Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Ginie Page opened the business meeting at 4:00 pm.

Chris Wickson of East Cape Engineering reported the Wellfleet Market 21E paperwork is completed and was sent to the attorney’s.  He reported nothing has been done between the owners and potential buyer.  The septic was inspected and is fine at this point in time.  

Andrew Petty read two letters from Allison Palmer of 70 Lookout Road dated 12/29/09 and 1/9/10 regarding shell fishermen parking on the beach and on Conservation Trust property.  She questioned who is responsible for enforcement.  There was discussion regarding enforcement from the Police, the Shellfish Warden, and the lack of manpower from the Conservation Department.  Agent Greenberg-Lemos suggested inviting Allison Palmer and the Police to a Conservation Commission meeting to discuss a possible solution.    

Meeting minutes of 1/6/10 will be reviewed at the February 3, 2010 meeting.

The Commission reviewed a map provided by the Cape Cod Commission of the ACEC.  There was discussion regarding the National Seashore boundary property going seaward and Greenberg-Lemos questioned if the Commission should be responsible.  She also questioned if the Commission should have a buffer zone around the flood plain.  The Commission will come back with their remarks and recommendations.  Terry Gips moved that the Commission recommend using the existing line of the ACEC without an additional 50’ buffer zone and no additional 50’ buffer zone for the flood plain; seconded by John DiBlasio; passed 4-0.   Agent Greenberg-Lemos will work on the revised regulations to be presented in a Warrant at the Spring Town Meeting.

Public Hearings:

Chequessett Yacht & Country Club, 675 Chequessett Neck Rd., Map 19, Parcel 115, NOI, AOOC:  drainage repair.  Laruen McKean recused herself because she works for the National Seashore which is an abutter.  Barbara Boone and Dave Stott stated this is amendment to a previous NOI.  Boone stated the drainage is going off the course and they would still like to open up the ditch and remove the piping and keep the ditch open.  The Commission requested Boone supply the test results from the field borings.    Stott stated by removing the pipe, it will help with the water flow and add a water feature to the course.  Terry Gips moved to continue to February 3, 2010; seconded by John DiBlasio; passed 3-0.

Lockwood, Map 22, Parcel 8.1, 110 Sandpiper Hill, NOI, remove and replace single family dwelling (Cont’d from 01/06/10).  Emily Beebe, Attorney Ben Zehnder, and Mr and Mrs Lockwood came to the table.  A new site plan dated 1/11/10 was reviewed.  Beebe stated the proposed footprint of the new dwelling will be 494 square feet within the 50’ buffer zone which will be a 59% reduction of developed area which includes buildings, paths, the parking area, decking, etc. and a 10% increase of disturbance in the 100’ buffer zone.  Beebe reviewed the reductions of the proposal from the first application, the second and what is before the Commission at this point.   The current plan represents a 31.7% overall reduction in disturbance compared to the original plan.  Bill Reilly, attorney for abutter Leander, read a letter on her behalf as well as several other abutters, requesting alternative plans because they feel the building will change the character of the neighborhood.  Greenberg-Lemos read a letter dated 1/20/10 from Elizabeth Lovejoy, an abutter, expressing concerns with their views and impacts to the  neighborhood and requested the Lockwood’s limit the size of the dwelling.  Attorney Zehnder stated it is not the jurisdiction of the Commission to consider issues with views.  Agent Greenberg-Lemos asked if there is a benchmark on the revetment wall and stated that when the mark is showing, action should be taken with regard to renourishment.  Terry Gips moved to approve the NOI with conditions; seconded by John DiBlasio; passed 3 with one abstention by McKean.  She requested the Commission provide an overview of the changes the applicant provided based on the requests of the Commission from the last meeting.    Supervisor:  Terry Gips.            

Terry Gips moved to adjourn at 5:50 pm; seconded by John DiBlasio; passed 4-0.
