4:00 - Business Meeting & Conservation Agent's Report
Terry Gips opened the meeting at 4:05 pm.

Hillary Greenberg reported she heard from Mary Giorgio regarding the two year extension, which includes local regulations; therefore, all Orders of Conditions from August 2008 to August 2010 will be automatically extended to 2012.  
  
There will be a “Drug Take-Back” day on Sept. 25, 2010 where residents can bring in outdated medications.

The weekend of Sept. 25 will be beach clean up day.  In Provincetown, Coastal Studies will shuttle volunteers out to Long Point Beach by boat.  

On Sept. 22, 2010 from 2:00 – 4:00 pm volunteers will prune the right-of- way on town-owned land off Duck Pond Road under the power lines.  Volunteers are to bring their own tools.

MACC Fall Workshop information

Agent Greenberg-Lemos stated she applied to SPAT for a grant for the design and printing of the brochure.  She has not received a response as yet.   

The Natural Resource Advisory Board report was distributed.  Agent Greenberg-Lemos requested members of the commission review the report and make any recommendations to her, which will be forwarded to the NRAB for consideration.  She stated the residents in Eastham have formed associations to monitor the ponds.  

Terry Gips recommended the commissioners review the ACEC regulations which are scheduled for discussion at the October 6, 2010 business meeting.

Connelly, 110 Springbrook Lane, Map 47, Parcel 30, Certificate of Compliance.   Andrew Petty stated a new file was submitted and this was never completed.  Ginie Page moved to approve the Certificate of Compliance to close out the Order of Conditions; seconded by Ed Simpson; passed 5-0.

McNamara, 80 Designers Rd., Map 23, Parcel 68, Request for 3 year extension.  Jason Ellis reported to Andrew Petty that no work has been started as yet.  John DiBlasio moved to approve the 3 year extension; seconded by Ed Simpson; passed 5-0.

Glaze, 625 Old Wharf Rd., Map 35, Parcel 14, NOI, Construct sand drift fence.  A continuation was requested by the applicant for October 6, 2010.  Trudy Vermehren moved to continue to October 6, 2010; seconded by John DiBlasio; passed 5-0.

Yankelovich, 374 King Phillip Rd., Map 35, Parcel 182, NOI, extend rock revetment.  There was no representative at the meeting.  Agent Greenberg-Lemos stated Natural Heritage sent paperwork to Coastal Review Management due to the concerns they had.  Stan Humphries, representing an abutter, stated he will attend the next meeting after hearing from Natural Heritage and Coastal Review Management.  Terry Gips moved to continue to October 6, 2010; seconded by Trudy Vermehren; passed 5-0.

Gilroy, 83 Samoset, Map 28, Parcel 113, NOI, addition to dwelling and beach improvement.  Don Monroe from Coastal Engineering represented the applicant and gave an overview of the project.  The existing concrete wall at the beach has failure spots along the foundation and there is an issue with erosion that took place behind the concrete wall.  The beach has dropped a number of feet over the last several years.  They want to raise the height of the wall to match the abutters’ wall.  DEP made a recommendation to construct a larger structure instead of replacing the current wall.  Monroe stated the demolished concrete will be removed by a bucket-loader.  Monitoring of the sand will take place and renourished when necessary. The addition to the dwelling is approximately 1.3%, connecting the garage to the house on a concrete slab.   Agent Greenberg-Lemos requested future beach renourishment calculations.  Ginie Page moved to continue to October 6, 2010; seconded by Trudy Vermehren; passed 5-0.

Wyer, 210 Lt. Island Rd., Map 41, Parcel 42, RDA, Septic Upgrade.  Emily Beebe represented the applicant and gave an overview of the project, stating there is a failed leaching pit.  She described the location of all the elements, what trees would be removed, and the stabilization of the resource area.  John DiBlasio identified the project as a Negative 3; seconded by Ginie Page; passed 5-0.

Brimm, 160 3rd St., Map 40, Parcel 102, RDA, replace deck.  Mike Bagley represented the applicant, and gave an overview of the project.  A Jurisdictional Opinion was granted in April 2010 to fix the decking for the summer months, and the applicant now wishes to have a larger deck.  The existing deck is ten feet wide and they are requesting an additional cantilevered four feet.  The Commission feels the addition would significantly disturb the vegetation.  Bagley stated the Brimm’s also wanted to move the stairs to the west side, but he will now have to talk to the applicant.  The Commission requested a new plan and a demolition plan.  Mike Bagley requested to withdraw the application without prejudice.  Ginie Page moved to accept the withdrawal without prejudice; seconded by Ed Simpson; passed 5-0.

Browns Landing Condo Trust, 30 Fox Island Rd., Map 28, Parcel 223, RDA, Repair road surface (Cont’d from 09/01/10).  Ginie Page recused herself.  Colin Fleming stated he wanted to make sure he knew exactly what the commission needed from him.  He stated the contractor recommended using recycled concrete.   The asphalt will be removed along a 10 to 12 foot wide portion of the road, and there will be a gentle grade to insure that water does not drain toward the marsh.  Chet Lay will be staking the road.  Olga Kahn of 30 Marsh View, stated she would like to participate in repairing the section of the  road adjacent to her property.  She was advised she would need to file a RDA to cover her property.   There is an agreement between the Fleming’s and the Conservation Trust.  John DiBlasio moved to continue to October 6, 2010; seconded by Trudy Vermehren; passed 5-0.   

John DiBlasio moved to adjourn at 6:20 pm; seconded by Ginie Page; passed 5-0.
