Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Co-Chair Ginie Page opened the meeting at 4:00 pm.  

Terry Gips moved to approve the April 7, 2010 meeting minutes as amended; seconded by John DiBlasio; passed 6-0.

Beach / harbor clean up will take place April 24, 2010.  

Jurisdictional Opinions:

Brimm, one-to-one replacement of deck, 160 3rd St.  Ed Simpson moved to approve the Jurisdictional Opinion; seconded by Terry Gips; passed 6-0.

Agger, 81 W. Way #100, remove two 25’ pines which are infested with beetles.  Trudy Vermehren moved to approve the Jurisdictional Opinion with the condition the trees are to be removed from the site; seconded by Patrick Winslow; passed 6-0.

Dewan, 100 W. Main St, construct an 8 x 10 wooden deck supported with two sonotubes.   John DiBlasio moved to approve Jurisdictional Opinion; seconded by Patrick Winslow; passed 6-0.

Korim, 90 School Street, remove trees.  John DiBlasio moved to approve the Jurisdictional Opinion; seconded by Ed Simpson, passed 6-0.

Rheault, 735 Chequessett Neck Rd., remove scotch broom plants and plant with non-invasive plants.  Remove tarmac north of garage and replace with dirt/grass with square pavers.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Terry Vermehren; passed 6-0.

Cohen, 390 Pleasant Point Rd.  The original Order of Conditions did not include a handicapped access ramp.  The owners now want to install a wheel chair access ramp, removing timber wall.  The Commission would like to make a site visit and have the owner file an amendment to the Order of Conditions.  

Patterson, 186 Pleasant Point – requesting an emergency order to repair bulkhead.  Sand is coming out of the bottom.  The project requires excavation, placing fiber rolls and rocks behind the bulk head.  After discussion, the Commission decided they would like an NOI filed with an engineered plan.               
Terry Gips will speak at Town Meeting regarding Article 35 on the warrant and a Patrick Winslow  will speak regarding the Boratko decision for an easement on Water Street (Town owned land.)  
   

Public Hearings 5:00 pm:

Town of Wellfleet, Great Island Landing, Map 18, Parcel 8, restoration of eroded resources, RDA.  John DiBlasio stated he feels this should be a NOI due to the size of the project.  This project was filed with MESA and the town is awaiting response.  John DiBlasio recommended pre and post construction photographs; after completion of path, it must look natural.  He also recommended removing the asphalt, repair the dune, install fencing allowing for turtle access, the path to road must be revegetated, and place a rollout boardwalk.  The Commission would like to make another site visit and have Gordon Peabody explain the project.  Trudy Vermehren moved to continue to May 5, 2010; seconded by John DiBlasio; passed 6-0.

Juster, 30 Indian Neck Rd., Map 28, Parcel 44, RDA, rebuild rear deck and a 7’ x 11’ addition (after the fact filing) (Cont’d from 04/07/10).  Chet Lay represented the applicant and gave description of the downspout and drain locations as well as the French drain for the drip line.  Agent Greenberg-Lemos stated there were three trees topped at the coastal bank along with several stumps.  The Commission recommended Chet Lay return on May 5, 2010, providing a plan identifying walkways, plantings—including all re-vegetation.  Patrick Winslow moved to continue to May 5, 2010; seconded by John DiBlasio, passed 6-0.

Lema (Wellfleet Marketplace), 295 Main St., Map 14, Parcel 181, Request for Extended Order of Conditions (Cont’d from 04/07/10).  Agent Greenberg-Lemos stated there is a signed Purchase and Sale agreement between the owner and buyer.  After further discussion regarding obtaining a mortgage as well as ordering the materials, Terry Gips moved to grant a two month extension (June 21, 2010); seconded by John DiBlasio; passed 6-0.  

Business Cont’d

Boratko warrant – The Commissioners discussed the wording of Attorney Ben Zehnder’s written recommendation.  Agent Greenberg-Lemos recommended a statement be made at Town Meeting identifying the reasons why the decision of the Conservation Commission was made.  

Terry Gips  moved to adjourn at 6:03 pm; seconded by Ed Simpson; passed 6-0.
