Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Chair Gips called the meeting to order at  4:05 pm

John DiBlasio moved to approve the November 17, 2010 meeting minutes as amended; seconded by Trudy Vermehren; passed 6-0. (ck attendance).

Patrick Winslow moved to approve the December 1, 2010 meeting minutes as amended; seconded by John DiBlasio; passed 6-0.

5 Samoset / Hiawatha Rd:  Agent Greenberg-Lemos reported the Board of Selectmen were concerned with public access if the owner of 5 Samoset extended the timber bulkhead.  A new plan was provided by Bennett Engineering.  Ginie Page stated that shell fishermen are concerned because Hiawatha had been a historical town access at this location and want to be assured they will be able to get a boat through to the water.  A rubble pile was placed in the area about 30 years ago to prevent erosion so vehicles have not been able to use this for launching for 3 decades. They have been using addressStreetOmaha Road, but that road is a private road and its continued use into the future is not guaranteed.   Agent Greenberg stated that if the shell fishermen want access, they should get in touch with the Commission, the Board of Selectman, and DPW to possibly place sand over the rubble.  Granite stairs will be provided for the public access.  The Board of Selectmen asked the Commission to study Sewell’s Gutter.  Agent Greenberg-Lemos recommended the Commission use Epsilon and Associates to review the area.  Ginie Page moved to request Epsilon do a study of Sewell’s Gutter; seconded by Patrick Winslow; passed 6-0.  Agent Greenberg-Lemos stated the covering the rubble pile is not part of the emergency order.  Trudy Vermehren moved to approve the Emergency Certification form and the revised Bennett Engineering plan dated 12/07/10; seconded by John DiBlasio; passed 6-0.  Agent Greenberg-Lemos stated she would send a letter to the shell fishermen regarding access at Hiawatha and Omaha Road.  The Commission will receive a NOI for 5 Samoset and it will be on the agenda in February 2011.  
Lowenberg:  41 Crest Ave. Map 35, Parcel 87.2.   Chet Lay represented the applicant and stated Frank Corbin will be doing the landscaping and will provide a maintenance plan.  He requested the Commission set up an escrow account for $7,000  to cover the landscape work and maintenance work over the next 3 years.  Since the property is for sale and due to close in the next few days, a Certificate of Compliance is required to clear the deed.  The Commission was in favor of having money in escrow for revegetation of the property and an on-going order for a maintenance plan.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Patrick Winslow; passed 6-0.   
        
Public Hearings 5:03 pm:

Review proposed revisions to the Wellfleet Environmental Protection Regulations that include Regulations for areas subject to flooding and the Wellfleet Harbor ACEC.

The Commission reviewed the revisions and minor changes were noted.    

John Riehl read a letter from NRAB who supported the suggested regulation changes.  Two members of the NRAB attended the meeting and made brief supportive comments.

Patrick Winslow moved to approve the changes to the Wellfleet Environmental Protection Regulations  and to make them effective as of March 15, 2011; seconded by John DiBlasio; passed 6-0.

Patrick Winslow moved to adjourn at 5:30 pm; seconded by Trudy Vermehren; passed 6-0.
