Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Chair Terry Gips opened the meeting at 4:05 pm.

Jurisdictional Opinion:

White Crest Beach – erosion due to storm water. Suzanne Thomas stated this parking lot has historically had problems. The weak spot of the dune was washed through two weeks ago and created a larger crevasse which has begun to erode further due to its use as a path to the beach. She proposes placing a sand berm along the side of the parking lot toward the ocean as well as snow fencing on the dune itself until a more permanent solution can be designed. The crevasse is also a safety issue to the public. She stated sand could be brought in to build the berm. There was discussion regarding drainage for the parking lot. Agent Greenberg-Lemos recommended amending the Order of Conditions to add the fencing and advised Suzanne that sand could be added, along with rebuilding the berm. Agent Greenberg-Lemos said that Order of Conditions would have to be amended in order to install the fencing. The Commission voted to authorize Thomas to work~ with DPW to build a sand berm across the edge of the parking lot

Denny O’Connell came on behalf of the Conservation Trust stating that the plan to purchase the Clover property was in place and to request that the Conservation Commission agree to apply to the State for a matching grant. A conservation restriction, to be held by the Commission, will be placed on the Clover lot but not on the adjacent one to the north owned by the Town. There will be a total of approximately 8 acres. The Selectmen voted to support the application. Ginie Page recused herself from the vote.  Ed Simpson moved to approve the matching grant to the State for land acquisition and for the conservation restriction; seconded by Lauren McKean, passed 4-0-1.

Reorganize the Board for 2011/2012:
Ginie Page moved to nominate Trudy Vermehren and Terry Gips as Co-Chairs; seconded by Ed Simpson; passed 5-0.
Trudy Vermehren nominated Ed Simpson as the Clerk; seconded by Ginie Page; passed 5-0.

Community Preservation Committee representative: Terry Gips moved to nominate Trudy Vermehren as the Committee representative; seconded by Lauren McKean; passed 5-0.

Agent Greenberg-Lemos reported she had contacted Rex Peterson and the Cape Cod Commission regarding the storm water bylaw. There has been no response from either party. She recommended contacting Janet Reinhart, Chair of the Planning Board for assistance and Terry agreed to do that.

Greenberg-Lemos reported Nellie Road was repaired.

Greenberg-Lemos reported Jack’s Boat Rental relocated the shed in the parking lot at Gull Pond. Terry Gips gave the chronological order of events of the shed relocation.

Crosen, 270 Ocean View, Map 24, Parcel 56, Certificate of Compliance (Cont’d from 06/15/11). Lauren McKean recused herself. Emily Beebe represented the applicant and stated the work is complete as ordered. Ginie Page moved to issue the Certificate of Compliance; seconded by Ed Simpson; passed 4-0-1.

Blasch, 1440 Chequessett Neck Rd., Map 18, Parcel 8, Certificate of Compliance (Cont’d from 06/15/11). Lauren McKean recused herself. Emily Beebe represented the applicant. The Commission made a site visit and there were a few concerns. Andrew Petty stated a water runoff test was performed on the driveway and it was determined that the design failed to deliver the water to the catch basins. Beebe felt that since the driveway is out of the buffer zone, it should not stop the Certificate of Compliance. Gips stated she still has concern with runoff into the marsh. Beebe stated that there is no storm water drainage system on Chequessett Neck Road, thus storm water accumulates from road runoff. The Commission requested that the engineer, Tim Brady, who had designed the driveway and the runoff equipment, be asked to assess the situation. Ginie Page stated after a rain, there are large puddles across the street from the Blasch property. Gips agreed that the town road as well as the private driveway contribute to the flooding problems. She also stated that the commission was concerned about the degradation to the vegetation along the marsh side of the road due to parking of construction vehicles. Beebe stated Mr. Blasch had spent his own money removing telephone poles, etc. to improve habitat, especially for nesting turtles.. Since then, people have parked on the shoulder creating degradation to the vegetation. Andrew suggested plantings and signage to discourage people parking in that location. Beebe requested a continuation to discuss storm water, revegetation of the dune around the house and under the decks; she said she would invite Tim Brady to the next meeting. Terry Gips moved to continue to 06/20/11; seconded by Trudy Vermehren; passed 4-0-1.

CYCC, 680 Chequessett Neck Road, Map 18, Parcels 81 and 115, NOI, replace culvert (Cont’d from 06/15/11). Lauren McKean recused herself. She stated they would like to remove the existing culvert, replace with the same size culvert, and shore up the pathway because it is fairly dry at this time. She stated the edging for the cart path will have gaps in the curbing to allow water to pass through.  Boone sent a copy of the abutter letter to the National Seashore. The culvert will be cleaned and maintained by general cleaning with a pipe and rake. It is looked at after every storm. The project supervisor will look at the pathway on a regular basis. Ed Simpson moved to approve the NOI to replace the culvert; seconded by Ginie Page; passed 4-0-1.

Brown/Littenberg, 5 Ben’s Way, Map 42, Parcel 64, Amendment: deck addition
Tom Dalmus stated the applicant would like to add an 8’ deck as well as additional planting to the previously approved Order of Conditions. Terry Gips suggested adding the removal of the dead tree to the conditions. Trudy Vermehren moved to approve the Amended Order of Conditions; seconded by Ginie Page; passed 5-0.

Newman, 75 Governor Foss Drive, Map 23, Parcel 132, RDA, septic upgrade. Matt Farrell represented the applicant and gave an overview of the project. There is a failed leach pit so the septic will be upgraded. Farrell explained what a failed leach pit is for the commission. Terry Gips moved to identify this as a Negative 3; seconded by Trudy Vermehren; passed 5-0.
