Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Terry Gips opened the meeting at 4:05 pm.

Griswold Draz of the Planning Board made a presentation to the Commission regarding proposed changes to the Zoning Bylaws, identifying calculations of lot sizes and proposed dwelling sizes.  Draz provided  handouts.

Sarah Turano-Flores gave an update of material placed on Meadow Avenue West as well as the placement of shells on Thaler’s driveway.  She stated a filing will be done for any future work on the road.  Paperwork:  letter from Ms. Turano-Flores.

Jurisdictional Opinions:

Thaler, 250 Meadow Ave, Jurisdictional Opinion:  (after the fact), shells on driveway.  Agent Greenberg requested Thaler contact her office when work will be performed in the future.  John DiBlasio moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 6-0.  Paperwork:  Jurisdictional Opinion request form.
  
Dobbins, Lt. Island, prune four pine trees to allow a view easement for the abutters behind their dwelling.  There was discussion regarding removing the trees and replanting other trees or vegetation.  The Commission wants to make a site visit.  Trudy Vermehren moved to request more information from the applicant and make a site visit; seconded by John DiBlasio; passed 6-0.  Paperwork:  Jurisdictional Opinion request form.

Michelson, 21 Samoset Ave., requested an additional extension to their deck and an area for a BBQ.  There was discussion regarding the amount of work being requested on the property.    It was recommended a new plan be submitted identifying the disturbance to the property and what is proposed.  Ginie Page moved to have the applicant submit detailed plans; seconded by Trudy Vermehren; passed 6-0.  Paperwork:  Jurisdictional Opinion request form.

Minutes:
Trudy Vermehren moved to approve the 05/05/10 meeting minutes as amended; seconded by John DiBlasio; passed 6-0.

Ginie Page moved to approve the 05/19/10 meeting minutes as amended; seconded by John DiBlasio; passed 5-0.

Agent Hillary Greenberg-Lemos distributed reports on the Mayo Creek Salt Marsh Restoration project  and the sediments transfer Report that Woods Hole Group produced for the Commission.  She asked that the Commissioners review these reports.

Public Hearings 5:00 pm:

Eurich, 1065 Chequessett Neck Rd., Map 19, Parcel 91, AOOC.  Reggie Donoghue gave an overview of the proposed dwelling and the proposed disturbance to the property.  Changes include retaining walls, storage areas, and planting plan.  Seth Wilkinson reported Natural Heritage stated they had no problems with the revised plans, although they recommended that there be no fencing which would hinder the terrapin turtles’ nesting areas.  The Commission requested a listing of the plants in Latin and common names.  Mr. Eurich gave an overview of the design of the proposed dwelling.  There was discussion regarding potential high tide water near the deck and it was pointed out that this portion of the dwelling is on the original previously approved footprint.  Discussion also took place regarding the turn-around area, the proposed roofing, the foundation, the rain water collection system, and the disturbance to the bank.  The Commission requested the following information:  how much soil will be removed from the bank; green roof planting plan; plans for the permeable path to the propane storage; rainwater system; and if the turn-around area could be reduced in size.  John DeBlasio moved to continue to August 4, 2010; seconded by Ed Simpson, passed 6-0.  Paperwork:  Request for Amended Order of Condition; site plans.               

Brown’s Landing Condo Trust, 30 Fox Island Rd., Map 238, Parcel 223, RDA  Repair road surface (Cont’d from 07/07/10).  Hillary Greenberg-Lemos stated the applicant requested a continuation.  Ed Simpson moved to continue the hearing to 08/04/10; seconded by Trudy Vermehren; passed 6-0.

Rheault, 735 & 745 Chequessett Neck Rd., Map 19, Parcel 112, Certificate of Compliance.  Don Monroe of Coastal Engineering gave a description of the work performed on the revetment and requested annual renourishment as an ongoing condition with the Certificate of Compliance.  Ginie Page moved to grant a Certificate of Compliance; seconded by John DiBlasio; passed 6-0.  Paperwork:  Letter from Coastal Engineering requesting Certificate of Compliance.  

Connelly, 110 Springbrook Rd., Map 47, Parcel 30, NOI , Construct single family dwelling, driveway, septic and well (Cont’d from 07/07/10).  Jason Ellis represented the applicant and provided new plans as requested.  The house was located out of the 100’ buffer zone, the deck and bulkhead were eliminated, and the septic system was relocated.  He again reiterated that the parcel is for sale and if the future owners wanted a different design, they would have to come back to the Commission.   One abutter requested the private road be returned to the original state after construction.  Attorney Chris Gazette, representing the immediate abutter, stated they want to make sure new owners would come back to the Commission if the house plans were changed or made larger.  Ed Simpson moved to approve the NOI; seconded by John DiBlasio; passed 6-0.  Paperwork:  revised site plan      

Wilson, 56 Indian Neck Rd., Map 28, Parcel 48, NOI, slope restoration including slash removal, re-vegetation and construction of single family home (Cont’d from 07/07/10).   Matt Farrell represented the applicant, and provided two alternative analyses as requested.  After a lengthy discussion, the Commission determined Alternative 1 (original plan) was the favored plan.  There will also be little impact on the resource area.  Alternative 2 was to site the dwelling to the south 12 feet so the foundation was out of the 50 foot buffer zone and Alternative 3 was to site the entire structure, including the deck and porch outside the 50 foot buffer zone.  The concrete foundation would have been exposed on the north side in each of these alternatives.  Attorney Sarah Torano-Flores, representing an immediate abutter, stated they would be in favor of Alternative 1 as well.  The commission requested the proposed swale on the north side of the building be removed and a drywell be installed.  Paperwork:  Letter from J. M. O’Reilly &I Associates, Inc. providing alternative analyses.  John DiBlasio moved to approve the NOI, as originally proposed in Alternative 1; seconded by Ed Simpson; passed 5-1.  Supervisor:  Terry Gips      

Footit, 10 Bay View Ave, Map 35, Parcel 33, Certificate of Compliance.   Although he has already received a Certificate of Compliance, Mr. Footit is requesting an ongoing condition to place sediment on the bank.   John DiBlasio moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 6-0.

Perot, 36 Indian Neck Rd., Map 28, Parcel 45, AOOC.  Jason Ellis represented the applicant and explained the house has been reduced in size.  Ellis explained there were minor changes to the disturbed area.  Trudy Vermehren moved to approve the AOOC; seconded by John DiBlasio; passed 6-0.  Paperwork:  Letter and new site plan.

Collins, 68 Village Lane, Map 47, Parcel 4, NOI, Septic upgrade, well, above ground pool, decking, patio
Jason Ellis represented the applicant and gave an overview of the project, stating the septic had failed.  Approval for the septic and well was approved by the Board of Health.  The elevation of the proposed deck around the pool will be at the top of the pool.  Ed Simpson moved to approve the NOI; seconded by Ginie Page; passed 6-0.   

Simpson, 25 Caledonia Path, Map 42, Parcel 83, NOI, new garage.  Ed Simpson recused himself.  Luke Simpson represented his father, giving an overview of the project.  Due to zoning requirements and the desire to maintain trees, the garage was placed within the 100 foot buffer zone.  John DiBlasio moved to approve the NOI; seconded by Trudy Vermehren; passed 5-0.  Supervisor:  Lauren McKean.  Paperwork:  NOI paperwork and backup as well as photos presented by Luke Simpson.

John DiBlasio moved to adjourn at 7:50 pm; seconded by Ginie Page; passed 6-0.
