Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair Ginie Page, John DiBlasio, Terry Gips, Trudy Vermehren, Patrick Winslow, and Ed Simpson.   
Staff Present:  Agent Hillary Greenberg, Assistant Agent Andrew Petty, and Christine Bates, Committee Secretary
        
4:00 - Business Meeting & Conservation Agent's Report.  Ginie Page opened the meeting at 4:08 pm.  

There was discussion regarding some of the tree clearings, road clearings, etc.  Andrew Petty stated a letter is sent from the Conservation office to those people performing the violations requesting they come to the Conservation Agent’s office.  There was also discussion regarding the dumping of branches in marshes, etc.

Ginie Page stated because of the repairs required on the Lt. Island bridge, we must add a condition to those properties located on Lt. Island  to have the contractors/builders check the bridge both before and after taking heavy loads over the bridge as well as be bonded.  The Town should not be responsible for repairing the bridge due to construction on private property.  

John DiBlasio stated he had a conversation with Brent Valli.  The Commission has been concerned with his keeping the barge in the same location, damaging the grass for over three years.  Agent Greenberg requested DiBlasio ask him if he is planning on using the barge in the future, and if not, would he consider selling the barge.    

The Commission discussed kayaks and other vessels left on Town property and landings along the waterways and how to effectively remove them.  Options included writing an article in the newspaper advising owners that vessels remaining on the property would be tagged and then moved to the sandpit; permitting kayaks with stickers and building racks for seasonal use/storage; and renting spaces in the racks.   Andrew Petty stated there currently are designated areas for boat storage on the sand with designated signage.  If appropriate publicity were generated regarding the abandoned vessels, it is the hope people will remove the vessels.  John DiBlasio volunteered to write a first draft of a small vessel (kayaks, canoes, sunfish)  policy.           

Agent Greenberg invited members of the Commission to join the Technical Commission for the Mayo Creek Restoration project.  It would entail working with consultants and coming up with a plan.  The RFP is still being drafted and a consultant has to be chosen.  Trudy Vermahren volunteered.      

Public Hearings:  
5:00 pm
Adams, Lot 29, Rte 6, Map 36, Parcel 262.1, Certificate of Compliance.  Andrew Petty made a site visit and stated it is in compliance.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Terry Gips; passed 6-0.

5:04 pm
LaPoint, RDA, shellfish grant (Cont’d from 09/02/09).  Due to a lack of correspondence from the Army Corp, Trudy Vermehren moved to continue to 10/7/09; seconded by Terry Gips, passed 6-0.

Pyles, NOI, Map 41, Parcel 121, 110 Bayberry Lane, new dwelling (Cont’d from 08/19/09).  The applicant’s engineer requested a continuation to 10/21/09; Terry Gips moved to continue to 10/21/09; seconded by John DiBlasio; passed 6-0.

Collins, 11th Street, Map 40, Parcel 156, Certificate of Compliance.  Don Monroe of Coastal Engineering represented the applicant with a 1988 Order of Condition for sand fencing and beach grass.  There will be a nourishment clause from the State for future nourishment.  Monroe stated he has talked with Thaler’s lawyer regarding access to the beach for their work as well.  Terry Gips moved to approve the Certificate of Compliance; seconded by John DiBlasio; passed 6-0.

Collins, 51 9th St., Map 40, Parcel 156, NOI, deck and stairs (Cont’d from 08/19/09).  Agent Greenberg read a letter requesting a continuation to 10/21/09.  Patrick Winslow moved to continue to 10/21/09 per the applicant; seconded by Trudy; passed 6-0.

Business cont’d:

Agent Greenberg stated she is continuing the $1,400 weekly fines to Martin Reilly for lack of compliance with the nourishment issues.

John DiBlasio moved to approve the 8/19/09 meeting minutes as amended; seconded by Trudy Vermahreen; passed 6-0.

John DiBlasio moved to approve the 9/2/09 meeting minutes as amended; seconded by Ed Simpson; passed 5-0.

John DiBlasio moved to adjourn at 7:35 pm; seconded by Ed Simpson; passed 6-0.
