Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Terry Gips opened the meeting at 4:06 pm.

Jurisdictional Opinions:
Town of Wellfleet, Powers Landing, Parcel 157, trim vegetation off old pavement and remove sand from parking lot.  Ed Simpson moved to approve the trimming on the north and west side of the property; seconded by John DiBlasio; passed 5-0.

10 Hiawatha Rd., remove dead trees (work to be done by Dennis Townsend).  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

Andrew Petty informed the Commission there is some erosion at the end of Hiawatha Road where slabs of concrete are exposed.  He recommends keeping an eye on the site to see if sand will return on its own during the winter.  

The Commission discussed the letter from Town Counsel regarding two-year extensions for Orders of Conditions.  Andrew Petty stated we would contact Town Counsel for advice regarding such extensions.  MACC has not notified the Conservation Agent of any changes in procedures regarding extensions.  There was a question about possible future changes in regulations and if existing Orders of Conditions would be grandfathered for projects not started or would the project come under the new regulations.    

Terry Gips contacted MACC to do a workshop on green design solutions in mitigation.  MACC stated they are looking for ideas for workshops, and Terry stated she would draft some questions for them.  The commission would like to see some workshops done locally.    

John DiBlasio had a conversation with Laura Kelly, who promotes green organic gardening.  She told him of a town in placeWestern Mass. that was not allowed to use pesticides.  The Commission didn’t feel the town could control the use of pesticides, other than request people to voluntarily not use them.  

Terry requested the Commission be prepared to review at the next meeting the draft document, “What You Need to Know About Wetlands Protection in Wellfleet,” which was prepared by Hillary last spring. The Commission reviewed this previously but wanted to make additional suggestions before it is mailed to the Wellfleet Community. Andrew will e-mail copy to everyone.
 
Meeting Minutes:
Ed Simpson moved to approve the June 2, 2010 meeting minutes as amended; seconded by Ginie Page; passed 3-0.
Trudy Vermehren moved to approve the July 7, 2010 meeting minutes as amended; seconded by John DiBlasio; passed 5-0.
Ginie Page moved to approve the July 21, 2010 meeting minutes as amended; seconded by John DiBlasio; passed 5-0.

Patrick Winslow advised Agent Greenberg he didn’t feel he could be co-chair for the Commission.  Terry stated that Hillary suggested Ginie Page be acting Chair if Chair Terry Gips was absent.
 
Public Hearings 5:00 pm:

Schiffrin, 174 Samoset Ave., Map 28, Parcel 89, Certificate of Compliance.  Mr. Curley, contractor, stated the project is in compliance.  Petty stated there is an extra driveway and a shed, which was not on the original plan.  The bluestone patio at the rear of the buildings was not built.  The commission proposed that the extra driveway be allowed but that the patio not be constructed in the future.  There is also a shed on blocks on the property.  The Commission requested an as-built plan before the vote on COC is voted upon.  Ginie Page moved to continue to 9/1/10; seconded by  Trudy Vermehren; passed 5-0.

Ziering, 115 Way #89, Map 29, Parcel 285, Amendment to Order of Conditions.  PersonNamePeter McMahon represented the applicant and explained the changes to the design.  He stated there would be a re-configuration of the decks, and one retaining wall instead of three.  The existing building will be demolished and reconstructed based on an engineer’s statement that the building is unsound.  Petty requested a demolition protocol, staking the proposed foundation, and any marking of trees to be cut. Due to the increased use of heavy trucks and machinery, the Commission requested special attention to the road from Route 6 to the property.  Conditions will require road to be returned to state before project work. Pre- and post-construction photos are to be provided of the road.  The commission will do a site visit at 10:00 am on 9/1/10.  John DiBlasio moved to continue to 9/1/10; seconded by Ginie Page; passed 5-0.

Brown’s Landing Condo Trust, 30 Fox Island Rd., Map 28, Parcel 223, RDA  Repair road surface (Cont’d from 08/04/10).  The applicant did not attend the meeting.  Terry Gips moved to continue to 9/1/10; seconded by Ed Simpson; passed 5-0.

O’Neil, 200 Briar Lane, Map 13, Parcel 114, NOI, demolition and reconstruction of garage, build chicken coop and extend driveway (Cont’d from 08/04/10).  At the request of the applicant, Terry Gips moved to continue to 9/1/10; seconded by Ed Simpson; passed 5-0.

Eurich, 1065 Chequessett Neck Rd., Map 19, Parcel 91, AOOC (Cont’d from 08/04/10).  Don Eurich distributed a handout identifying the area of permanent disturbance.  The turn-around has been compressed in size, the deck reduced in size, and the underground storage reduced by five feet.  The area being restored in the marsh will be 365 feet, and the footpath that goes to the neighbor’s property will be re-vegetated.  A green roof is included in the proposal as part of the storm water plan.   A water retention system is incorporated into the green roof which will reduce water runoff. The excess runoff will go into the rainwater harvesting system.  Eurich stated a second well, if needed, could be installed in the pathway so as not to disturb any further resource.  Reggie Donaghue of Coastal Engineering stated there will be pervious material in the pathway to maintain minimal run off.  The retaining wall is stepped and has vegetation incorporated into it so runoff should not be a problem.  Seth Wilkinson gave an overview of the irrigation system to get the plantings established and identified areas that will not be planted to allow terrapin nesting at the request of Natural Heritage.  Natural Heritage also requested no bearberry be planted because it can gradually cover all open areas, making it difficult for the terrapins.  Donaghue gave an overview of a sacrificial form which would remain in place against concrete walls of the underground storage unit.  Work can only take place from October 15 to April 15.  Wilkinson expects a 90% survival rate for the plantings.  Wilkinson explained the anticipated use of sedum plantings on the roof along with the irrigation.  Ed Simpson moved to approve the Amended Order of Conditions with additional conditions; seconded Trudy Vermehren; passed 5-0.          

John DiBlasio moved to adjourn at 6:40 pm; seconded by Terry Gips; passed 5-0.
