Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Terry Gips opened the business meeting at 4:05 pm.  

Lydia Vivante of the Recycling Commission stated they have branched out to include a “green group”.  At their last meeting, it was recommended there be no use of plastic bags or other plastic packaging in Wellfleet for distributing products at commercial establishments.   She read a statement from the commission that “all packaging be biodegradable”.  Agent Hillary Greenberg-Lemos stated the Board of Health is not the appropriate enforcer because the type of packaging used is not considered a health issue.  She and Paul Sieloff recommended the resolution go to Town Meeting.  Lydia stated several restaurants have already started using biodegradable products.  She stated that currently the Wellfleet Transfer Station cannot recycle plastic bags but that larger stores, such as Stop and Shop, have bins for recycling them.  Lydia stated paper cups / plates can go to the dump along with other recycled paper.  She requested the Commission make a recommendation for this project which is scheduled for 2012.  Agent Greenberg-Lemos stated the Recycling Commission will be working on additional composting options at the dump which will include food waste, garden waste, and that many paper products can be composted. Chair Gips moved that the Conservation Commission go on record in support of the endeavor to move toward biodegradable/compost-friendly packaging within the Town of Wellfleet and that we strongly urge a parallel composting program be developed for these materials; seconded by  Ed Simpson;
passed 5-0.     

Agent Greenberg-Lemos stated there are plans being developed for a Farmer’s Market behind Preservation Hall on Wednesdays to promote healthy eating and utilize local products.  There was discussion regarding different locations within town.

Glaze, 625 Old Wharf Rd., Map 35, Parcel 14, NOI, Construct sand drift fence (Cont’d from 02/02/11).  At the request of the applicant, Terry Gips moved to continue to 3/2/11; seconded by Ed Simpson; passed 5-0.

Cumberland Farms, 3586 State Hwy, Map 23, Parcel 39, NOI, Redevelopment to construct commercial building to house Cumberland Farms store with fuel service and retail store. (Cont’d from 02/02/11).  Reggie Donaghue from Coastal Engineering represented the applicant as well as John Mark from Cumberland Farms.  The proposal calls for removing pavement within the buffer zone and as a result reducing the amount of paving in the buffer zone.  There are protocols set up for preconstruction, construction, and post-construction.  Donaghue gave an overview of the entire project, including water, septic, grading, storm water and recharge areas, as well as revegetation.  He stated buildings behind the current Cumberland Farms store will be removed and the area will become a field.  The Commission recommended a 3 to 5 year maintenance plan to remove invasive plants.  There was discussion regarding the gas tanks, monitoring, and state mandated regulations.  Donaghue gave an overview of the recharge basins, oil separation pipes, and the levels of protection to be put in place.  The curbing along the wetland would be pitched away from the wetlands.  Donaghue discussed the demolition protocols; they don’t anticipate any issues with Route 6.  Work is anticipated to start in the fall of 2011.  In the event of an oil / gas spill, there are shut off valves and the piping and tanks would be capable of holding up to approximately 1,000 gallons.  There would be training for employees to have knowledge of shutting down the site, notifying the appropriate agencies, etc.  Agent Greenberg-Lemos stated there was a small spill from a vehicle at this location and Cumberland Farms promptly cleaned up the area.  Trudy Vermehren moved to approve the NOI; seconded by John DiBlasio; passed 5-0.  Supervisor:  Trudy Vermehren

Wigwam LLC, 95 Wigwam, Certificate of Compliance.  Agent Greenberg-Lemos stated this project is complete.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 5-0.

Kane, 155 Pine Point Rd., Map 21, Parcel 56, NOI, stabilization of coastal bank and installation of gabions.  David Little of Ryder Wilcox and one of the owners of the property came to the table and gave an overview of the project.  He stated the area is traversed heavily by people and vehicles, and vegetation and trees are slipping over the bank.   Nine rows of gabions are proposed, three of which would be buried and the others visible.  Little gave an overview of the structure of the gabions and presented photographs of their use at other properties.  Little read the construction notes.  He stated two trees would have to be removed with minor disturbance to other vegetation.  There was discussion regarding nourishment and the possibility that the gabions would provide a location for natural plants.  A neighbor stated he would be concerned that Duck Creek properties will all start using gabions.  Ed Simpson moved to approve the NOI; seconded by Trudy Vermehren; passed 5-0.  Supervisor:  Ginie Page

Doyle, 330 Seaview Rd., Map 24, Parcel 22, NOI, move house from marine scarp.  Chet Lay represented the applicant and reviewed the National Parks concerns and Lay stated the applicant agrees to all their requests.  The house will be moved by hydraulic lift.  The well will be relocated.  There was discussion regarding the stockpile location and its closeness to the edge of the dune.  The Commission stated that there would be a condition of stockpiling off the property.  John DiBlasio moved to approve the NOI; seconded by Trudy Vermehren; passed 5-0.  Supervisor:  Ed Simpson

Kandel, Bayview Ave., Map 35, Parcel 37, RDA, deck work.  Jay Horowitz represented the applicant and gave an overview of the project, which includes cantilevering an additional + / - three feet of decking.  There are two levels of decking.  Agent Greenberg-Lemos asked him to provide a plan identifying the ACEC and buffer zone.  John DiBlasio moved to identify this as a Negative 3; seconded by Trudy Vermehren; passed 5-0.
