters, 3779 St. Hwy, Map 3, Parcel 4, RDA, Abandon failed septic system. Matt Farrell from O’Reilly Associates stated there is a new septic system in place and that the tank will be pumped and filled with sand. Ginie Page moved to identify this as a Negative 3; seconded by John Portnoy; passed 7-0.

Ganak, 55 Parkington Hill Rd., Map 46, Parcel 27, NOI, addition to dwelling. David Lajoie represented the applicant and gave an overview of the project. Agent Greenberg-Lemos questioned where he took the measurement from the river and Lajoie stated it was from the edge of Hatches Creek which is fresh water. Terry Gips moved to approve the NOI; seconded by Ed Simpson; passed 7-0.

Wright, 0 Blackfish Creek, Map 35, Parcel 210, NOI, replace timber bulkhead with rock revetment (Cont’d from 04/18/12). Ginie Page moved to continue to June 6; 2012; seconded by John Portnoy; passed 7-0.

Henrickson, 0 Blackfish Creek, Map 35, Parcel 210, NOI, replace timber bulkhead with rock revetment (Cont’d from 04/18/12). Ginie Page moved to continue to June 6, 2012; seconded by John Portnoy; passed 7-0.
