Minutes of Conservation Commission Public Meeting

4:10 - Business Meeting & Conservation Agent's Report.  Ginie Page opened the meeting at 4:10 pm.  

David Rowell represented Malcynsky who had received a Determination of Applicability.  The owners want to make a change to the original plans by shifting the area approximately five feet towards the beach to accommodate the outdoor shower.   There will be no further disturbance.  Patrick Winslow moved to approve an amendment to the RDA; seconded by John DiBlasio; passed 4-0.

Moore - 975 Chequessett Neck Rd – an NOI was approved for a new stone revetment.  There was a Jurisdictional Opinion to transport a well rig out to do test borings.  They are requesting approval to allow an excavator and a trailer to transport the well rig and regrade the surface after the project is complete.  John DiBlasio moved to approve the amendment to the Jurisdictional Opinion; seconded by Ed Simpson; passed 4-0.

Tony Massari wrote a letter regarding a 6” x 6” communication post on the Stossel property.  Andrew Petty suggested writing a letter to Stossel requesting a Jurisdictional Opinion be filed for the communication post.  

Patrick Winslow read letters written by Agent Greenberg to those people receiving fines for violating their Orders of Conditions.  

MAIL:  
A letter from East Cape Engineering provided information on 170 Pond Avenue regarding the appeal by the Drummer Cove Association.  

Brochure from Community Planning on upcoming seminars, MASS Wildlife News ad MACC newsletter.  

Ginie suggested a party after the site visit to recognize those that have retired from the Commission on Sept. 16, 2009.

Meeting minutes of 7/15/09 were reviewed.  John DiBlasio moved to approve the 7/15/09 as amended; seconded by Ed Simpson; passed 4-0.

John DiBlasio moved the meeting minutes of 8/19/09 as amended; seconded by Trudy; passed 4-0.
   
Public Hearings:  
5:00 pm
MacDonald, Map 40, Parcel 147, 31 9th St., Request for extension.  Mrs. MacDonald stated due to the economy, they were unable to start the project.  A two-year extension was request ed. Trudy Vermehren moved to approve the two-year extension; seconded by John DiBlasio; passed 5-0.

Back, Map 41, Parcel 12, 190 Blue Heron Rd., Certificate of Compliance.  Andrew Petty stated the project is complete.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Patrick Winslow; passed 5-0.

LaPoint, RDA, shellfish grant (Cont’d from 08/19/09).  Due to a lack of approval from the Army Corps of Engineers, Trudy Vermehren moved to continue to 9/16/09; seconded by John DiBlasio; passed 5--0.

Thaler, 250 Meadow Ave W., Map 40, Parcel 158, NOI, sandbags and drift fencing (Cont’d from 08/19/09).  Sarah Torano Flores represented the applicant, stating the NHESP did issue a final signed permit.  Andrew Petty stated any information provided to any state agencies should be copied to the Commission.  Bob Prescott stated he had concerns with the piping plovers and that there is only one beach remaining for the plovers’ nesting areas.  He stated there is an established wrack line and would like to have a condition added that there will be yearly monitoring.  Petty stated NHESP has provided conditions for the beach area and will be reviewed in the March timeframe annually.  John DiBlasio moved to approve the NOI with conditions; seconded by Ed Simpson; passed 5-0.

Bressler, Map 23, Parcel 7, 60I Designers Rd., NOI, addition to existing structure.  Chet Lay represented the applicant and a positive letter was received from MESA.  This will be a 420 square foot addition with a full foundation.  Work will be 82 feet from the wetlands.  It was recommended dry wells be added.  Trudy Vermehren moved to approve the NOI with conditions; seconded by Patrick Winslow; passed 4-0.  Supervisor:  Trudy Vermehren

Massari, Map 34, Parcel 13, 244 King Phillip Rd., NOI, construct deck adjacent to beach stairs.  Mr. Massari gave an overview of the project.  Massari stated he has an Order of Conditions stating his responsibility for renourishment and he has had it reviewed this year and everything is fine.  Trudy Vermehren moved to approve the NOI; seconded by Patrick Winslow with conditions; passed 4-1.  Supervisor:  Ed Simpson

Rheault, Map 19, Parcel 112, 735 Chequessett Neck Rd., NOI, repairs to revetment.  Don Monroe represented the applicant and gave an overview of the project.  The revetment is licensed by the state and is starting to show signs of slumping.  The new wall will be built in sections on the same location.  There will be no work done on the groin.  Refer to DMF conditions.  Trudy Vermehren moved to approve the NOI; seconded by Patrick Winslow; passed 5-0 with conditions.  Supervisor:  Ginie Page.
