Minutes of Conservation Commission Public Meeting

4:00 - Business Meeting & Conservation Agent's Report
Ginie Page opened the meeting at 4:05 pm.  

Mail:  Brochures, information on tomato late blight, slow growth 40B housing and newsletter regarding removing nitrogen and phosphorus.

John Riehl reported the State of Wellfleet Harbor Conference will be held on November 14, 2009 at the Elementary School cafeteria.  Speakers will be Jack Clark, Peter Markunus, John Portnoy, Jo Ann Muramoto and Tim Smith.   He also stated the NRAB is undertaking an effort to look at Wellfleet ponds and prepare a brief report with recommendations.  He stated if anyone on the Commission would like to make recommendations or ask questions on shore issues and beach utilization they would appreciate it.  Agent Greenberg stated she received a $40,000 grant for Mayo Creek Restoration.  

Jurisdictional Opinions:

David Aggar, 85 Belding Way,  28/11, crown reduction/ pruning trees on the back side of his house.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Patrick Winslow; passed 4-0.

Don and Nancy Peliquin, Harborside Village, replace 8 x 8 shed with 8 x 10 shed.  This would be in compliance with the plan.  Terry Gips moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

Woods Hole Group – Task 1.  Terry Gips stated the content is fine; however, she feels there should be a map with the numbers corresponding to the pictures or to the particular areas that are being assessed.  She feels the pictures are mislabeled.  She was not familiar with some of the terminology, such as 1st, 2nd and 3rd bank.  Terry Gips will write a list of her recommendations to be forwarded to Agent Greenberg.  The Commission would like to see results of the beach sand sieve analysis.  The Commission would like information on beach access, linear feet of revetments, linear feet of beach at high tide and linear feet of salt marshes.   They would like dates and time of tide on photographs.  There was no documentation regarding the meeting with the Shellfish Advisory Board.  

Agent Greenberg distributed legal documents pertaining to a  court resolution between Warren Woods and Doris Olive.  The case is settled and Agent Greenberg felt this document would be helpful when Coastal Engineering comes to the meeting on August 19th  to discuss the work with various parties from Lt. Island regarding beach renourishment.  She reported Warren Woods appealed the amended order of conditions for Drew.    

There was discussion regarding parking by various entities such as Pearl, beach sticker office, events at Beds and Breakfasts and how it is affecting the people who own boats at the harbor.  Agent Greenberg reported there is water pooling at the Pearl over the septic system.  

Terry Gips moved to approve the meeting minutes from  July 1, 2009; seconded by John DiBlasio; passed 5-0.

LaPoint, RDA, Aquaculture grant (Cont’d from 07/01/09).  John DiBlasio moved to continue to August 19, 2009; seconded by Terry Gips; passed 5-0 to await word from the Army Corp of Engineers.

placeKew, Certificate of Compliance, 82 Wiles Lane, Map 16, Parcel 631.  A site visit was made and project is in compliance.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 5-0.

Ferris, Certificate of Compliance, 1005 3rd Ave, Map 40, Parcel 8.  Agent Greenberg stated the project is in compliance.  Terry Gips moved the Certificate of Compliance; seconded by Patrick Winslow; passed

Huge, Certificate of Compliance, 264 King Phillip Rd., Map 34, Parcel 9.  Andrew Petty reported nourishment was done in April and there will be a condition for renourishment in perpetuity.  John DiBlasio moved to approve the Certificate of Compliance; seconded by Patrick Winslow; passed 5-0.

Simpson, Amendment to Order of Conditions, 780 Ocean View Dr;., Map 17, Parcel 3.  Ed Simpson recused himself.  The dwelling will be two feet lower in elevation and the decking has been reconfigured.  The new structure is outside of the buffer zone.  The original conditions shall remain the same.  Terry Gips moved to approve the Amended Order Of Conditions; seconded by Patrick Winslow; passed 4-0.  John DiBlasio - Supervisor

Glaze, RDA, 625 Old Wharf Rd., Map 31, Parcel 14, Add Deck .  Mr. Glaze stated he will be making a walkway from the deck to the driveway.  Ginie recommended a pre-fabricated wood pathway.  John DiBlasio identified this as a Negative 3; seconded by Ginie Page; passed 5-0.

Preservation Hall, NOI, 335 Main Street, Map 14, Parcel 173, renovation to buildings and add pervious pavers for driveway.  Reggie Donaghue from Coastal Engineering represented the applicant along with    architect Jim Hadley, landscape architect Patty Crow. Anne Suggs of Preservation Hall also attended.  Donaghue gave an overview of the project.  The proposed work is all within the previously disturbed area.   Donaghue stated the pervious pavers should eliminate any problems with runoff at the bottom of the driveway.  There is a maintenance plan for the gutter system.  There will be handicapped access on the new lower level in the back of the new addition.  There will be a commercial kitchen in the building.  The building and septic contract will be issued as one permit and there will be coordination with the Town regarding construction in the off-season.  Hadley stated the current building is stable.  Natural Heritage has not responded.  Terry Gips moved to continue to August 19, 2009; seconded by John DiBlasio; passed 5-0.

Pyles, NOI, Map 41, Parcel 121, 170 Bayberry Lane, new dwelling.  Engineer John O’Reily and Designer Peter Koneen gave an overview of the project.  O’Reily gave a history of the property, stating the lots were subdivided.  He explained the old order of conditions were for the former parcel numbers prior to the subdivision changes.  The proposed house and deck will be between the 100’ and 50’ lines from the top of the bank and within the ACEC.    The septic is outside of the buffer zone.  The footprint will be 2,020 square feet.  The well will be within the 50’ buffer zone.  A landscape plan and construction protocol will be provided.  Natural Heritage has not responded as yet.  The 415 square foot deck will be elevated and the supports will be hand dug.  There will be an egress under the deck and the area will be returned to grade and vegetated.  Drip lines will be utilized, along with stone beds.  The driveway will be stone or shell.  Terry Gips questioned if the clients would consider eliminating the garage and Koneen stated there are no alternatives for storage, and if the building were to be reduced, he didn’t feel it would change the impact to the resource.   O’Reily stated there is no parking area on the lot, and feels the garage will not impact the property any more than a parking area.  Abutter John Grieb stated he has concerns about putting structures on the property because it is all within the buffer zone.  There was discussion regarding the Conservation Trust and how conservation land land can be acquired.  Terry Gips moved to continue to August 19, 2009, pending additional paperwork; seconded by John DiBlasio; passed 5-0.

Thayler, 250 Meadow Ave West, Map 40, Parcel 158, NOI, installation of sandbags and sand drift fencing (Cont’d from 06/17/09).  At the request of the applicant, Terry Gips moved to continue to August 19, 2009; seconded Ed Simpson; passed 5-0.
