4:00 - Business Meeting & Conservation Agent's Report

Terry Gips opened the business meeting at 4:05 pm.

Mark Borrelli of the Center of Coastal Studies gave a presentation on beach profiling. He stated they had received a seed proposal from Cape Cod 5 Cents Bank to perform 5 beach profiles from Sandwich to Provincetown. Borrelli stated they will profile Duck Harbor Beach and the Gut in Wellfleet every two weeks for twelve months at spring low tide. He stated beach profiles have never been done in this area and he is looking to gather data. He stated the sand at Duck Harbor goes in two different directions and will give an indication of how that shore face is evolving, based on weather and currents.   He gave a description of the equipment that is utilized for the study. Notification of additional funding will be received in June. The commission selected Powers Landing and Newcomb Hollow Beach for profiles paid for from Commission funds. If additional funding comes through, these choices might be modified. Trudy Vermehren moved to approve the beach profile project with appropriating money from the commission; seconded by Campbell Rea; passed 6-0.

Eurich property update, Chequessett Neck Road.~ Lara from Safe Harbor provided paperwork on green roofs. Agent Greenberg-Lemos presented a site plan from Coastal Engineering which identifies what is actually on the ground versus which was approved.  The soil for the green roof will be premade plant trays and hand carried to the roofline. Agent Greenberg-Lemos will check on the conditions related to the green roof(s) because there was confusion at the meeting about whether the main house or the storage bunker or both would have green roofs..

Agent Greenberg-Lemos recommended the commission take a vote to support the intent to hold conservation restrictions for the Walker property through the Conservation Trust. Trudy Vermehren moved to approve the Conservation Restriction for the Walker property; seconded by John Portnoy; passed 6-0.

Jim O’Connell has agreed to review and report back to the Commission his findings for the NOIs for 0 Pleasant Point. Money will be collected from the five applicants and put in escrow with the Town Clerk. Ginie Page moved to hire Jim O’Connell to perform research for the 0 Pleasant Point project; seconded by Campbell Reas; passed 6-0.

Agent Greenberg-Lemos~ stated she received a phone call from David Lajoie regarding the Wise property on King Phillip Road.~ She understood that Lajoie recommended using Kevin Rose as a contractor and that he would use an excavator to remove the trees. Lajoie clarified that the trees will be taken down by hand and lifted to the excavator for the removal off the property.


Public Hearings 5:02 pm:

Harborside Village Coop, 20 Wellfleet St., Map 20, Parcel 19, Certificate of Compliance.~ Agent Greenberg-Lemos stated the septic upgrade was done in compliance. Ginie Page moved to approve the Certificate of Compliance; seconded by Trudy Vermehren; passed 6-0.~

Nickerson Lumber Co., 45 Commercial St., Map 15, Parcel 102:~ Certificate of Compliance. There was one Order of Conditions and two amendments.~ The property is for sale and requires closure. There was discussion regarding the materials on the retaining wall and David Lajoie stated it is a berm to help divert water. Trudy Vermehren moved to approve the three Certificates of Compliance; seconded by Campbell Rea; passed 6-0.

Nickerson Lumber Co., 45 Commercial St., Map 15, Parcel 102:~ RDA, Installation of two lumber storage racks. David Lajoie represented the applicant and stated it was originally proposed in 2007 and approved. A small amount of excavation will be required to install the supports for the racks and repaving will take place in those areas. Lajoie stated the work would take approximately one week. The drains on the property were recently cleaned.~ The free standing racks behind building 2 will be removed. Terry moved to identify this project as a Negative 3; seconded by Lauren McKean; passed 6-0.

Emmons, 119 Hamblen Farm Rd., Map 19, Parcel 13, NOI, new wells and septic upgrade (Cont’d from 04/18/12).~ David Lajoie represented the applicant distributed revised plans. He stated the Board of Health had no problem with the subdivision. The Board of Health regulations state there could be a total of 8 bedrooms on the two properties.  The properties are within the 100 foot buffer zone and the Commission expressed concerns with any new construction. The only thing currently before the Commission is to approve the wells and septics, not any future construction. However, the commission was reluctant to approve the current proposal without plans for future construction   Lajoie proposed the current one bedroom dwelling become a two bedroom dwelling with a second floor and the one bedroom cottage become a one story two bedroom unit. The commission asked Lajoie if he would consider composting toilets instead of the I/A system. The commission requested core samples be taken and soil borings to verify the wetland delineation. The commission requested the applicant look at alternative plans based on footprint, use, and wetland concerns. Terry Gips moved to continue to May 16, 2012; seconded by Trudy Vermehren; passed 6-0.

Meister, 295 King Phillip Rd., Map 35, Parcel 198, RDA, topping/removing trees.~ Terry Gips moved to continue to May 16, 2012 because no representatives were at the meeting; seconded by Trudy Vermehren; passed 66
McDavitt, 175 Commercial St, Map 21, Parcel 117, RDA, construct wooden deck and staircases at southerly end of dwelling. Chet Lay represented the applicant and stated there would be six sono-tubes within the floodplain. The elevation of the deck will be level with the existing porch. The private hedge will be replaced with other trees. Trudy Vermehren identified this project as a Negative 2, seconded by Campbell Rea; passed 6-0.

Brimm, 160 3rd St., Map 40, Parcel 102, NOI, shorefront protection (Cont’d from 03/07/12).~ At the request of the applicant Terry Gips moved to continue to June 6, 2012; seconded by Lauren McKean; passed 6-0.

2 Center Plaza Nominee Trust, 150 3rd St., Map 40, Parcel 98, NOI, shorefront protection (Cont’d from 03/07/12). At he request of the applicant, Terry Gips moved to continue to June 6, 2012, seconded by Lauren McKean, passed 6-0.

Terry Gips moved to close the public hearings at 6:04 pm; seconded by Trudy Vemehren; passed 6-0.

Business Meeting reopened at 6:04 pm.

Terry Gips recommended that the harbor master, beach administrator, and shellfish personnel be informed that Boats/Floats proposal that had been worked on throughout the winter had been well received by the Town Administrator, and that the program would begin in spring 2013. In the remaining months of 2012, racks will be built by AmeriCorps personnel and efforts will be made to educate and inform the public.

On May 22 there will be a Ponds Meeting at the Nat’l Seashore HQ. Lauren McKean requested the commission make a site visit to Gull Pond

Terry Gips read an e-mail from MACC regarding endangered species.~
