Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Chair Gips called the meeting to order at 4:09 pm.

Stossel, 5 Samoset, Andrew Petty stated there was no environmental danger with the septic system although the erosion had exposed part of the buried system.  The sand approved at the previous meeting had been dumped in the eroded area.  Due to changed wind and wave conditions, the main channel had moved south toward the center of the gutter.  

Discussion took place regarding the proposed Wellfleet Harbor ACEC regulations, including various elevation triggers, the flood zones, and specific areas the Commission can regulate.  The Commission members noted that we will have help the public understand the new performance standards for the ACEC which are slightly different from the standards for other areas regulated by the Town’s Environmental ByLaw.  The Commission reviewed maps identifying the ACEC and flood plain zones.  There was discussion regarding water quality in the ponds and what actions the Commission can take to improve conditions.  It was noted that it is important for the public to know that the regulations will protect the resources as well as their properties.  

Jurisdictional Opinion:

95 Wigwam, install AC condenser under porch within the filter strip.  Ginie Page moved to approve the Jurisdictional Opinion; seconded by John DiBlasio; passed 5-0.

Mail was reviewed.  

Andrew Petty discussed the 5 Samoset property again.  The Conservation Commission approved an emergency order to resolve the problem with the erosion.  They also approved the bulkhead construction on town property.  He reported the Town is in negotiations with the property owner and the owner may extend the length of the bulkhead, or remove the concrete rubble and replace with boulders.  The Commission stated the owner would have to file a new NOI.  Town Administrator, Paul Sieloff, reported the owner will get back to the Town, and there are two options for the town property, such as removable stairs or rocks that would be placed like steps.  Paul Sieloff stated the DPW would work on the town property, removing the debris and backfilling.    

Public Hearings 5:00 pm:

Alliance Energy, 2683 Rte 6, Map 15, Parcels 126, 127, 129, 130, RDA, new piping, new manholes, re-install existing tank gauge, reinforce concrete mats, reinstall existing dispensers on new dispenser sumps, install new safety bollards.  Anthony Guba represented the applicant and stated they purchased the property (the Mobile Station near the corner of Main Street) and wanted to upgrade all the referenced items listed on the RDA.  Andrew Petty requested a site plan to identify the adjacent resources including the 50’ and 100’ buffer zones.  He also requested that the areas of proposed work within the property be specifically delineated. If the work is within the 100’ zone it would definitely require an NOI.  Guba gave a description of the work to be performed and stated he will prepare a new plan for the next meeting.. Ginie Page moved to continue to January 5, 2011; seconded by Trudy Vermehren; passed 5-0.

Eurich, 1065 Chequessett Neck Road, Map 19, Parcel 91, Request for three year extension on AOOC.  Don Eurich gave the reason for the request. The three year extension would provide sufficient time to monitor the landscape plantings as well as those on the roof to confirm their viability.  Trudy Vermehren moved to approve a three year extension; seconded by Patrick Winslow; passed 5-0.

Ziering, 165 Pilgrim Spring Rd., Map 29, Parcel 282.1, NOI, additions to dwelling and selected tree cuttings.  Ginie Page recused herself.  Chet Lay of Slade Associates represented the applicant and gave an overview of the project.  He stated they would eliminate the outdoor shower in this request.  The project underway will require a septic system upgrade and the Commission requested that plans for the new system be incorporated into the NOI.   The Commission had not heard from Natural Heritage.  Chet Lay will provide a new plan.  Ginie Page read a letter from the Conservation Trust.  Patrick Winslow moved to continue to January 5, 2011; seconded by Trudy Vermehren; passed 4-0-1.

Loewenberg, 41 Crest Ave., Map 35, Parcel 87.2, RDA, Request for 3 year vista pruning.  Applicant withdrew without prejudice.  

Lockwood, 110 Sandpiper Hill Rd., Map 22, Parcel 8.1, NOI, renovation and addition to dwelling.  Patrick Winslow recused himself.  Emily Beebe, Ben Zehnder and David Lockwood gave an overview of the project.  The applicant presented a new proposal that retained the existing structure with small modifications and an addition on the north side.  Trudy Vermehren moved to approve the NOI; seconded by John DiBlasio; passed 4-0-1.  

Tate, 60K Designers Rd., Map 23, Parcel 7, RDA, replace leaching area for septic upgrade.  Emily Beebe represented the applicant and gave an overview of the project.  John DiBlasio identified the RDA as a Negative 3; seconded by Ginie Page; passed 5-0.  

Sterling, 45 Omaha Rd., Map 28, Parcel 190, NOI, new driveway, new porch and management of vegetation.  Ginie Page recused herself as a member of the Conservation Trust which has abutting property.  Emily Beebe represented the applicant and gave an overview of the project.  The Commission requested a project description, construction protocol, and detailed cutting and revegetation plan.  The request to trim Russian olive trees on the abutter’s property will be deleted from the project.  Terry Gips moved to continue to January 5, 2011; seconded by Trudy Vermehren; passed 4-0-1.

Yankelovitch, 374 King Phillip Rd., Map 35, Parcel 182, extend revetment (Cont’d form 11/3/10).  Andrew Petty announced Les Smith of Epsilon Consulting will be working on the Yankelovich application.  He will review the plan, make a site visit, attend a meeting, and review the project. At the request of the applicant, Trudy Vermehren moved to continue to January 5, 2011; seconded by Patrick Winslow; passed 5-0.

Glaze, 625 Old Warf Rd., Map 35, Parcel 14, NOI, Construct sand drift fence (Cont’d from 11/17/10).  The applicant is still waiting for the Conservation Permit from NHESP.  At the request of the applicant, Ginie Page moved to continue to January 5, 2011; seconded by John DiBlasio; passed 5-0.

Ruggles, 30 Kendrick Ave., Map 20, Parcel 1B, NOI, foundation repairs, exterior building renovation, add drywells and outdoor shower (Cont’d from 11/17/10).  At the request of the applicant, Patrick Winslow moved to continue to January 5, 2011; seconded by John DiBlasio; passed 5-0.

John DiBlasio moved to adjourn the meeting at 6:55 pm; seconded by Patrick Winslow, passed 5-0.
