Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report

Co-Chair Terry Gips called the business meeting to order at 4:02 pm.  

Ed Simpson moved to approve the meeting minutes of 10/07/09 as amended; seconded Ginie Page; passed 3-0.
Ginie Page moved to approve the 10/21/09 meeting minutes as amended; seconded by Patrick Winslow; passed 4-0.

Don Eurich 1065 Chequessett Neck Rd, (former Currier property), presented three plans which he would like the Commission to consider with regards to rebuilding the structure on the property.  One plan which stayed within the current footprint, had been previously approved by the Commission; one changed the shape of the footprint, extended one corner of the house more into the flood zone, and moved and reshaped the turn-around area behind the house; and the other plan added a 2nd building and pulled the main dwelling out of the flood plain. The Commission stated they were concerned with any new land disturbance and potential damage to more of the dune.  The Commission did not want any further encroachment in the flood plain.   Mr. Eurich displayed pictures of an abandoned well and the materials that were removed from the area.  He started constructing a cover and deck over the well house but has stopped any further work.  The approved condition was to remove the well and replant over it.  Ginie Page was concerned about the traffic to the deck and the degradation of the land.  The Commission will review the approved Order of Conditions, the meeting minutes, and will make a site visit.  Mr. Eurich will come back to the Board for the discussion.  

Agent Greenberg reminded the Commission that applicants must provide an alternative analysis.

Jurisdictional Opinions::
Brunt, Map 35 Parcel 22, 500 Old Wharf Road, replace a deck, one to one footings.  The distance to the marsh is 81 feet and the decking requires replacement due to safety reasons.  Ed Simpson moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 4-0.

Garza, Map 40, Parcel 135, 55 6th St., install leach area which is 100’ from coastal bank.  Patrick Winslow moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 4-0.

William Connell wrote a letter regarding Mayo Beach dune grass.  New paths are being made by people and he recommended putting up snow fencing.  The Commission will make a site visit and discuss the issue.

Mail:  an Editorial regarding endangered species

There will be an Ocean Management Plan meeting on Thursday, 11/5/09 at the Center of Coastal Studies in Provincetown.  The State of the Harbor Conference will be held on 11/14/009 at the Wellfleet Elementary School.

Agent Greenberg reported RFP’s for Mayo Creek are due on 11/9/09 and there will be a meeting to select who the proposal will go to.  She invited members of the Commission to be involved.

Public Hearings:

5:00 pm  CityplaceFranklin, 30 State St., Map 36, Parcel 30, Certificate of Compliance.  A site visit was made and the project was constructed according to plans.  Patrick Winslow moved to approve the Certificate of Compliance; seconded by Ginie Page; passed 4-0.

5:04 pm  Collins, 51 9th St., Map 40, Parcel 156, NOI, deck and stairs (Cont’d from 10/21/009)  Don Monroe from Coastal Engineering presented revised plans noting the access for the beach and stated the lower deck will be removed.  He identified the amount of renourishment required based on profiles.  Natural Heritage had not had an opportunity to review the plan.  Ed Simpson moved to continue to 11/18/09; seconded by Ginie Page; passed 4-0.

Cohen, 390 Pleasant Point Ave., Map 36, Parcel 192, NOI, new deck and stairs.  Chet Lay represented the applicant and stated the total impact within the buffer zone would be 7 square feet.  All building materials will be stored in the gravel driveway.  Agent Greenberg request the current construction debris currently scattered on the property be moved to the driveway.  The Commission was concerned about a new path being made from the proposed stairway as well as the lack of sun under the decking.  Chet Lay recommended moving the location of the stairway to accommodate the Commission;  this would result in one less sonotube for the construction.  The Builder stated he would have to replace the existing decking to make it safer.  Revised plans will be submitted to the Agent.  Patrick Winslow moved to approve the NOI; seconded by Ed Simpson; passed 4-0.  Supervisor:  Terry Gips

Silvetti/Machado, 35 Main St., Map 15, Parcel 125, NOI, replace existing screen porch and add 2nd story bedroom and dormer and add 40 feet dry-stack retaining wall on south side of porch.  Bruce Miller, Architect, represented the applicant and gave an overview of the construction on the house.  He stated the footings on the existing screen porch are not up to current code but there may be may be an alternative to putting in a 4-foot foundation. This will be determined when construction is begun.  Agent Greenberg requested the homeowner provide a single site plan containing all the necessary information (rather than multiple plans) and more information on the dry-stack retaining wall.  Bruce Miller requested removing the dry-stack retaining wall from the application and coming back for the wall as an amendment.  Agent Greenberg read a letter into the record from abutter Buttignol stating their concerns regarding the proposed work on the dry-stack retaining wall and provided history of work done by the owners within the wetlands.  It was noted there were materials located on the Buttignol property and a letter will be written to him regarding removing the materials.  Ginie Page moved to approve the NOI, seconded by Patrick Winslow; passed 4-0.  Supervisor:  Ed Simpson

Schopp, 75 Cannon Hill Rd., Map 30, Parcel 144, NOI, replace deck with three season screened porch and decking, construct outside stairway, new basement entrance, new entry and laundry room.  Chet Lay represented the applicant and gave an overview of the project, stating the current deck is not safe.  There will be a total of 7 sono-tubes.  Under the screen porch, an entrance way is proposed to allow storage in the cellar.  The greenhouse will be removed for the new entry and laundry room and excavation and removal of materials of the entrance will be done by hand.  The propane tank will be moved to another location.  After discussing the proposed design of the entranceway in the cellar, the builder stated he would reduce the size of the doors so there would be no disturbance at ground level and no retaining walls. The porch will be guttered with down spouts and dry welled.  There are trees to be removed on the property as well.  The Commissioners requested revised plans.  Ginie Page moved to continue to 11/18/09; seconded by Ed Simpson; passed 4-0.
