Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Co-Chair Trudy Vermehren called the meeting to order at 4:05 pm

Jan Plaue came before the Commission to discuss Hamblen Park    She stated 3 months ago the Open Space Committee wanted to place a sign in the park stating this was the first land donated to the Town and designated a perpetual park.   She stated this land should be controlled by the Conservation Commission instead of the town.  There is not a conservation restriction on the property at this time but the conditions of its donation stipulate that it be conserved.   Agent Greenberg-Lemos stated she had received a grant from Barnstable County Land Management specifically for this property.  Terry Gips moved to have the commission’s endorsement of a plan to transfer the custody and control of the property to the Wellfleet Conservation Commission; seconded by Lauren McKean; passed 4-0.  

Brochure:   The Commission edited the brochure.

Items on the Town Warrant related to the Conservation Commission were passed, with the exception of #5.

Jurisdictional Opinions
275 Kendrick Ave, remove large pine tree and locus tree, as well as oak tree damaged from the recent storm.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Lauren McKean; passed 4-0.
135 Lt. Island, remove several pitch pines infected with pine borer.  Trudy Vermehren moved to allow the removal of the pines; seconded by Campbell Rea; passed 4-0.

100 D St (Lt. Island), remove 3 trees due to pine borer.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Trudy Vermehren; passed 4-0.

Terry Gips provided a draft proposal for small boat identification program/regulation for Wellfleet.  Andrew Petty stated the shell fishermen should have identification on their vessels already.  The commission will review the proposal and come back with recommendations at the November 16, 2011 meeting.

Public Hearings 5:00 pm:

Yankelovitch, 374 King Phillips Rd., Map 35, Parcel 182, Extend rock revetment (Cont’d from 10/19/11).~ At the request of the applicant, Terry Gips moved to continue to November 16, 2011; seconded by Campbell Rea; passed 4-0.

Michelson, 21 Samoset Ave, Map 28, Parcel 184, Certificate of Compliance.  The project is in compliance, and the applicant requested a continuing condition.  Trudy Vermehren moved to approve the Certificate of Compliance with the ongoing condition to manage vegetation and remove invasives; seconded by Terry Gips; passed 4-0.

O’Connor, 90 LeCount Hollow Rd., Map 30, Parcel 9, NOI, Remove existing garage and barn and replace with wood frame structure (Cont’d from 10/19/11).  At the applicant’s request, Terry Gips moved to continue to November 16, 2011; seconded by Campbell Rea; passed 4-0.  

Coates, 10 First Ave, Map 30, Parcel 120, NOI, Removal of existing brick patio and masonry retaining wall and stairs, construct deck, porch, stairs pervious block patio and timber retaining wall (Cont’d from 10/19/11).  At the applicant’s request; Trudy Vermehren moved to continue to 11/16/11; seconded by Campbell Rea; passed 4-0.  

Zimmerman, 715 Cheq. Neck Rd., Map 19, Parcel 113, RDA, grade driveway, install stone or crushed shells, allow annual repair/replacement.  Agent Greenberg-Lemos discussed the project on the applicant’s behalf, stating the stone or crushed shells will be up to 3 inches in depth.  Campbell Rea identified the project as a Negative 3; seconded by Terry Gips; passed 4-0.

Beach Mountain LLC, 464 Route 6, Map 42, Parcel 22, RDA, excavate and pour 4 concrete supports for deck renovation.  Steve Rose gave an overview of the project and stated this will be additional support for the deck which will have a roof.  The commission recommended gutters and dry well be installed for rainwater.  Campbell Rea identified the RDA as a Negative 3; seconded by Terry Gips; passed 4-0.

Crockett, c/o Hay, 91 Commercial St., Map 21, Parcel 129, NOI:  Install vinyl sheet pile bulkhead at 91 and 95 Commercial St.  Tim Brady represented the applicant and stated it is one project on two separate but adjacent parcels.  He stated the previously approved septic system will be installed shortly and they want to install the bulkhead at approximately the same time.  Brady stated they will not remove the existing bulkhead, but cut it back, bury it, and place the new vinyl sheet pile bulkhead in front of it. There are drainage and erosion issues due to the damaged wood bulkhead and this project will be a major improvement.  He stated the locust trees will be removed during the construction as well as cleaning up the property. Brady stated the cost of disposing the old wall is very expensive and he didn’t feel it would compromise the project by leaving it in place. There was considerable discussion regarding drainage issues including the proposed leaching area, catch basis, potential runoff from vehicles, and the possibility of swale for overflow in heavy rain events. Brady stated the leaching area can accommodate one inch of rain water. Terry Gips recommended removing some of the debris and rubble from the edge of the marsh that can be reached from the top of the bank. Brady will meet with the applicants to discuss a drain garden, increasing the leaching system, widening the trench, moving the guard rail, removing materials at the rear of the lot, and capturing runoff from buildings. Terry Gips moved to continue to 11/16/11; seconded by Trudy Vermehren; passed 4-0.

Duck Creek Creative Ctr., 91 / 95 Commercial St., Map 21, Parcel 128, NOI, remove wood bulkhead at 95 Commercial St. and install vinyl sheet pile bulkhead at 91 and 95 Commercial St. The hearing for Crockett c/o Hay was heard at the same time by Tim Brady. Terry Gips moved to continue to 11/16/11; seconded by Trudy Vermehren; passed 4-0.

Trudy Vermehren moved to close the public hearings at 6:00 pm; seconded by Campbell Rea; passed 4-0. Reopen Business meeting at 6:01

Agent Greenberg-Lemos reported an Emergency Order was signed off for the repair of a sink hole located at the bottom of Pheasant and Bound Brook.

MAIL:

·       Regulatory reform literature.
·       Planning Board sent a preliminary plan for Horton property with a proposal for 8 lots (42/43). The Commission determined this was not in a resource area.

A letter regarding Gull Pond dated October 19, 2011 from P. Sieloff to the Board of Selectmen was read.

Trudy Vermehren moved to adjourn at 6:30 pm; seconded by Lauren McKean; passed 4-0.
