Co-Chair Trudy Vermehren called the meeting to order at 4:05 pm.

Jurisdictional Opinion: Benevento, 47/ 24, trench underground utilities from the road to the barn. There was an NOI approved recently, but the utilities were not a part of the application. The trench will be in the driveway. Terry Gips moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

Eastham’s Board of Selectmen’s meeting regarding boats on town property is available on the web.

Agent Hillary Greenberg-Lemos stated she had a discussion with Town Administrator, Paul Sieloff, regarding showers at the saltwater beaches, and his initial reaction was that they would be too costly. Lauren McKean will check what is at Marconi Beach regarding drainage from an outdoor shower.  Agent Greenberg-Lemos also stated Paul Sieloff doesn’t feel boats on town property are a problem. It was recommended by the Commission to have Agent Greenberg-Lemos invite John Riehl, Marina Advisory Board members, Suzanne Thomas and the Harbormaster to a meeting to discuss the concerns regarding boats on town property.  Further discussion took place regarding assessing the damage done on the beaches and marshes. A discussion also took place regarding the difference between anchoring and mooring boats. Ed Simpson stated there could be an auction on any boats left on town owned land after November 15. Racking canoes/kayaks is not an option at town owned landings due to lack of people monitoring them. The commission discussed Brent Valli’s barge not being moved from its location in over seven years.

Terry Gips stated there is increased erosion at LeCount Hollow Beach.~ Hillary Greenberg stated the town will be requesting an AOOC.

Yankelovitch, 374 King Phillips Rd., Map 35, Parcel 182, Extend rock revetment (Cont’d from 09/07/11). At the applicant’s request for a continuation, Terry Gips moved to continue the hearing to October 5, 2011; seconded by Ed Simpson, passed 5-0.

Harborside Village Coop Corp., 20 Wellfleet St., Map 20, Parcel 19, NOI, Excavation, dewatering and discharge of clean water to allow for installation of treatment tanks associated with upgrade of the wastewater treatment plant (Cont’d from 09/07/11)
David Bennett represented the applicant. He stated one inch of rain on the approximate 50 acrews would be equivalent to 1,350,000 gallons of water. The final plans were submitted to the commission. Bennett met with the contractor to discuss dewatering and they concluded that the only time flooding might occur would be in conjunction with a major storm, in which case the pumping system could be shut down. He stated there would be daily monitoring during the construction phase.~ DEP has not yet approved the revised plans. Maria Hollis stated there are approximately 12 units occupied during the winter months. Bennett stated there will be a generator on site during the construction to be used if necessary. It will take approximately six weeks for dewatering, followed by revegetation, re-grading, etc.  He stated he hoped the entire project would be completed by mid December 2011  Due to the topography, seed will be scattered instead of hydro-seeding. Ginie Page moved to approve the NOI; seconded by Ed Simpson; passed 5-0.~ Supervisor: Agents

Meyer, 300 Paine Hollow Rd., Map 35, Parcel 204, NOI, Septic Upgrade. Hillary Greenberg spoke on behalf of the applicant and gave an overview of the septic upgrade. One revision may be made to remove the alternative technology on the plan. David Lajoie then joined the discussion on behalf of the applicant and stated he will have a new plan available after going before the Board of Health. Ed Simpson moved to approve the NOI; seconded by Ginie Page; passed 6-0.

Cumberland Farms, 2586 Rte 6, Map 23, Parcel 39, AOOC, revisions to the building, parking, sidewalks and utilities plan(s). Reggie Donoghue of Coastal Engineering reviewed the amendment changes. There will be additional storage behind the retail (liquor) store, a portion within the buffer zone. Additional parking has been added outside the buffer zone. The loading zone and dumpsters will be located outside of the buffer zone. The water line extension will be located on the opposite side of Route 6. Donoghue presented and discussed the revised planting plans. Frank Corbin suggested using native trees which are disease resistant instead of some of the trees provided in the planting plan.~ Corbin asked if the driveway along the retaining wall would be retained. Donoghue explained that there is an agreement with the abutter (Bay Sales Marine) for access to the property on the south side on the Cumberland property. A retaining wall with plantings on the abutter’s property has been designed to improve the vehicle entrance from Route 6 to both the driveway for Bay Sales and Cumberland Farms. Terry Gips moved to approve the AOOC; seconded by Ginie Page; passed 6-0.

Trudy Vermehren moved to adjourn at 5:45 pm; seconded by Ed Simpson; passed 5-0.
