4:00 - Business Meeting & Conservation Agent's Report
Chair Gips opened the meeting at 4:09 pm.  

Chet Lay and Bob Hayden came before the Commission to discuss the possibility of changing the Order of Conditions on the Doyle property located at Seaview Road .  Lauren McKean recused herself.  They requested that they stockpile the sand from excavation on the property due to costs of hauling it off site.  The Commission was concerned the sand would smother all the vegetation and stated the original Order of Conditions would remain as written.  

Agent Greenberg-Lemos provided a proposed shorebirds management plan.  Town-owned signs would be placed on town land advising of closures due to shorebird nesting.      This rules and signage on town-owned land would be identical to those used by the National Seashore except that the signs would indicate Town of Wellfleet rather than the National Park Service. Agent Greenberg-Lemos stated the town is bound to adhere to NHESP regulations.  The signs would go up after the nests are identified.  Wind and kite surfing would not be allowed within 200 meters of nesting areas.  National Seashore staff will assist in identifying the nests and monitoring the area.   Terry Gips suggested the Commission hold a public hearing.  Ginie Page moved to advertise a public hearing for the April 20, 2011 business meeting for the shorebird management plan; seconded by Trudy Vermehren; passed  4-0-1.  (Lauren McKean recused herself).

Jurisdictional Opinion:  Bill Whitman, 53 Cheq Bluff Rd, one to one replacement of stairs.  Ginie Page moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

Public Hearings 5:00 pm:

Town of Wellfleet, RDA, Old Pier Road, Map 22, Parcels 21, 29, 30, 31:  Grade Road
Mark Vincent of the DPW stated they have received several phone calls regarding the poor condition of the road.   The road has broken up and water from a private road drains onto Old Pier Road resulting in potholes.  He stated processed stone will be used for the regrading to fill in the imperfections.  There will be approximately 25 to 30 yards of stone.  Trudy Vermehren moved to identify this as a Negative 2; seconded by Ginie Page; passed 5-0.

Town of Wellfleet, NOI, Beach Area Restoration:  Newcomb Hollow Beach, Cahoon Hollow Beach, White Crest Beach and McGuire Landing.  Lauren McKean recused herself.  Natural Heritage has not yet responded.  Mark Vincent stated he would like to start work the first week in May because there is a lot of work to be done.  Regarding  LeCount Hollow Beach/McGuire Landing he stated that due to erosion, assessment needs to be made regarding locating the access walkway down to the beach; in addition, they will re-establish the split rail fence,  clean back the edges of wind blown sand in the parking area, and repave the parking lot.  According to Vincent,White Crest typically takes care of itself so they do not anticipate work at this time.  It nwas included in the NOI so that in the event of future storms, maintenance work could be undertaken.  Vincent stated repaving will be done on the back parking lot.  Cahoon Hollow Beach work will include a walkway to the beach,  drainage repairs, and parking area grading.  Vincent reported that Newcomb Hollow Beach doesn’t require too much work this year. The Commission would like to see the split rail fence repaired.  Ginie Page moved to continue to April 20, 2011; seconded by Ed Simpson; passed 5-0.

Yankelovitch, 374 King Phillip Rd., Map 35, Parcel 182, extend revetment (Cont’d form 03/16//11).  Peter Markunas represented the applicant and explained that Natural Heritage would not write a letter until they issue a Construction Management Permit (CMP).  He will be applying for that permit and a Chapter 91 license.  Ginie Page moved to continue to July 20, 2011; seconded by Trudy Vermehren; passed 5-0.

Stossel, 5 Samoset Ave., Map 28, Parcel 186, NOI, Extension of timber bulkhead (Cont’d from 03/16/11).  Ginie Page recused herself.  Attorney Ben Zehnder, Gordon Peabody, and Dave Bennett represented the applicant.  Zehnder stated the title work was complete and the town owns all of Hiawatha Road.  The plan was revised, a meeting was held with the Town regarding repair of the road. The Stossels would be responsible for returning the road to pre-construction condition and for sand renourishment.  Dave Bennett gave an overview of the revised plan, including the use of an angled face revetment, a revised renourishment program, and the joining of the revetment to the rubble pile.  Zehnder stated signs will be placed identifying private versus public property.  PK nails will be placed at elevation 7 which will identify when renourishment is required.    Beach grass will be planted in the sand covering the stones and replanted if erosion should occur.  There will be an easement request at the Town Meeting granting permission to use Hiawatha Road.  Materials for the revetment will be lowered from the Stossel’s property so that no beach access at this time.  At some future point, sand would be placed by a vehicle for renourishment on the beach.   It was recommended renourishment take place during the winter months.  Bennett stated they would like to make repairs on the septic system and then work on the extension of the bulkhead.  Zehnder stated if the proposal received Commission approval, it would lay the groundwork for the easement request.  Zehnder stated he would need to talk to the DPW as well as the Town Administrator regarding the maintenance of Hiawatha Road.  Ed Simpson moved to approve the NOI with conditions; seconded by Trudy Vermehren; passed 4-0-1.  Supervisor:  Trudy Vermehren

Lauren McKean recused herself.  At the request of the applicant, Terry Gips moved to continue to April 20, 2011; seconded by Trudy Vermehren; passed 4-0-1.

Koebel, 195 Herring River Road, Map 8, Parcel 202, NOI, septic upgrade.  Lauren McKean recused herself.  David Lajoie represented the applicant and provided revised plans and gave an overview of the project, stating there is no increase in use of the property.  Several of the trees will be saved due to the new location of the septic tank.  Trudy Vermehren moved to approve the NOI; seconded by Ed Simpson; passed 4-0-1.

Brown, #5 Ben’s Way, Map 42, Parcel 64, NOI, Screen Porch extension.  Tom Dalmas represented the applicant and gave an overview of the project which includes adding an additional stairway from the decking.  Natural Heritage has not responded as yet.  Terry Gips requested additional information regarding the type of equipment to be used, which trees will be cut, and enhancement mitigation plantings.  Lauren McKean moved to continue to April 20, 2010; seconded by Ed Simpson; passed 5-0.
