Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Co-Chair Terry Gips opened the meeting at 4:06 pm.  

The Commission reviewed and edited the educational brochure to be handed out to the public.   

Betsy VanDoran, 150 Old Hay Road, came before the Commission and stated she had some trees cut on her property.  She produced a letter from her sister stating her sister was unaware of the cutting.  She stated she was unaware of the regulations of the wetlands and will educate herself.  The Commission said they would make a site visit to review the work that had been done on the property.

Mac’s Shack, 91 Commercial St., temporary refrigeration unit.  Agent Greenberg-Lemos stated a unit will be permanently placed as previously approved once the property is hooked up to the public water system.   Ginie Page moved to approve the Jurisdictional Opinion to install a temporary refrigeration unit at the site which the commission had viewed; seconded by Ed Simpson, passed 5-0.

Wellfleet Harbor Condos, 205 Commercial St., replace preexisting stairway one-to-one (between Cottages 14 and 15),   After discussing the location of the stairway, Patrick Winslow moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 5-0.

Quinn Buggs, producer from NY, requested to use a  motorcycle on Mayo Beach for filming a commercial on June 14 or 15.  Patrick Winslow moved to approve the use of Town property; seconded by Ed Simpson, with the condition the vehicle be below the high water mark and above the tidal flat; passed 5-0.

Dan Fister of Americorp wrote a letter to the Commission with suggestions for a project that the Americorp members could work on in Wellfleet.  The Commission was receptive of every idea and Agent Greenberg-Lemos will get back to Dan.
 
Public Hearings 5:00 pm:

Loewenberg, 41 Crest Ave., Map 35, Parcel 87.2, NOI, cutting and pruning of trees and vegetation (after the fact filing) Cont’d from 05/19/10.  Chet Lay represented the applicant and provided materials the Commission requested at the 5/19/10.  He stated they would like to flush-cut the locust trees, remove all the debris on the hill, and replant the bare areas with bearberry, Carolina rose and beach grass.  They also requested the removal of two scrub pines located by the dwelling.  Lay stated the applicant would like to do the entire project at one time.  The Commission did not feel the materials provided were specific enough, such as identifying where the new plants will be planted, how many plants, etc.   It was recommended another site visit be made on 6/16/10 at 10:00 am, and a planting plan will be submitted for the 7/7/10 meeting.  Ginie Page moved to continue to 7/7/10 with a site visit planned for 6/17/10; seconded by Patrick Winslow; passed 5-0.

Nicholson, 11 Partridge Way, Map 22, Parcel 24, NOI, construct new dwelling (Cont’d from 05/19/10).  Ginie Page recused herself.  David Lajoie represented the applicant and stated the revised plan identifies the proposed new location of the dwelling, which would be 8 or 9 feet further away from the buffer zone.  There would be a stone driveway, and no significant vegetation will be removed from the property.  He stated the property may not be developed, but if so, the applicant may come back for a view corridor at a later time.   Ed Simpson moved to approve the project; seconded by Patrick Winslow; passed 4-0.  .

Town of Wellfleet, Great Island Landing, Map 18, Parcel 8, restoration of eroded resources, RDA (Cont’d from 05/05/10).  A letter was received from the National Park and Agent Greenberg-Lemos recommended a continuation to August 4, 2010 because of the need of a better plan.  Ginie Page moved to continue to August 4, 2010; seconded by Patrick Winslow; passed 4-0.  McKean recused herself.

Ennis, 204 Kendrick Ave., Map 20, Parcel 27, Certificate of Compliance.  Agent Greenberg-Lemos stated this project is compliant.  Ginie Page moved to approve the Certificate of Compliance; seconded by  Lauren McKean; passed 5-0.  (No filing fee was received so paperwork will be held until fees are paid)

Purcell, 30 Higgins Lane, Map 15, Parcel 119, RDA, repair dike.  Loam and grass seed will be used in the project.  Ginie Page identified the project as a negative 2; seconded by Ed Simpson; passed 5-0.

Cohen, 390 Pleasant Point Ave., Map 36, Parcel 192, RDA, remove landscape timber bulkhead and steps and replace with handicapped accessible ramp and revegetate.  John Fitzgerald represented the applicant and gave an overview of the project.    He stated the ramp surface will use permeable materials.  The Japanese black pine will be replaced with a native species.  Rosa Virginia replace rosa rugosa.  The commission recommended a stone trench for a drip line.  Terry Gips moved to identify this proposal as a Negative 3; seconded by Ginie Page; passed 5-0.

Brown’s Landing Condo Trust, 30 Fox Island Rd., Map 28, Parcel 223, RDA, Repair road surface adjacent to 30 Fox Island Road.  Colin Fleming, representing his father and the condo trust, gave an overview of the project.  He stated the sink holes have gotten deep and wide and the road has narrowed.  They want to fill the sink holes with asphalt and widen the road.  Ginie Page recused herself.  He stated there are five cottages in the condo trust.  He gave a history of the road, how the marsh has grown in along that side of the road covering some of the previously traveled surface, and how the sink holes have made it difficult for passing.  The commission requested the applicant flag the work limit to determine how much vegetation would be removed.  The commission expressed concern with property lines and requested the condo trust contact the Conservation Trust to advise them of the proposed repair.  The commission recommended a land survey, which might already be available.  Ed Simpson moved to continue to 7/7/10; seconded by Patrick Winslow; passed 4-0.

Connelly, 110 Springbrook Rd., Map 47, Parcel 30, NOI, Construct single family dwelling, driveway, septic and well.  The engineer requested a continuation to July 7, 2010.  Ginie Page moved to continue to July 7, 2010 at the request of the engineer; seconded by Patrick Winslow; passed 5-0.  

Ginie Page moved to adjourn at 6:25; seconded by Ed Simpson; passed 5-0.
