Minutes of Conservation Commission Public Meeting

Co-Chair Terry Gips called the meeting to order at 4:08 pm

Agent Greenberg-Lemos updated the commission on the tree cutting on the Lowenberg’s property on Crest Ave. (now owned by Gifford). She reported the majority of the cutting was done on Hillel’s (abutter) view easement across the Gifford property. Agent Greenberg-Lemos will send letters to both parties and request their attendance at a meeting to discuss tree cutting. There is a Certificate of Compliance with on-going conditions, including re-vegetation on the Gifford property.

MAIL:
·       any warrants need to be submitted by February for the Spring Town Meeting.

·       Agent Greenberg-Lemos reported there is a modification to of the storm water overflow of Holbrook and Commercial (there was no easement from either Pickard or Danforth).

·       Letter from Agent Greenberg-Lemos to Hendrickson regarding selective cutting and pruning at 174 Pleasant Point Rd within buffer zone.

·       Letter from Agent Greenberg-Lemos to Loudon regarding stairs off deck at 15 Pleasant Point Landing. The owner replied that the stairs had been remove.

·       Letter from Agent Greenberg-Lemos to Dillard and Richardson at Pleasant Pont Landing stating the bulkhead was not retaining sand.~ No action being taken.

Ginie Page moved to approve the amended December 7, 2011 minutes; seconded by Ed Simpson; passed 5-0.

Agent Greenberg gave an update regarding the Assistant Agent’s position. This will be a part time position (18 hours per week) with the possibility of utilizing Barnstable County employees two days per week as well.
 
At the January 18, 2012 business meeting, the commission will discuss Gull Pond, boats, floats and vessels.

Public Hearings 5:00 pm:

Town of Wellfleet, NOI, Paving and Drainage of various sites within Wellfleet (cont’d from 12/21/11).~ Agent Greenberg-Lemos will discuss a mitigation program with Paul Millett of EPG and the DPW regarding Cove Road and wetlands. Terry Gips moved to continue to 1/18/12; seconded by Ed Simpson; passed 5-0.

Ahern, 6 Pleasant Point Landing, Map 35, Parcel 105, NOI, install full foundation under existing structure (cont’d from 12/21/11). The DEP # had been received so Ed Simpson moved to approve the NOI with conditions; seconded by Campbell Rea; passed 5-0. Supervisor: Terry Gips

Hall, 90 Aunt Sarah’s Way, Map 42, Parcel 58, RDA, Trim/remove locust trees. Peter Hall explained that he wants to trim three or four locust trees in order to allow light in for other trees. Ed Simpson will make a site visit to determine what trees will be cut prior to the actual work. Terry Gips identified this as a Negative 2 determination; seconded by Ginie Page; passed 5-0.

Yankelovitch, 374 King Phillips Rd., Map 35, Parcel 182, RDA, Septic Upgrade. David Lajoie represented the applicant and reviewed the project, stating a new well will also be installed. The one cesspool on the south west will be removed due to the location and current erosion on the property. The other cesspool will be pumped and filled in. Terry Gips identified this as a Negative 3 determination; seconded by Ed Simpson; passed 5-0.

Pekula, 70 Way #68, Map 21, Parcel 35, NOI, Construct Accessory Bldg (studio). David Lajoie represented the applicant and gave an overview of the project, stating it will be placed on pilings, with an exterior pump to move waste water to the existing septic system, thus allowing bathroom facilities in the studio. Ed Simpson moved to approve the NOI; seconded by Ginie Page; passed 5-0. Supervisor: Campbell Rea

Gyory, 100 Ione Rd., Map 28, Parcel 69, NOI, Septic Upgrade. David Lajoie represented the applicant and gave an overview of the topography of the property and the project. Ed Simpson moved to approve the NOI; seconded by Ginie Page; passed 5-0.

O’Connor, 90 LeCount Hollow Rd., Map 30, Parcel 9, NOI, Remove existing garage and barn and replace with wood frame structure (Cont’d from 12/07/11). Emily Beebe and Mr. O’Connor came to the table. Beebe reviewed what was originally proposed and stated the new proposed structure would be moved to the north on the property. There will be less activity within the 50 foot buffer than the original plan. Once the barn and garage are removed, the area will be regraded and reseeded with no contour changes. Parking will be at the main house. The basement of the new structure will be used for storage. Beebe discussed the plans with the building inspector; it will meet current regulations provide there is no stove in the building. Ed Simpson moved to approve the NOI with conditions; seconded by Ginie Page; passed

Cashin, 21 Arthur Cashin Way, Map 40, Parcel 148, NOI, Septic Upgrade.~ Stephanie Sequinn of Ryder & Wilcox represented the applicant. She gave an overview of the property and the structure. Along with a septic upgrade, a new well will be installed. A new foundation will be installed under the existing building and sun room; the deck will also be replaced. Sequinn stated the contractor doing the excavation requested that he be allowed to redistribute the material (sand from removed from the new basement) across the site within the work limit.~ She stated there will be approximately 37 yards of sand.~ Sequinn stated she will have a better calculation of the excavation material at the January 18, 2012. Campbell Rea moved to continue to January 18, 2012; seconded by Ed Simpson; passed 5-0.

Mondano, 387 Bound Brook Way, Map 6, Parcel 11, NOI, coastal dune restoration, relocation of driveway, propane tank and utility line and grading. (cont’d from 11/21/11). At the request of the applicant, Terry Gips moved to continue to 02/01/12; seconded by Ed Simpson; passed 5-0.

Bernstein, 95 Wigwam Rd., Map 35, Parcel 206, addition of deck. Chet Lay and Manny Heylinger represented the applicant. Lay gave an overview of the project, stating new footings will be used, dug by hand, concrete poured by hand, and materials removed from the site. There was discussion regarding the location of the proposed deck since it would extend over the coastal bank. Revised plans with a reduced deck will be prepared along with a new site plan identifying the ACEC. Heyliger asked if a Jurisdictional Opinion had been issued for a shed under the deck. Terry Gips moved to continue to January 18, 2012; seconded by Ginie Page; passed 5-0.

Campbell Rea moved to adjourn at 6:55 pm; seconded by Ed Simpson; passed 5-0.
