4:00 - Business Meeting & Conservation Agent's Report
Terry Gips opened the meeting at 4:18 pm.
There was clarification on the work to be done regarding the nourishment for Yankelovitch.

John DiBlasio moved to approve the 01/05/11 meeting minutes as amended; seconded by Patrick Winslow; passed 4-0.

Terry Gips was asked by John Riehl to pass on that the Harbor Conference Committee requires additional participation from other Boards.  They meet approximately once per month.  There were suggestions made for topics to be covered at the conference.  

David Agger came before the Commissioners to discuss the Boathouse and neighboring erosion issues and nourishment on Lt. Island.  He stated he has owned the property since 1998.  He wanted information on the permitting for the Mortenson property, and Agent Greenberg-Lemos stated there was no condition for nourishment in perpetuity; therefore, the Commission has no standing legally to ask for further nourishment.  A Certificate of Compliance was issued.  A structure was built in the area and letters were sent from the Conservation Office to come before the Commission; but no action was taken because the Mortenson’s stated they did not want to be obligated to further nourishment.  Agent Greenberg-Lemos explained that no action would be taken by the commission.

US Gov/National Seashore, pine tree leaning over residence owned by Seashore building.  Patrick Winslow moved to approve the Jurisdictional Opinion; seconded by John DiBlasio; passed 4-0.  (Lauren McKean recused herself).

Public Hearings 5:00 pm:

Yankelovitch, 374 King Phillip Rd., Map 35, Parcel 182, extend revetment (Cont’d form 01/06/11).  At the request of the applicant, Terry Gips moved to continue to February 16, 2011; seconded by Patrick Winslow; passed 5-0.

Shea/White, 9 Crest Ave., Map 35, Parcel 93.1, NOI, construct at grade, erosion steps, brush
removal and vista pruning.  Mark Burgess represented the applicant and stated the project will be in three phases which include a path,  replanting, brush removal, and vista pruning, which will be ongoing.  There was discussion regarding the path and the fragility of the bank and several commissioners stated they had never seen anyone walking up and down the path.  Burgess stated there was some discussion with the applicant to build stairs at the bottom of the bank to reach the beach.    The Commissioners discussed alternate plans and requested another site visit for February 16, 2011 at 11:30 am prior to requesting revised plans.  John DiBlasio moved to continue the hearing to March 2, 2011; seconded by Patrick Winslow; passed 5-0.        

Reeves, 2616 State Hwy, Map 23 Parcel 40, NOI, replace building and add crawl space foundation
(Cont’d from 01/05/11).  The applicant requested a continuation to February 16, 2011.  Terry Gips moved to continue to February 16, 2011; seconded by Patrick Winslow; passed 5-0.

Glaze, 625 Old Warf Rd., Map 35, Parcel 14, NOI, Construct sand drift fence (Cont’d from 01/05/11).  The applicant requested a continuation to February 16, 2011.  Terry Gips moved to continue to February 16, 2011; seconded by Ed Simpson; passed 5-0.

Sterling, 45 Omaha Rd., Map 28, Parcel 190, NOI, new driveway, new porch and management of vegetation (Cont’d from 01/05/10).  Emily Beebe represented the applicant and stated this is a local filing.  Revised plans as well as a vegetation management plan were presented.  No work involving the use of heavy machinery will be done from June 1 to October 15.  Beebe gave an overview of the vegetation management plan.  No trees or vegetation are to be removed from abutting properties.  Beebe will perform the monitoring on a seasonal basis and there will be 100% survival rate on revegetation.  Patrick Winslow moved to approve the NOI with conditions; seconded by Ed Simpson; passed 4-1.  Supervisor:  Patrick Winslow    

Arend, c/o Corbelis, 50 Designers Rd., Map 23, Parcel 8, Certificate of Compliance.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Patrick Winslow; passed 5-0.

Harborside Coop, Map 20, Parcel 19, Certificate of Compliance.  Loren Schofield represented the applicant and gave an overview of the project.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 5-0 with the condition in perpetuity there will be no hazardous material storage.  

Keegan, 933 Chequesset Neck Rd., Map 19, Parcel 99, NOI, addition to dwelling, construct retaining
wall and stairway.  Lauren McKean recused herself.  Reggie Donoghue from Coastal Engineering represented the applicant and gave an overview of the project.  He stated there would be a 24 cubic yard nourishment condition as well as an annual survey.  Ed Simpson moved to approve the NOI; seconded by Patrick Winslow; passed 4-0-1.     
                               
Currier / Anstine, 1045 Chequessett Neck Rd., Map 19, Parcel 93, NOI, construct windspire.  Lauren McKean recused herself.  Ed Simpson stated Elizabeth Currier purchased a restaurant from him several years ago.  Mark Robinson represented the applicant and gave an overview of the installation of the windspires: digging of the foundation would be done by vacuuming the soil (to avoid use of heavy equipment); an 18’ trench would be dug by hand; there would be standard protocol for concrete overpour.   Agent Greenberg-Lemos read a letter from the National Seashore requesting ongoing monitoring for incidents of birds and bats colliding with the spire.  Patrick Winslow moved to approve the NOI; seconded by John DiBlasio; passed 4-0-1.  Supervisor:  Ed Simpson

Currier / Anstine, 1015 Chequessett Neck Rd., Map 19, Parcel 92, NOI, construct windspire.  Lauren McKean recused herself.  Mark Robinson represented the applicant and gave an overview of the installation of the windspires.  The National Seashore requested monitoring for birds and bats.  Ed Simpson moved to approve the NOI; seconded by Patrick Winslow; passed 4-0-1.  Supervisor:  Ed Simpson

Eurich  1065 Chequessett Neck Rd., Map 19, Parcel 91, NOI, construct windspire.  Lauren McKean recused herself.  Mark Robinson represented the applicant and gave an overview of the installation of the windspires.  Since the property is not accessible by any large vehicles, all work will be done by hand.  There was discussion regarding the location of the windspire and the storage unit under construction.  Robinson stated work could only be done up to April and not again until October due to the terrapin turtle nesting period; he would like to get the concrete footing installed as soon as possible.  Patrick Winslow moved to approve the NOI; seconded by John DiBlasio; passed 4-0-1.  Supervisor:  Ed Simpson

Cumberland Farms, 3586 State Hwy, Map 23, Parcel 39, NOI, Redevelopment to construct commercial
building to house Cumberland Farms store with fuel service and retail store.  At the request of the applicant, John DiBlasio moved to continue to February 16, 2011; seconded by Ed Simpson, passed 5-0..

Zimmerman, 715 Chequessett Neck Rd., Map 19, Parcel 113, Request for 3 year extension.  Reggie Donoghue represented the applicant and gave an overview of the project.  Patrick Winslow moved to approve the 3 year extension; seconded by Ed Simpson; passed 5-0.

John DiBlasio moved to adjourn at 7:05 pm; seconded by Ed Simpson; passed 5-0.
