Jurisdictional Opinion:
Trow, 370 Cove Road, 8 x 12 wooden shed, John DiBlasio moved to approve the Jurisdictional Opinion; seconded by Terry Gips; passed 6-0.

Spagnoli, 105 Catboat Rd., remove three dead pine trees in front of dwelling and two dead trees in the back.  Patrick Winslow moved to approve the Jurisdictional Opinion; seconded by Trudy Vermehren; passed 6-0.

French Bistro, 15 LeCount Hollow Rd; remove four dead poplar trees and remove choke cherry and bittersweet bushes.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 6-0.

Other Business:  
Eurich, 1065 Chequessett Neck Rd. (Currier property).  Mr. Eurich presented drawings of the approved plans of 2004 and a proposed plan allowing better views for the dwelling.  Reggie Donoghue of Coastal Engineering provided technical information to the Commission.   There was discussion regarding the elevations of the site, location of decking and stairs, and the vegetation on the property.  An amendment to the Order of Conditions will be submitted to the Commission in the future.

Public Hearings 5:00 pm:

Miller, 116 Hiawatha, Map 28, Parcel 182, Amended Order of Conditions.  Tim Brady of East Cape Engineering represented the applicant and the proposed changes are to have a crawl space foundation versus a slab foundation.  The impact on the ground will be exactly the same and the crawl space will allow plumbing, duct work, and installing the insulation.   Other proposed changes include having a pergola instead of a patio which was approved.  The plans for the stairs to the basement will be concrete instead of wood.  A landscape plan was presented which includes removing the permanent driveway and replacing it with a pervious driveway.  The outdoor shower will require a drywell.  The Commission requested the flagstone walkway be relocated north to avoid additional walking on the vegetation and creating paths.  Trudy Vermehren moved to approve the amendment; seconded by Terry Gips; passed 6-0  with new conditions.

Pyles, NOI, Map 41, Parcel 121, 110 Bayberry Lane, new dwelling (Cont’d from 10/21/09).  Two e-mail letters from neighbor Zellner opposed the project based on water quality in the neighborhood and ecology issues as well as natural beauty.  An e-mail from John Grieb requested the Commission continue the hearing in order for his engineer to review the project.  John O’Reilly represented the applicant and advised the Commissioners that a letter from Natural Heritage stated there would be no take with the project.  The total footprint is just over 2,020 square feet which includes the garage.  The revised plans show a retaining wall of boulders; the well would be within the 50 foot buffer zone.  Meeting minutes of 10/21/09 were read into the record.  The entire project is within the ACEC and within the 100 foot buffer zone.  O’Reilly stated the total disturbance is approximately 4,500 square feet or 18% of lot coverage within the 100 foot buffer zone.  There was discussion regarding the quality of the water in the neighborhood.  O’Reilly stated there will be gutters and dry wells.  Patrick Winslow moved to approve the NOI; seconded by Ed Simpson; approved 4-2.  Supervisor:  Trudy Vermehren

Moore, 975 Chequessett Neck Rd., Map 19, Parcel 96, NOI, Install Wind Spire.  Mark Robinson represented the applicant and gave an overview of the proposed wind spire.  Robinson stated he will vacuum the hole for the pole footing placement.  A temporary ladder will be used to carry the materials to the site.  He stated the wind generating unit is very quiet when in use and has a good record of no bird strikes.  The cable from the unit to the dwelling will be a narrow trench.  Abutter Currier requested to see the site plan.  Robinson stated no trees will be removed for installation and the trees close to the wind spire will be topped when necessary.  John DiBlasio moved to approve the NOI; seconded by Terry Gips; passed 6-0 with conditions.  Supervisor:  John DiBlasio

Collins, 51 9th St., Map 40, Parcel 156, NOI, deck and stairs (Cont’d from 11/04/09).  The applicant requested a continuation. Terry Gips  moved to continue to 12/2/09; seconded by John DiBlasio; passed 6-0.

Schopp, 75 Cannon Hill Rd., Map 30, Parcel 144, NOI, replace deck with three season screened porch and decking, construct outside stairway, new basement entrance, new entry and laundry room (Cont’d from 11/04/09).  Revised plans were presented to the Commission.  The contractor stated all tree removal will be done by hand within the work limit.  It was recommended the bamboo be removed or contained.  Ed Simpson moved to approve the NOI; seconded by John DiBlasio; passed 6-0.   Supervisor:  Patrick Winslow.

Terry Gips moved to include pre and post photographs as a standard condition in all projects approved by the Commission; seconded by Patrick Winslow; 6-0.

Ginie Page moved to adjourn at 6:55 pm; seconded by Terry Gips; passed 6-0.
